A New Commitment Pathway for Offenders With Serious Mental Illness: Expedited Diversion to Court-Ordered Treatment.

The authors propose a new form of civil commitment that would benefit individuals with serious mental illness involved with the criminal justice system. This population has complex needs rooted in comorbid conditions, alienation from treatment and support systems, and poor access to care. Although many dollars are spent on costly assessments and hospitalization of jail detainees with serious mental illness to ensure that they are competent to stand trial, these detainees typically do not receive adequate services during incarceration or after release and recidivate at high rates. The proposed

Involuntary psychiatric holds - the structure of admissions on the example of Institute of Psychiatry and Neurology in Warsaw.

OBJECTIVES: The aim of the study was to analyse the structure of involuntary psychiatric holds in Institute of Psychiatry and Neurology in Warsaw, throughout the year. Our research interests included socio-demographic profiles of the patients, time of admissions (time of a day/night/ season), type of diagnoses at admission and suicide attempts preceding the admission. Grave Disability, Basic Needs, and Welfare and Protection: Statutory Definitions for Involuntary Commitment Across States.

OBJECTIVE: The authors aimed to identify and describe standards, across U.S. states and the District of Columbia (DC), for involuntary commitment of people experiencing a psychiatric disability that impairs their ability to live independently. METHODS: Statutes pertaining to involuntary commitment were compiled for all 50 states and DC. The authors focused on commitment criteria other than those regarding a person's danger to themselves or others and identified types and components of these standards, allowable evidence for meeting commitment standards, and other requirements and exclusions.

The Competency Paradox in Somatic Disease.

Westmoreland et al. have reviewed factors associated with provider reluctance to initiate and judicial reluctance to authorize civil commitment and involuntary treatment for persons with severe anorexia nervosa. Their analysis of the legal, medical, and psychiatric elements that affect treatment outcomes contributes to professional understanding of a complex topic. Although their proposal to create guidelines for involuntary treatment for persons with eating disorders may be of clinical utility, guidelines should not be promulgated for the purposes of reaching judicial findings of law.

[Qualitative survey of the law of 5 July 2011 in the field of psychiatry].

The law of 5 July 2011 concerning the rights and protection of subjects in psychiatric care and the modalities of their management has been severely criticized and often rejected, both before and following its application in August 2011. This study was designed to describe and compare perceptions of this law by actors in the field, six months after application of the law. This qualitative study based on twenty-four interviewees from Isère and Savoie - including psychiatrists, judges, patients and families - shows that this law is not completely rejected in practice and that it provides a numbe

'Old' and 'new' institutions for persons with mental illness: treatment, punishment or preventive confinement?

Despite countless promises for a better life by national commissions, governments and the international community, there has evolved a vicious cycle of neglect, abandonment, indignity, cruel and inhuman treatment, and punishment of persons with mental illness. This shameful history of benign, and sometimes malignant, neglect of persons with mental illness is well understood, with the deep stigma and unredressed discrimination, the deplorable living conditions, and the physical and social barriers preventing their integration and full participation in society. The maltreatment of this vulnerabl

Involuntary detention and treatment of the mentally ill: China's 2012 Mental Health Law.

The long-awaited Mental Health Law of China was passed on 26 October 2012 and took effect on 1 May 2013. Being the first national legislation on mental health, it establishes a basic legal framework to regulate mental health practice and recognizes the fundamental rights of persons with mental disorders. This article focuses on the system of involuntary detention and treatment of the mentally ill under the new law, which is expected to prevent the so-called "Being misidentified as mentally disordered" cases in China. A systematic examination of the new system demonstrates that the Mental Healt

The Pendulum Swings from Deinstitutionalization to Expanded Civil Commitment.

Over time, U.S. civil commitment laws have evolved from broad, paternalistic statutes to more narrowly defined legal standards that emphasize individual liberty, least-restrictive treatment, and due process. This shift contributed to deinstitutionalization as state hospital beds decreased and the number of those meeting the new involuntary commitment standards diminished. Subsequent analyses found that, as states narrowed their criteria for involuntary commitment and as community mental health systems strained to absorb the gap, homelessness and criminal justice involvement among people with m

European Psychiatric Association (EPA) guidance on forensic psychiatry: Evidence based assessment and treatment of mentally disordered offenders.

