Negligence and the communication of neonatal genetic information to parents.

It is inevitable that neonatal genetic information will be communicated to parents and a potential for psychiatric injury exists where the communication is negligent. An important question in this regard is whether a health-care provider may owe a duty of care to parents when communicating accurate genetic information, or whether the courts might treat it as merely the receipt of distressing news, which hitherto attracts no liability in English Tort Law. The important role of genetic counselling in this context will likely be determinative in deciding whether communicating accurate genetic inf

Bizarre allegation of negligence in fabricated pin migration--a case report.

Kirschner's wires (popularly known as 'K-wires' or 'pins') are used commonly in various orthopaedic surgical fixations. Around the shoulder joint such pins are used for fixation of acromioclavicular joint, sternoclavicular joint, proximal humerus and clavicle. In such fixations, spontaneous loosening and extraction of pins would not cause as much anxiety and worry to the surgeon as a pin which breaks and migrates within the body. Such alarm is not just due to the potential damage that the migrating pin can cause, but also due to fear of misinterpretation of the event in legal suits as negligen

Clinical impact of molecular genetic diagnosis, genetic counseling, and management of hereditary cancer. Part I: Studies of cancer in families.

Hereditary cancer represents approximately 5-10% of the total cancer burden and may account for 60,000 to 120,000 new cancer occurrences this year in the United States. New developments in molecular genetics and the cloning of cancer-prone genes have intensely fueled interest in dealing with hereditary forms of cancer. The authors provide an algorithm that depicts the process for the identification, study, and DNA-based genetic counseling of families being investigated under a research proposal at the Hereditary Cancer Institute of Creighton University School of Medicine. They have studied 56

Brachial plexus palsy: an old problem revisited again. II. Cases in point.

OBJECTIVES: In spite of mounting evidence to the contrary, plaintiffs' expert witnesses continue to maintain that brachial plexus impairment is almost always the result of excessive lateral traction on the head during the last phase of delivery. Case studies are presented to challenge this concept. STUDY DESIGN: Examples encountered in medicolegal consultations were analyzed with this purpose as our focus. RESULTS: Cases of brachial plexus impairment were encountered in which there was no evidence of shoulder dystocia or extreme lateral traction on the fetal head. In one in which shoulder dy

[Complications of synthetic hair implantation].

Five men (average age 35 years) suffering from the sequelae of hair implants were examined in the course of claims for legal compensation. Polyether amide hair fibres had been implanted, 1000 per patient and session. In all cases the improved implantation technique with a fine needle and subcutaneous knotting had been used in a total of three institutions. Three patients developed bacterial folliculitis after 4-8 weeks; in the other two patients this developed later, after 3-6 months. In two patients the possible triggering event was the wearing of a motorcycle helmet and a vacation in a tropi

Doctors with problems in an NHS workforce.

OBJECTIVES: To describe the incidence, nature, and implications of serious disciplinary problems among the medical staff of a large NHS hospital workforce. DESIGN: Descriptive study with analysis of case records. SETTING: Northern Health Region, an administrative area within the NHS covering a population of three million. SUBJECTS: Forty nine hospital doctors: 46 consultants and three associate specialists. MAIN OUTCOME MEASURES: The nature of the problems encountered within the doctors' practice, and the types of action taken by the employing authority. RESULTS: Over a five year period c

Anesthetic mishaps and the cost of monitoring: a proposed standard for monitoring equipment.

Review of insurance data indicates that approximately 1.5 claims are paid per 10,000 anesthetic procedures, a conservative estimate of the incidence of preventable serious injury associated with anesthesia. Insurance data permit estimation of the premium cost for the anesthesiologist and hospital, per operating room per year, of $69,429.00. We propose the use of an enhanced monitoring standard requiring a pulse oximeter, capnograph, spirometer, halometer, automatic sphygmomanometer, breathing circuit oxygen analyzer, stethoscope, electrocardiographic monitor, and temperature monitor. We sugges

[Postoperative iatrogenic lesions of the external branch of the accessory spinal nerve].

Iatrogenic lesions of the spinal nerve are rare and generally occur during cervicotomy for aetiological assessment of adenopathy. The spinal nerve is essentially damaged at two sites: the supraclavicular fossa (where the nerve is very superficial) and in the antero-lateral triangle of the neck (where the nerve approaches the sterno-cleido-mastoid muscle). The lesion of the spinal nerve essentially presents in the form of paralysis of the trapezius; which should be examined systematically postoperatively and at subsequent consultations, as the clinical signs may only develop after a certain lat

[Surgical complications in the area of the bile ducts from the forensic viewpoint].

In a period of 10 years there were 21 cases of iatrogenic lesions of the extrahepatic bile ducts following cholecystectomy (n = 19). In 2 cases of partial gastrectomy an expert's opinion was taken. 8 patients out of 21 came to death. The striking fact is that in 7 cases the removal of the gallbladder had been performed in retrograde direction.
