Obstetric Anesthesia Liability Concerns.

Obstetric practice carries a high risk of medical liability and involves both obstetricians and anesthesiologists. Analysis of data from the Anesthesia Closed Claims Project database shows an increase in the proportion of anesthesia claims for maternal death and brain damage between the 1990s and 2000 and later, primarily due to hemorrhage. The proportion of claims for newborn brain damage remained unchanged while those for maternal nerve injury and minor injuries decreased. Use of massive transfusion protocols and clinical drills have been shown to improve outcomes from hemorrhage. Good commu

Negligence claims following non-union and malunion of long bone fractures: An analysis of 15 years of data.

INTRODUCTION: Non-unions and malunions are recognised to be complications of the treatment of long bone fractures. No previous work has looked at the implications of these complications from a medicolegal perspective. METHODS: A complete database of litigation claims in Trauma and Orthopaedic Surgery was obtained from the NHS Litigation Authority. Two separate modalities of the treatment of long bone fractures were examined i) non-union and ii) acquired deformity. The type of complaint, whether defended or not, and costs were analysed. RESULTS: There were claims of which 97 related to non-un

[Death on the operating table and death in the early post-operative period : recommendations of forensic pathologists].

Death during an operation represents a severe event for physicians and family of the deceased. A further difficulty arises when certifying the cause and manner of death because medical staff are often afraid that they will incriminate themselves when declaring an unnatural death or an unclear manner of death but are also afraid to issue a false statement by declaring a natural death. In such cases of mors in tabula it is recommended to declare an unclear manner of death because this leads to police investigations and in the majority of the cases to exoneration of the medical staff.

Reporting a fatality during tumescent liposuction.

Deaths of patients during elective surgery have drawn attention to the danger of anesthesia. Tumescent local anesthesia is subcutaneous infiltration of large volumes of dilute lidocaine with epinephrine to produce vasoconstriction while delivering anesthesia over large areas without lidocaine toxicity. This report documents the case of a 38-year-old woman who attended an outpatient clinic to undergo liposuction of the abdomen and bilateral hips and thighs. According to one witness, around 30 min after anesthesia administration, the victim suffered an episode of tonic-clonic convulsion. When th

Nerve injury associated with anesthesia: a closed claims analysis.

BACKGROUND: Nerve injury associated with anesthesia is a significant source of morbidity for patients and liability for anesthesiologists. To identify recurrent and emerging patterns of injury we analyzed the current American Society of Anesthesiologists (ASA) Closed Claims Project Database and performed an in-depth analysis of claims for nerve injury that were entered into the database since the authors' initial report of the subject. METHODS: The ASA Closed Claims Database is a standardized collection of case summaries derived from the closed claims files of professional liability insurance

Five liability claims involving the cornea and how they could have been prevented.

Five recent professional liability claims involving the cornea are reviewed, arising from five unusual conditions: fungal infection following corneal abrasion with a tree branch; herpes simplex-induced neurotrophic keratitis resulting from contact lens wear; corneal necrotization caused by lime particulate matter splashed into the eye; siderosis-related retinal detachment secondary to a penetrating iron foreign body; and fluctuating acuity, halos, and flare resulting from radial keratotomy. Emphasis is on how these claims might have been avoided.

[Forensic aspects of bladder and ureteral injuries in standard gynecologic operations].

Damage to the efferent urinary passages during abdominal or vaginal hysterectomy cannot always be prevented no matter how carefully one may proceed preoperatively and intraoperatively. However, all possibilities of avoiding complications or at least of recognising and eliminating them before surgery, must be explored. Nevertheless, formation of vesicovaginal or ureterovaginal fistulas or of a congested ureter will be rare. In such cases, one cannot jump to the conclusion of mismanagement or a therapeutic error from the mere occurrence of damage. In each individual case, there must be an expert

Legal aspects of the management of chronic pain.

OBJECTIVE: To review the legal provisions which control the prescription of opioid analgesics in Australia, and to summarise the areas in which practitioners who treat patients with chronic pain may expect to become involved with the legal system. DATA SOURCES: The relevant legislation was reviewed, and a selective review was undertaken of literature dealing with the legal aspects of pain and suffering which may form a basis for personal injury claims. Case law which deals with issues of consent to treatment was also examined. DATA SYNTHESIS: Statutory requirements which control the prescrip

[Postoperatively developing serratus paresis as a legal problem].

It is demonstrated in five exemplary cases that a neuralgic amyotrophy with particular involvement of the long thoracic nerve was the cause of a postoperative serratus paresis. In any case liability claims, it is essential for an expert's opinion on postoperative serratus paresis to differentiate this pathology from intraoperative injuries caused by pressure. Above all the interval between operation and the first manifestation of symptoms, as well as the development of distinct pain count against an intraoperative plexus lesion.

Malignant hyperthermia.

Malignant hyperthermia is a potentially fatal complication of general anesthesia that may occur with greater frequency in some patients with ptosis or strabismus. The history of our knowledge of this recently described condition is outlined. The clinical features, pathophysiology, and differential diagnosis are reviewed in detail. A protocol for the treatment of the acute malignant hyperthermia crisis and guidelines for the management of susceptible patients are suggested. The medicolegal implications of the occurrence of such a crisis are discussed.

Medical and legal implications of side effects from neuroleptic drugs. A round-table discussion.

The side effects that may occur during treatment of schizophrenia with neuroleptic drugs are fully examined. Included are autonomic, extrapyramidal, other CNS, endocrine and metabolic, allergic, and skin and eye side effects. The differences between the side effect profiles of various antipsychotic drugs are noted. The restrictions imposed by laws designed to protect the patients's rights are evaluated with regard to the side effects of neuroleptic drugs. The meaning of informed consent is delineated.

Caesarean section: a 15-year review of changing incidence, indications, and risks.

During 15 years (1965 through 1979), 9,718 cesarean sections were performed at Hutzel Hospital. This report concerns the indications, incidence, morbidity, and mortality. Dystocia, fetal distress, and breech presentations were the most common indications for primary cesarean section. The incidence rose from 9.8% to 16.8% during this study. Forceps deliveries dropped from 47.5% to 12.0% and vaginal breech deliveries decreased from 86% to 35%. Spinal anesthesia was used in 90%. Caesarean section hysterectomies were performed in 128. The most common indications were carcinoma in situ of the cervi

Emergency radiology without the radiologist: the forensic perspective.

PURPOSE: The aim of this paper is to describe two cases from the authors' forensic archive database in which teleradiology was related to unfavourable outcomes. MATERIAL AND METHODS: Two patients underwent autopsy after unexpected death following road accidents. In one case, death was caused by multiple cervical fractures following minor neck injury in the presence of diffuse idiopathic skeletal hyperostosis. In the other case, death was due to delayed isthmic aortic rupture occurring after thoracic blunt trauma in a young adult. Both conditions were diagnosed at autopsy only. RESULTS: In bo
