CONCLUSIONS AND RELEVANCE: These findings suggest that outcomes from 3 Supreme Court decisions in 2022 could lead to substantial harms to public health, including nearly 3000 excess deaths (and possibly many more) over a decade.

OBJECTIVE: To determine the consequences of the Gobeille v. Liberty Mutual Supreme Court decision on the representativeness of the Massachusetts all-payer claims database (APCD). The loss of individuals captured in the APCD may vary demographically, geographically, and in the capture of fatal opioid-related overdose (OOD).
DATA SOURCES AND STUDY SETTING: We used 2013-2021 data from the Massachusetts Public Health Data Warehouse (PHD), which links person-level APCD records to other datasets. The APCD includes commercially-insured health claims mandatorily reported pre-Gobeille. Post-Gobeille,

Despite acknowledging the risks of the COVID-19 pandemic for the prison population, Brazil's Supreme Court declined to issue structural injunctions during the health crisis ordering lower courts to consider these risks when making incarceration-related decisions. These injunctions could have been crucial to mitigate mass incarceration and protect the prison population during the pandemic. Through an examination of the Supreme Court's rulings in structural cases and in a sample of over 4,000 habeas corpus decisions, this paper argues that granting these injunctions would have overwhelmed the co

At the core of the common law, rooted in fairness, is the principle that an accused must be "fit" or "competent" to answer charges pursued by the state. Fitness rules vary considerably across jurisdictions but generally share the requirement that the accused be able to actively participate in the conduct of their defense. In the Canadian tradition, the common law on fitness is codified in Section 2 of the Criminal Code. For over 30 years, statutory interpretation of the law has been limited to provincial courts of appeal in Canada. Now, for the first time, the Supreme Court of Canada has rende

The Americans With Disabilities Act (ADA) was created to prohibit discrimination based on disability. Although many individuals filed claims alleging discrimination in the workplace based on disability, the federal courts, led by the U.S. Supreme Court, adopted an increasingly constricted interpretation of key provisions of the ADA. As a result, many individuals with serious impairments were found by the courts to not be disabled. In 2008 Congress overturned these court decisions by enacting the ADA Amendments Act. These amendments overrule several decisions by the United States Supreme Court

This lecture deals with the difficult problem of so called "wrongful life". Two Court decisions have been issued recently in France and lead to a very ambiguous situation since they differ dramatically. In the "Perruche affair" where a diagnosis of rubella was not done, the parents prevented to get an interruption of pregnancy, and the child severely affected, the Court (Cour de Cassation, i.e. Supreme Court in charge of civil affairs) decided to compensate the child for "not having be aborted". In the "Quarez affair" where a diagnosis of Down syndrome was not done, the parents prevented to ge

This article discusses the 1975 Supreme Court opinion O'Connor v. Donaldson. The article first examines the due process clause of the Fourteenth Amendment, the basis for the O'Connor ruling. It then looks carefully at the Court's conclusions, with particular attention to the Court's reasoning and analysis. The article goes on to look at how the Supreme Court has interpreted O'Connor on subsequent occasions and suggests that the Court has often misconstrued its own decision. The article concludes by offering thoughts and commentary on the O'Connor opinion and its progeny.

To update her article in the June 1999 issue of Academic Medicine, the author addresses the impact of the U.S. Supreme Court's decision in the 2001 Bartlett case on medical students with learning differences. In Bartlett v. the New York State Board of Bar Examiners, the Court ruled that Bartlett was substantially limited in the major life activity of working because of the board's failure to accommodate her reading impairment. The author postulates that the Supreme Court decision in the Bartlett case offers hope to medical students applying for accommodation on medical licensing examinations.

Child sexual abuse is the most challenging type of abuse to detect. Moreover, there are difficulties in gathering evidence, apprehending, and prosecuting the perpetrator. The trial is often based on the contradiction of the suspect's and the child's statements. The aim of this study is to identify the difficulties encountered during the entire trial in cases of sexual assault against the child in Turkey starting from the investigation phase, to determine the auditability of taking a child's statement, which is the basis of the judicial decision, and to evaluate the effectiveness of the princip

In a "mixed bag" 2023-2024 session, the U.S. Supreme Court issued a series of decisions both favorable and antithetical to public health and safety. Taking on tough constitutional issues implicating gun control, misinformation, and homelessness, the Court also avoided substantive reviews in favor of procedural dismissals in key cases involving reproductive rights and government censorship.

The Alabama Supreme Court recently held, in LePage v. Center for Reproductive Medicine, that the parents of human embryos that were negligently destroyed at a fertility clinic could bring an action for damages under the State's wrongful death statute. Although the Alabama legislature promptly enacted a law essentially overturning the state supreme court's decision, concerns have been raised that the court's decision might influence courts in other States to interpret their wrongful death statutes, or possibly even their fetal homicide statutes, to apply in similar circumstances, thereby threat

Abortion has been a hotly contested political issue since the mid 1960s, when states began liberalizing their abortion laws. Recent Supreme Court rulings, such as Rust vs. Sullivan, the retirement of two liberal Supreme Court justices and the battle over Louisiana's abortion legislation have created new fervor on both fronts of the battle. All health care providers who care for women need to be cognizant of the current abortion laws and the factors that influence the abortion decision. These factors include the different levels of health risk and financial implications posed by continued pregn

Last month, Dr. Decker analyzed recent court decisions that maintain the standard that providing blood and human tissue is a service, not a sale of goods. Under most conditions, he concluded, hospitals can't be held liable for damages to a patient who acquires an infectious virus from blood transfusions or tissue transplants. This month, Dr. Decker considers the effect of AIDS on rulings dealing with the disclosure of a blood donor's identity. In 1988, the Supreme Court of the United States twice declined to review lower court decisions dealing with the disclosure of the names of blood donors

In sum, it is the decision of this Court that the hospital not deescalate Jane Doe's treatment or enforce any DNR order unless both parents agree to this final course of treatment. Scottish Rite, its physicians, staff, agents, and employees are enjoined from taking any action inconsistent with this order. This Court hopes that the ordeal suffered by all concerned in having to resort to the courts for direction will soon be alleviated by judicial precedent or legislative enactment establishing proper rules and procedures for all involved in a future dilemma such as this one. BACKGROUND: The U.S. Supreme Court ruled in 2003 in the Gratz et al. v. Bollinger et al. and the Grutter v. Bollinger et al. cases that affirmative action selection policies aimed at student diversity in higher and professional education are acceptable on constitutional grounds. The court also ruled that "holistic," "individualized" selection procedures, not "mechanical" methods, must be used to achieve student diversity goals.
SUMMARY: This brief essay reviews and critiques professional and academic literature that addresses the two court cases and their likely sequelae. The weight of scient

In Chappel v Hart, the High Court upheld the decision of the Supreme Court of New South Wales that a surgeon was liable for failing to warn a patient of a previously unreported complication of a procedure. The patient, if properly warned, would have had the operation at another time, probably with a more experienced surgeon. The decision has important implications for doctors when advising patients of the risks of surgery.
