[Organizational negligence in hospitals: understanding and mitigating the risks of criminal liability].

The increasing complexity of medical treatment processes, shortages of qualified personnel, and the division of labor in modern hospitals heighten the risk of legal violations. This article examines the criminal and administrative liability of hospital managers and other persons in positions of responsibility in cases involving organizational negligence arising from deficiencies in the hospital's organizational structure and supervision (Organisationsverschulden). It demonstrates that an effective compliance management system serves not only to mitigate liability risks but also constitutes an essential instrument for ensuring patient safety, legal compliance, and organizational resilience.
