The application of civil commitment law and practices to a case of delusional disorder: a cross-national comparison of legal approaches in the United States and the United Kingdom.

Legal approaches to civil commitment in the United States and the United Kingdom are compared. A concise overview of the historical evolution of civil commitment in both countries precedes a discussion of the present scheme of commitment standards in each system. These current standards in U.S. and U.K. jurisdictions are then applied to a hypothetical case of delusional disorder. A discussion of the constructive use of civil commitment in patients with delusional disorder who may be dangerous focuses on its value as a preventive measure against potential harm to self or others, as well as the

Involuntary psychiatric hospitalization of minors.

Hospital records of the psychiatric hospitalization of minors living in the south of Israel were studied retrospectively for age, diagnosis and legal status on admission. The records of those minors who were involuntary hospitalized were investigated for behavioural symptomatology and justification for involuntary hospitalization. A range of psychiatric diagnoses was found, excluding diagnoses of schizophrenia and bipolar affective disorder. Explanations for these findings are offered.

Characteristics of Involuntarily Admitted Patients and Treatment Patterns Over a 21-Year Observation Period.

BACKGROUND: Patients suffering from psychiatric disorders are often treated in locked psychiatric units owing to psychomotor agitation, hostility and aggressive behavior, or suicidality. Because of legal conditions, investigations of these acutely ill patients are difficult, and many studies do not represent real-life psychiatry. In Austria, admission to a locked psychiatric unit is regulated by a national law for involuntary admission, which came into effect in 1991. The current retrospective study investigated the management of patients who were admitted involuntarily to an academic treatmen

[Associations of short-term evaluation assessments and patient characteristics with the use of coercive measures].

BACKGROUND: Dutch mental health care institutes are currently making a tremendous effort to reduce the number of coercive measures they impose, such as seclusion. Despite this effort, a group of patients are still being subjected to enforced medication or seclusion. AIM: To obtain more knowledge about which patient characteristics are associated with coercive measures and thereby to identify signs that could be acted upon at an earlier stage to prevent deterioration of the patient's condition and reduce the need for coercive measures. METHOD: We performed a prospective, naturalistic three-mo

Profile of children placed in residential psychiatric program: Association with delinquency, involuntary mental health commitment, and reentry into care.

This study examined characteristics and profiles of youth receiving services in 1 of Florida's Medicaid-funded residential mental health treatment programs--State Inpatient Psychiatric Program (SIPP)--between July 1, 2004, and June 30, 2008 (N=1,432). Latent class analysis (LCA) was used to classify youth, and 3 classes were identified: Children With Multiple Needs, Children With No Caregivers, and Abused Children With Substantial Maltreatment History. The results of LCA showed that Children With Multiple Needs experienced the greatest risk for adverse outcomes. Compared with youth in the othe

[Pregnant and mentally incompetent].

Two women, aged 31 and 36 years, under treatment for schizophrenia and psychotic episodes, respectively, became pregnant and decided to discontinue their medication. Thereupon the psychiatric disorder recurred and they refused--i.e. they were unable--to consent to a proposed treatment or investigation regarding their pregnancies. The necessary consent had to be obtained from a legal guardian. This was the husband in the first, urgent case. In the second case approval from the judge was obtained for the patient to be admitted against her will to protect her life and that of the foetus. In the N

[Ethics: A tool for combating inequalities in the perception of constraints].

Psychiatry sometimes treats patients who do not acknowledge or resist treatment and who continue to face stigma in our society. Across the country, psychiatric inpatient units operate under a wide variety of service models, which influences how patients' rights are exercised and the nature of the caregiving work. Healthcare professionals from Brittany and Île-de-France highlight the importance of an ethical approach that fosters the therapeutic alliance. Breaking down barriers will help bring psychiatry further into the community and foster a different perspective on the "strangeness" of psych

[Long and short stays under ASPPI: Comparison of clinical and non-clinical data from 250 initial certificates].

BACKGROUND: On July 5, 2011, France introduced a law permitting the involuntary admission of patients considered to be in "imminent danger" into psychiatric care without the consent of the family. This is known as "admission en soins psychiatriques pour péril imminent"(ASPPI). ASPPI authorizes all physicians to hospitalize a patient without his or her consent nor the consent of a third party. This differs from previous measures as only one certificate is needed. The law also requires involuntarily admitted patients to present themselves before a judge specialized in Liberties and Detentions (j

Psychiatric care or social defense? The origins of a controversy over the responsibility of the mentally ill in French forensic psychiatry.

While some countries like Belgium chose a penal system clearly inspired by social-defense theories for mentally disturbed criminals, the French law hasn't been consistent and varies from the enlightened classical law and social-defense law. Indeed paragraph 1 of article 122-1 states that people whose discernment or control is abolished by a psychiatric disorder are non-responsible respecting the classical logic of law. On the other hand, Paragraph 2 of Article 122-1 allows the mentally ill to be judged responsible whereas no institution exists to take care about them. Then the system of psychi

Analysing risk factors for involuntary admission from an intersectional perspective: A latent class analysis.

