The authors have searched through French and western jurisprudence about transsexualism. Thanks to their experience of how judges and magistrates have reacted they have been able to analyse the evolution of attitudes and the present-day attitudes to the subject and how the condition should be treated and viewed by the law. There are only a relatively few numbers who wish to change sex but these are estimated at 1 in 50,000 to 1 in 100,000 according to different statistics. The proportion of males who want to change is 3 times greater than of females. The fact that transsexualism is a phenomeno

In Islamic jurisprudence, intersex people are known as khuntha-those who have both male and female multiplicative organs. Taking into account the fragmented evidence on the role of science in the treatment of the khuntha, the socioethical demands, and expectations of people depending on their gender, this study aims to better understand the existing literature on the khuntha people in the Middle East and North Africa region (MENA)-the perception, acceptance, and treatment from families, communities, and health care providers. This study used a scoping review framework and was guided by the Pre

The authors review the classification of transsexualism and gender dysphoria with respect to a series of 148 patients followed up for 10 years by a multidisciplinary group of endocrinologists, surgeons and psychiatrists; transsexualism is a major problem of self-identity and not a sexual derivation. The principal features of the study population are presented with details of methodology, criteria for selection for sex change treatment, and results obtained. The two main medicolegal problems (changing civil identity and penal medical responsibility) posed by medico-surgical treatment in France

BACKGROUND: The Bachelor of Ayurvedic Medicine and Surgery (BAMS) curriculum was revised by the National Commission for Indian System of Medicine in 2021-22. The updated syllabus now provides for extensive theoretical knowledge and skill development in forensic medicine (Agada Tantra evam Vidhi Vaidyaka), comparable with the MBBS (Bachelor of Medicine, Bachelor of Surgery) programme. This paper critically analyses these rigorous curricular reforms and argues that further steps are needed to provide practical training opportunities to Ayurveda students in line with those available to their MBBS

Precision medicine is transforming drug response from a population level assumption into an individualised biochemical event. Pharmacometabolomics, which profiles metabolic signatures associated with drug exposure and response, offers a mechanistic basis for explaining interindividual variability in therapeutic efficacy, adverse drug reactions, neurocognitive impairment and toxicological ambiguity. Legal systems, however, continue to evaluate drug related conduct largely through conventional toxicology, generalised impairment thresholds and binary assumptions about intent, voluntariness and ne

Of the various rules establishing a mental health clinician's legal duty to take precautions to protect their patient from harming others, the most common is the specificity rule that limits the protective duty to warn reasonably identifiable victims. The specificity rule is important wherein the main or only specified protective measure is warning the victim. In the last quarter century, Pennsylvania adopted the specificity rule from its Supreme Court Emerich decision. In its recent Maas decision, the Pennsylvania Supreme Court expanded the duty to apply to potential victims who are unnamed a

The removal of lower wisdom teeth is one of the most frequent operations in oral surgery. Iatrogenic lesions of the lingual and inferior alveolar nerve and fractures of the lower jaw are rare, but can lead to actions for damage and compensation for personal suffering. The aim of our investigation was to elaborate recommendations for the oral surgeon from the legal point of view. Therefore we investigated in two data banks all court decisions concerning wisdom teeth and analysed them in regard to the obligation to provide information, documentation and the minimum requirements of the surgical t

Adopting Therapeutic Jurisprudence (TJ) as its theoretical framework and employing the methods of literature analysis and normative analysis, this paper conceptualizes the rules of recommendation algorithms, quantitative feedback, open social connectivity, and automated review procedures as structural arrangements that shape the psychological experiences of minors, and examines their potential mental health implications. The analysis suggests that these rules may affect the mental health of minors along four dimensions-autonomous will, self-perception, relational trust, and procedural trust-an

Understanding how and why someone dies unexpectedly is key to bereaved family members. The coronial process in England investigates instances where the cause of death is unknown, violent or unnatural and/or occurred in state detention. Families are held to be at the centre of this process and the coroner's role has extended to concern about therapeutic jurisprudence, that is, how legal processes can minimise negative consequences for participants without jeopardising due process. Therapeutic jurisprudence involves unresolved tensions, however, and an epistemic power imbalance. Within the inque

This article outlines the Australian legal position relevant to minors and the commencement of hormone treatment for Gender Dysphoria (GD). It traces the significant Australian legal developments in this field and compares the Australian jurisprudence with recent English caselaw. In Quincy Bell and Mrs A v The Tavistock and Portman NHS Foundation Trust and Ors, the English High Court held that minors below 16 years are not likely to have the requisite competency to lawfully consent to the commencement of puberty suppressing drugs. The Court of Appeal subsequently overturned this decision, but

The availability of the defence of necessity in cases of homicide is a complex issue in both Canadian and British jurisprudence. This article examines the divergent judicial and academic views and argues that, while necessity may be available for certain kinds of homicide, it should be rejected as a legitimate defence to intentional killings. The author looks closely at two recent cases in which the question arose as to whether or not killing a human being is ever justifiable or excusable on the basis of necessity: the Canadian case of R. v. Latimer and the British case of Re A (Children). The

Bryan and Emery introduced a new concept in legal jurisprudence through which a critical examination of how the law deals with deaf people can be undertaken: deaf legal theory (DLT). They define it as "how the law seeks to frame Deaf people" and argue that legal systems should be reoriented to recognise and accommodate the unique perspectives and experiences of deaf people. Current legal systems are biased in favour of hearing people and these bias disadvantage deaf people in a variety of ways, including in their access to justice, employment, and education. The aim of this article is to advan

Informed consent is presented as a fundamental right and principle in modern medical practice. It involves obtaining permission from a patient before any medical procedure, treatment, or research protocol. Although not explicitly recognized as a standalone right in international human rights instruments, informed consent in healthcare is considered a right derived from other rights, such as the rights to health and freedom. The jurisprudence of international human rights courts has permitted the reinterpretation of informed consent beyond just a bioethical principle. This article argues for th

The HIV and AIDS Act was enacted in India in 2017 to protect the right to privacy, bodily autonomy, and non-discrimination of Persons Living with HIV (PLHIV). Prior to the Act, HIV/AIDS-related jurisprudence in India developed largely through judicial decisions on privacy, health care, queer rights, and marriage. This jurisprudence stigmatised PLHIV and constructed them as threats to society. The Act sought to respond to such characterisations and affirmed several rights of PLHIV that were previously denied. This article uses the reproductive justice framework to analyse the scope and potentia

INTRODUCTION: Since the advent of evidence-based medicine, the decision-making process in disease diagnosis and treatment has exhibited fundamental principles that align closely with the core tenets of evidence chain theory in the legal field. Based on this, this paper aims to explore the underlying logic and practical value of transferring evidence chain theory from law to medicine, focusing on its significance in enhancing the scientific rigor and standardization of clinical decision-making.
METHODS: Through systematic retrieval of existing literature in the fields of jurisprudence and medi

INTRODUCTION: The right to sexual and reproductive health (SRH) is an essential part of the right to health and is dependent upon substantive equality, including freedom from multiple and intersecting forms of discrimination that result in exclusion in both law and practice. Nonetheless, general and specific SRH needs of women living with HIV are often not adequately addressed. For example, services that women living with HIV need may not be available or may have multiple barriers, in particular stigma and discrimination. This study was conducted to review United Nations Human Rights Council,
