The medicolegal implications of this observation include the inappropriateness of malpractice claims in cases in which cancer could not reasonably be detected prospectively.

The weekend factor: the effect on healthcare quality. A medico-legal, retrospective study.

BACKGROUND: In the healthcare system, in the last 30 years, the prognostically negative value of the so-called Weekend Effect (WE) has been internationally recognized. The WE is regarded as the increased risk a patient might incur when hospitalized during non-working days, of enduring severe complications in comparison to the same hospitalization that occur on working days. The aim of this study was to retrospectively verify whether, once a mistake was made during weekends or on holidays, in comparison to a mistake occurred on workdays, it subsequently implied a higher risk of complications, d

Claims for compensation from women with cervical cancer in Norway-A retrospective, descriptive study of a 12-year period.

INTRODUCTION: In Norway, all patient-reported claims for compensation are evaluated by The Norwegian System of Patient Injury Compensation (NPE). The number of claims from women with cervical cancer is rising, and the approval rate is high. Our aim was to study claims for compensation from women with cervical cancer to identify the type of failures, when, during the time-course of treatment, the medical failures occurred, and the consequences of the failures. MATERIAL AND METHODS: A retrospective, descriptive study of claims for compensation to NPE from cervical cancer patients during a 12-ye

Medico-legal importance of necrotizing fasciitis.

Despite the rarity of necrotizing fasciitis (NF), it is a relatively common cause of death in many lawsuits. Families seek financial compensation or legal charges against those they believe to be involved in the death, usually physicians who did not identify the infection soon enough. This paper explores six cases in forensic pathology practice where NF posed a unique medico-legal dilemma.

Self-reported exposure to severe events on the labour ward among Swedish midwives and obstetricians: A cross-sectional retrospective study.

BACKGROUND: The process of delivery entails potentially traumatic events in which the mother or child becomes injured or dies. Midwives and obstetricians are sometimes responsible for these events and can be negatively affected by them as well as by the resulting investigation or complaints procedure (clinical negligence). OBJECTIVE: To assess the self-reported exposure rate of severe events among midwives and obstetricians on the delivery ward and the cumulative risk by professional years and subsequent investigations and complaints. DESIGN: Cross-sectional survey. PARTICIPANTS: Members of

[The macrosomic neonate: incidence, early morbidity and legal aspects. An analysis of the Hessia perinatal study].

In the past 13 years in Hessian Hospitals there is an 20% increase of newborn with a birthweight range between 4000-4499 g and a 17% increase of newborns weigh more than 4499 g. The incidence in the first weight group increases from 7.8% to 9.3% and in the second weight group from 1.3% to 1.53%. Since 1990 the decrease in the incidence of obstetrics traumas in single macrosomic newborns in vertex presentation will be missed, although there was an decrease from 1982 to 1990. There is a statistically significant higher incidence of injuries in the weight group above 4499 g than in the both weigh

Contact lens abrasions and the nonophthalmologist.

Corneal abrasions associated with contact lens wear are commonly evaluated and treated in acute care clinics and emergency departments by nonophthalmologists. The risk of progression to suppurative keratitis in this setting requires management distinct from that of other mechanical (eg, fingernail scratch) corneal abrasions. The antibiotic chosen should reflect the need for prophylaxis against Pseudomonas. Conditions favoring bacterial growth, specifically occlusive patching and/or use of steroid containing compounds, should be avoided, and 24-hour follow-up examination is recommended.

Antepartum testing for vasa previa: current standard of care.

Vasa previa is a rare accident in obstetrics with high fetal mortality. There are simple tests available to distinguish fetal from maternal blood. Recently it has been called into medicolegal question whether patients with third-trimester bleeding need to be tested for fetal bleeding. We surveyed 100 community hospitals and all the medical schools in the United States in an attempt to answer the question. It appears that the standard of care in the United States does not require such testing.

The ethical and legal framework for the decision not to resuscitate.

Practicing physicians are frequently faced with the question of whether or not to institute cardiopulmonary resuscitation in case of cardiac or respiratory arrest in a patient in hospital. Medical training has usually not included any systematic analysis of this issue from either an ethical or a legal standpoint. Many physicians may be unaware that ethical and legal principles, as well as professional guidelines, exist to guide such decision making. In practice, physicians make this decision without the benefit of training in ethical analysis. The problem is especially acute in teaching hospit

Medicolegal Implications of Nosocomial Infections: A Case Report of Aspergillus Contamination during Cardiac Surgery.

Nosocomial infections have become a major issue of public health and lead to an increasing number of suits for damages. We present a rare case of Aspergillus contamination during cardiac surgery, describe the medicolegal investigation, and present the new system for compensation of bodily injury after nosocomial infection in France, based on the law of March 4, 2002 on patient rights and quality in the health system. This case demonstrates the limits of compensation for nosocomial infections on the grounds of national solidarity. The expert report requested by the regional commission for conci
