Previous published research suggests there are a diverse, yet relatively consistent, set of factors present in sudden, unexpected, and initially inexplicable deaths in police custody. This retrospective analysis examines police custodial deaths in Maryland, USA. This article is a rebuttal of the claim by Spiecker and Steutel that sex between people with mild and moderate "mental retardation" is morally permissable only with the substitutive consent of caregivers. After a review of historical, empirical and practical considerations, an ethical analysis is undertaken which concludes that Spiecker and Steutel's arguments are deeply flawed and their proposed policy morally objectionable.

A review of police records for the nine-year period from 1974 to 1982 identified 20 men who died following restraint by an upper-body control hold while in the custody of a large, urban police department. Using evidence from autopsy findings and police reports of events immediately preceding death, we concluded that control-hold use was associated with death in 19 of the 20 cases.
