Medico-legal considerations in the context of neonatal encephalopathy and therapeutic hypothermia.

Neonatal encephalopathy (NE) is a significant complication of the peripartum period. It can lead to lifelong neurologic disabilities, including cerebral palsy, cognitive impairments, developmental delays, and epilepsy. Induced hypothermia is the first therapy, which has shown promise in improving the outcomes for neonates with moderate to severe NE following a presumed intrapartum insult. NE is also a frequent source of medical malpractice litigation. In this paper, we will review salient features of the American Tort System as it pertains to medical malpractice. We will discuss the obstetric

Cardiovascular Outcomes in Advanced Maternal Age Delivering Women. Clinical Review and Medico-Legal Issues.

Background and objecives: Adverse cardiovascular outcomes during pregnancy have increased over the past few decades, with increased numbers of women delivering later in their reproductive life. Other factors include higher rates of female obesity, diabetes, hypertension, cardiovascular diseases and assisted reproductive technology, which has extended fertility. Those at risk require extensive prenatal maternal screening, constant pregnancy supervising, monitoring during labor, delivery and puerperium and careful anesthetic evaluation during delivery. Materials and Methods: The present review r

Psychiatric Injury Claims and Pregnancy: Re (a Minor) and Others v Calderdale & Huddersfield NHS Foundation Trust [2017] EWHC 824.

RE and others concerned a clinical negligence claim against the Defendant NHS Trust by a baby injured during childbirth, as well by her mother and grandmother for psychiatric injury found to have been caused by those events. This commentary focuses on the claim for psychiatric injury by the mother and grandmother, both of which succeeded on the basis that the childbirth was a sufficiently shocking and horrifying event. This commentary urges caution about this development based on how it represents law's view of childbirth and the growth of claims that might result from any expansion of liabili

Recurrent laryngeal nerve monitoring: state of the art, ethical and legal issues.

Despite many advances in surgical techniques during the last several decades, the risk for recurrent laryngeal nerve (RLN) injury during thyroid and parathyroid surgery has only declined, not disappeared. RLN monitoring is an attempt to reduce the risk of nerve injury during thyroid and parathyroid surgery. In this article, the author discusses how to use RLN monitoring, its effectiveness, and the options available. He also highlights potential legal and ethical issues that surround the use of this method.

Analysis of NHSLA claims in hand and wrist surgery.

Claims for negligence are increasing in medical practice. We analysed data provided by the UK NHS Litigation Authority (NHSLA) on all hand and wrist surgery from 1995-2001. The numbers of claims increased from 13 to 40, but the number being successfully defended also increased from 2 to 13 during this period. Claims were most commonly attributed to errors at surgery (56%) or in outpatient clinics (24%). Strikingly the claims are clustered to a few common conditions, particularly the treatment of carpal tunnel syndrome (22%) and wrist fractures (48%). There were no claims related to complex han

[Sensory injury to the lingual nerve after nerve block at the lingula mandibulae].

Prolonged and possibly permanent change in sensation due to lingual nerve damage can occur after mandibular block anesthesia. The condition is rare and little can be done to prevent its occurrence. A case report is presented and functional as well as legal implications are discussed. Also practical recommendations are given to help the dentist when faced with the situation.

Neonatal hypoglycaemia: clinical and legal aspects.

Transiently low blood glucose levels are common in the neonatal period and may be considered a normal feature of adaptation to extrauterine life. There is no evidence that this causes brain injury in the absence of concurrent clinical manifestations. Conversely, persistent and severe hypoglycaemia may be associated with other underlying pathologies which themselves predispose to brain injury. Attribution of brain injury therefore requires demonstration of both 'significant' hypoglycaemia and a characteristic resulting pattern of brain injury. The prevention of hypoglycaemic brain injury requir

Pioneers of the intrauterine device.

The history of the intrauterine device is remarkably short and its survival has been jeopardized several times from the beginning when Gräfenberg introduced the intrauterine ring in 1928, and later when product liability claims in the USA forced companies to withdraw the IUD from the market. However, a revival is happening, and one of the withdrawn copper IUDs has been re-introduced in the USA. In the 1980s, pessimism about the future of the IUD was based on the fact that there are still two major imperfections inherent in intrauterine contraception: its lack of protection against both 'gyne'

Will breed-specific legislation reduce dog bites?

So how do we deal with biting dogs? To start with, we must remind ourselves that biting is a natural activity of all dogs, and that there is potential for injury. All dog owners must understand this and must be made aware that they are fully responsible for the actions of their dogs. I am not convinced that this is universally understood by dog owners, nor am I satisfied that every dog owner takes the necessary steps to train and socialize their dog. Owners need to be encouraged to actively work at inhibiting biting behaviour when dogs are young. As well, all dogs should be socialized to accep

Ethical and legal issues in human embryo donation.

OBJECTIVE: To identify main ethical and legal issues that arise with donation of embryos left over from IVF treatments of infertility or created from separate gamete donations. DESIGN: Analysis of ethical commentary, advisory committee reports, statutes, court cases, and legal commentary relating to gamete and embryo donation and assisted reproduction to assess their effect on donation of created or leftover embryos. RESULTS: Donation of surplus embryos or embryos created from separate gamete donations would help a subset of infertile couples to form families. A program undertaking embryo do

Balancing Public Health and Privacy: South Korea's Infectious Disease Laws Post-MERS and COVID-19.

This study evaluates South Korea's legislative amendments related to infectious disease after the 2015 Middle East respiratory syndrome (MERS) outbreak and how they were applied during the COVID-19 pandemic. A significant legal case after the 2015 MERS outbreak highlighted the government's liability due to inadequate response, which led to amendments in the Infectious Disease Control and Prevention Act. Key revisions included changes to epidemiological investigations, information disclosure, and requests to provide information. This study reviews the application of these amendments during COVI

Birth-related long bone fractures in otherwise healthy newborns and medical professional liability: literature review and case presentation.

Birth-related long bone fractures are rare but clinically significant events that require careful evaluation to distinguish them from fractures caused by underlying pathological conditions or non-accidental trauma. Their diagnosis and management have important clinical and medico-legal implications. A selective literature review was conducted to identify relevant studies published between 2004 and 2024, regarding incidence, mode of delivery, fracture location, time to diagnosis, treatment, and outcomes. Additionally, an original case report of a female neonate diagnosed with femoral shaft frac

Malpractice and compensation claims after hip fracture care: A systematic review of cross-jurisdiction trends and predictors of plaintiff success.

BACKGROUND: Hip fracture care requires timely diagnosis, expedited surgery, and high-risk inpatient management. Failures along this pathway can result in patient harm and malpractice exposure. This review synthesized cross-jurisdiction malpractice trends and inflation-adjusted liability payments associated with adult hip fracture care. METHODS: A PRISMA-guided systematic review was conducted. PubMed, Embase, Web of Science, Scopus, and the Cochrane Library were searched from January 2000 through January 2026. Eligible studies reported malpractice claims and outcomes specific to adult hip frac

Infective endocarditis and litigation for compensation on healthcare-associated infections: An Italian sample analysis.

BACKGROUND: Litigation related to Healthcare-Associated Infections (HAIs) in Italy represent a growing field of interest in establishing the medico-legal link between infection and the healthcare environment and practices for compensation; it is little explored in the cardiovascular surgery regarding infective endocarditis (IE). METHODS: We retrospectively analysed the civil judgements on infective endocarditis in the Italian region Emilia-Romagna from 2016 to July 2024 using Ministry of Justice national official database. The search was conducted on the online database on July 31, 2024, usin
