Researchers have identified at least twenty-five pathogens that can be transmitted through blood transfusions. Four percent of patients who receive the average amount of blood during a transfusion are at risk of being infected with a contaminated unit, and exposed to the danger of serious adverse reactions, including future debilitating conditions. Victims of transfusion-related diseases, however, generally have been unsuccessful when making claims against the purveyors of blood products because of blood shield statutes that were initially enacted in response to unknown pathogens that made the

The occurrence of mechanical nerve injury in connection with anaesthesia and surgery is probably more common than generally believed, and by no means all cases are reported to the patient injury claims department. Both incorrect positioning of the patient on the operating table and pressure from retractors and other instruments can contribute to the occurrence of such injuries. Both neurological and neurophysiological procedures should be used to localise the injury, particularly for the purpose of insurance assessment. Most important of all, however, is prevention of injury. Risk minimisation

One hundred and sixty seven (82%) of the 204 practising South Australian rural GP obstetricians responded to a questionnaire on training, skills and approach to high-risk obstetrics. The mean length of training was 8.5 months; 78% of GP obstetricians held a diploma. There was a mean of 13 years experience and 22 deliveries per year. However, 26.3% of practitioners had stopped obstetrics in the previous 12 months and cited indemnity insurance and lifestyle factors as the main reason for stopping. The GPs practised a wide range of skills; forceps (96%), Caesarean section (42%) and had good acces

A 19 year old male was admitted to a tertiary care centre in Sri Lanka, with a history of snake bite while sleeping at night. A killed specimen of a snake was brought with the patient. It had been identified as a non-venomous snake by the doctor and handed over to relatives, with a comment to that effect. Patient had no clinical or laboratory evidence of envenoming on admission. Patient developed bilateral ptosis six hours after alleged snake bite, soon followed by respiratory paralysis and was treated with Indian polyvalent anti-venom serum. After 12 h of the bite, patient had developed hypot

This paper explores the legal position of the off-label prescription of antipsychotic medications to people with dementia who experience behavioural and psychological symptoms of dementia (BPSD). Dementia is a challenging illness, and BPSD can be very difficult for carers to manage, with evidence that this contributes to carer strain and can result in the early institutionalisation of people with dementia. As a result, the prescription of antipsychotic and other neuroleptic medications to treat BPSD has become commonplace, in spite of these drugs being untested and unlicensed for use to treat

Intraoperative neuromonitoring (IONM) was introduced into thyroid surgery approximately 10 years ago for better identification of recurrent laryngeal nerve palsy. Since then several studies have been performed for evaluation of this new technology. IONM is superior to visual nerve identification alone for prediction of postoperative local cord function. Therefore, in bilateral procedures IONM enables intraoperative decision-making concerning resection of the second side. To avoid misinterpretation of the results of IONM a standardized approach including preoperative and postoperative laryngosc

A "wrongful life" suit is based on the purported tortious liability of a genetic counsellor towards an infant with hereditary defects, with the latter asserting that he or she would not have been born at all if not for the counsellor's negligence. This negligence allegedly lies in the failure on the part of the defendant adequately to advice the parents or to conduct properly the relevant testing and thereby prevent the child's conception or birth (where unimpaired life was not possible). This paper will offer support for the thesis that it would be both feasible and desirable to endorse "wron

Basing considerations on an extremely carefully examined case of toxic shock syndrome (TSS), an analysis of this phenomenon is presented from the clinical and forensic points of view. TSS is often associated with the term "tampon disease" but in the meantime it has turned out that it may also arise as a non-menstrual disorder, caused by local infections, for example after surgical interventions. The inevitable symptoms include: fever, exanthema, desquamation on the palms of the hands and soles of the feet as well as hypotension. The clinical symptoms would initially suggest a septic process, h

This review considers all possible modes of esophageal injury, based on a schema originally published in 1954 and more recently modified in 1970. For each category of injury there are detailed discussions of diagnosis and treatment. The best available knowledge of present-day modalities has been based on a survey of the literature for the past decade. When diverse methods of treatment were encountered, we have made comments consistent with our personal experience, when appropriate. The medicolegal literature contains a number of references to esophaegeal injury. Certain excerpts dealing with s

BACKGROUND: Obstructive sleep apnea (OSA) is common in patients undergoing surgery. OSA, known or suspected, has been associated with signif … operative complications related to OSA are increasingly being reported as the central contention of malpractice suits. These cases can be associated with severe financial penalties. These data likely underestimate the actual medicolegal burden, given that most such cases are settled out of court and are not accounted for in the legal literature.