Forensic psychiatry in Europe is a specialty primarily concerned with individuals who have either offended or present a risk of doing so, and who also suffer from a psychiatric condition. These mentally disordered offenders (MDOs) are often cared for in secure psychiatric environments or prisons. In this guidance paper we first present an overview of the field of forensic psychiatry from a European perspective. We then present a review of the literature summarising the evidence on the assessment and treatment of MDOs under the following headings: The forensic psychiatrist as expert witness, ri

Exploring psychosocial interventions for adults involuntarily admitted to psychiatric inpatient settings: a scoping review.

BACKGROUND: Involuntary psychiatric admission is associated with substantial distress, loss of autonomy, and strained therapeutic relationships for those admitted involuntarily and the healthcare professionals involved in their care. Psychosocial interventions may help mitigate these harms and support recovery, however, the literature in psychiatric inpatient settings has not been comprehensively mapped in relation to intervention characteristics, implementation, and context. AIMS: To map the published literature on psychosocial interventions for adults admitted involuntarily to psychiatric i

Police Involvement in Involuntary Psychiatry Admission: A Report From the Dublin Involuntary Admission Study.

OBJECTIVE: The authors sought to compare diagnostic and demographic factors among patients who were involuntarily admitted to psychiatry care with or without police involvement. METHODS: All admissions to psychiatry units in two university hospitals in Ireland were studied over a 3.5-year period. RESULTS: Of 2,715 admissions, 443 (16%) were involuntary; complete data were available for 390 of these involuntary admissions, of which 78 (20%) involved police. Patients with police involvement did not differ significantly from those without police involvement in gender, marital and employment sta

Compulsory admission of the mentally ill: adequacy of documentation.

The issues that are involved in the compulsory detention and treatment of persons with mental illness are complex. There has been an improvement in the adequacy of documentation of such persons in the first five years of operation of the new South Australian Mental Health Act, 1976-1977. However, an appreciable proportion of documents still do not appear to comply adequately with the statutory requirements. This may be related not only to shortcomings in the medical documentation, but also to ambiguities and possible overlapping in the criteria for compulsory detention and treatment.

Britain's Siberia: Mary Coutts's account of the asylum system.

This paper examines a pamphlet entitled Britain's Siberia. The High Statistics of Insanity Explained by a Certified Lunatic. Research has revealed that the writer was Mary Coutts and that she had been a detained patient in the Aberdeen Royal Asylum. The paper analyses what Coutts had to say about her experiences and compares this to the official asylum records and what they reveal about her inmate stay. The paper also relates Coutts' account to that of other patients who have written about their experiences. As one of the few women to have left a record of life in the asylum, Coutts' story is

Treatment Satisfaction in a Civil Commitment Facility for Sexually Violent Persons.

Evaluating patient satisfaction in therapeutic settings is consistent with a Risk-Needs-Responsivity (RNR) model. This study provides results from a program improvement initiative in a sexually violent person (SVP) civil commitment facility that queried patients and treatment providers about their satisfaction with therapeutic processes and assessment methods. Overall, patients reported high levels of satisfaction with treatment at the facility, with the highest levels of satisfaction on items about being treated with kindness and respect and staff acting professionally. Providers rated curren

APA's model law: a commitment code by and for psychiatrists.

The author argues that the APA model law is seriously flawed because it lacks sufficient mechanisms for questioning the judgment of psychiatrists throughout the commitment process and for ensuring the best disposition of patients. By failing to provide for independent screening of commitment petitions, to mandate multiple psychiatric evaluations of respondents, to provide indigent respondents a free psychiatric examination to help them prepare for the commitment hearing, and to address the shortcomings of legal advocacy, the model law sets the stage for improper or unwarranted commitments.