BACKGROUND: Involuntary admission (IA) is a contentious practice in mental healthcare, justified only to prevent harm to self or others. Previous studies have identified individual sociodemographic characteristics as risk factors for IA. Intersectional theories argue that such approaches overlook the complexities of social identities and related health inequalities. Intersectionality stresses the interconnected nature of social identities, such as race or class, and analyses how these overlapping factors create unique experiences of marginalisation and discrimination. This study aimed to adopt

Parental hostage takers.

Three men presented to a single regional secure psychiatric unit over a twelve-month period, after taking their youngest child hostage in their own homes because of a threatened separation from the family. In each case the episode had escalated because of hostility to police involvement in what for them was a typical domestic upheaval. All cases ended without injury. In each man, substance abuse, a family history of domestic violence and fears of rejection were prominent, and the recent birth of a child may have been an added precipitant. There may be a common family structure which predispose

Linking Mental Disorder and Risk in Sexually Violent Person Assessments.

A common criticism of sexually violent person (SVP) laws is that psychiatric commitment has been co-opted to continue the incarceration of dangerous criminals, not dangerous individuals with mental illness. This opinion may have credence because some forensic clinicians use a "silo" approach (i.e., diagnosing based on historical criminal behavior rather than current symptomatology, and formulating risk for future sexual violence based on actuarial scores rather than characteristics and features of the mental condition). A silo process fosters a missing link; namely, the absence of a nexus betw

Intrauterine death at term in a cocaine user detained under the Mental Health Act.

We report the case of a 31-year-old woman who presented at 23 weeks gestation following a mixed overdose of medication. She was detained under the Mental Health Act 1983/2007 for ongoing suicidal ideation and heavy cocaine use. She had a normal nuchal scan, and unremarkable anomaly and growth scans at 19, 29, 32 and 34 weeks. At 40 weeks, an ultrasound scan confirmed fetal demise. A macerated male stillborn was delivered by forceps. Women with mental health and substance misuse problems may have reduced awareness of fetal movements, and they may be poor historians or frequent attenders for non

The potential for antimicrobials to adversely affect mental state.

This is a case report highlighting the influence that antimicrobials (clarithromycin in particular) can have on one's mental state. We discuss the case of a middle-aged woman who presented to an acute admissions unit under Irish Mental Health Act for involuntary admission because of concerns expressed by her family and general practitioner regarding a recent change in behaviour and onset of irritable mood. This lady was diagnosed with an episode of mania that was thought to be precipitated by a combination of psychosocial stressors, recent discontinuation of psychotropic medication and complic

Voluntary vs. involuntary hospital admission in acute mania of bipolar disorder: results from the Swiss sample of the EMBLEM study.

BACKGROUND: Patients with acute mania in bipolar disorder require pharmacological treatment to reduce symptoms. In addition, it is recognised that admission status is a clinically relevant aspect of bipolar disorder. There is, however, a lack of published data assessing the association of admission status with clinical or functional outcomes. The European-Mania-in-Bipolar-Longitudinal-Evaluation-of-Medication (EMBLEM) study has been designed to describe outcomes associated with medication therapies. Baseline data from this study are now available and we used these data to examine the character

Involuntary psychiatric hospitalization in Italy: critical issues in the application of the provisions of law.

Involuntary psychiatric hospitalisation in Italy raises some critical forensic issues. We analysed the sociodemographic, psychopathological, and behavioural characteristics of involuntarily hospitalised psychiatric patients, and the effectiveness of the juridical procedure of guarantee. Case files (n = 2796) related to involuntary psychiatric hospitalisation (IPH) at the Office of the Tutelary Judge of the Ordinary Court of Rome (Italy) between January 2013 and May 2016 were analysed. For each case file sociodemographic, clinical and procedural information were collected. The sample included 5

Prevalence of Asperger's syndrome in a secure hospital.

BACKGROUND: The hypothesis that Asperger's syndrome (AS) may go unrecognised in forensic populations was examined by ascertaining the prevalence in Broadmoor Special Hospital. METHOD: The entire male patient population was screened by examination of case notes. Identified cases were subject to the next stage of the study, which involved observation and interviewing of patients, and a semi-structured interview of key staff. RESULTS: A prevalence of 1.5% (0.6% to 3.3%, 95% CI) was found. The addition of equivocal cases increased the prevalence to 2.3%. CONCLUSION: The prevalence of AS in Broa

Compulsory admissions of emergency psychiatric inpatients in Turin: the role of diagnosis.

Many studies have found high levels of compulsory admission (CA) among non-affective psychoses. Aims of the present study were to investigate whether there was a mere association between diagnosis and CA in a cohort of 848 patients referring to a Psychiatric Emergency Service in a catchment area in Turin during a 2-year period, independent of socio-demographic features, psychiatric history, and clinical status. Diagnosis as a risk factor for CA was assessed constructing a logistic regression model, using the following steps: first, assessing the association between diagnoses and CA, without co

Multiple personality disorder in criminal law.

The authors review the recent literature on multiple personality disorder (MPD), the most severe and chronic of the dissociative disorders, in relation to court cases of competence to stand trial, the insanity defense, and research on malingerers feigning MPD. Issues relevant in the assessment of competency and insanity are described. Features characteristic of MPD, including amnesia and alterations in consciousness and personality, have varying degrees of influence over the criminal behavior of an individual with MPD. As in other psychiatric disorders, the influence of MPD on an individual's
