The state of abortion rights in the US.

In Dobbs v. Jackson Women's Health Organization (2022), the US Supreme Court reversed longstanding court precedents that protected abortion as a fundamental right. Without that federal baseline, many states are passing restrictive laws that threaten providers and complicate patient care. The legal issues raised by these state restrictions are complex, including questions such as the exterritorial application of state restrictions and federal authority to regulate access to medication abortion. Meanwhile, providers who risk criminal or civil penalties for violating these laws may be deterred fr

Legal and policy issues from the United States and internationally about mandatory reporting of child abuse.

Laws that mandate reporting of child abuse have stirred global controversy. Mandatory reporting to authorities for different types of child abuse includes physical abuse, sexual abuse, emotional abuse, physical neglect, educational neglect, and emotional neglect. While the definition of child abuse differs from jurisdiction-to-jurisdiction, which covers a wide spectrum of abuse and maltreatment, employees who work in professions required to report child abuse include health care workers, educational employees, social workers, religious leaders, employees of divisions of child protective servic

Ending the Opioid Epidemic by Changing the Culture.

The opioid epidemic continues to take thousands of lives each year in the United States, more than motor vehicle accidents and suicides combined. Real solutions, based on science, will require a culture shift in the way that we think about and respond to substance use disorders, in the healthcare system and in our communities. Just more of the same approach will not turn the tide. This article discusses how to better understand the use of psychoactive drugs and how prevention, treatment and policy change can disseminate evidence-based practices, fight stigma, and advance harm reduction; not on

Would it be legally justified to impose vaccination in Israel? Examining the issue in light of the 2013 detection of polio in Israeli sewage.

BACKGROUND: The detection of wild poliovirus in Israeli sewage in May 2013 led the health authorities to decide that children who had been vaccinated with IPV would also be vaccinated with OPV. The decision sought to protect vulnerable Israeli individuals who were either not vaccinated with IPV or who suffered from an immune deficiency, to preserve Israel's status as a polio-free country, to prevent the virus' "exportation" into vulnerable polio-free countries, and to participate in the global efforts toward the eradication of polio. After a massive public persuasion campaign, 79% of the child

[A debate of the legal regulation of organ transplantation in West and East Germany (1960 - 1989). A comparative study].

The debate on the legal frameworks of organ transplantation in Germany began in the 1960s with the upcoming of new medical treatments. Since there were two German States at that time, the Federal Republic of Germany (FRG) and the German Democratic Republic (GDR), the process of the discussion on the way to legislation took place under two very different circumstances. In 1975 the GDR implemented a decree regarding the legal aspects of organ transplantation. Meanwhile the discussion in the FRG proceeded with no result until 1997. The analysis of articles in German medical and juridical journals

Normative lessons: codes of conduct, self-regulation and the law.

Good medical practice: a code of conduct for doctors in Australia provides uniform standards to be applied in relation to complaints about doctors to the new Medical Board of Australia. The draft Code was criticised for being prescriptive. The final Code employs apparently less authoritative wording than the draft Code, but the implicit obligations it contains are no less prescriptive. Although the draft Code was thought to potentially undermine trust in doctors, and stifle professional judgement in relation to individual patients, its general obligations always allowed for flexibility of appl

Bromocriptine related atypical vascular accidents postpartum identified through medicolegal reviews.

Recent literary case reports indicate that bromocriptine mesylate, when used for the suppression of lactation in the puerperium, can cause serious and even lethal side effects. The untoward sequelae are attributed to generalized or focal vasospasm affecting the cardiac and/or cerebral bold vessels. Apart from pre-existing hypertension and use in association with other ergot derivatives, the factors predisposing to such complications have not been elucidated, The authors present three atypical bromocriptine related postpartum accidents which may expand the understanding both of the predisposing

Federal court blocks enforcement of Santa Barbara clinic protection ordinance.

On March 13, Judge Richard Gadbois of the US District Court for the Central District of California issued a preliminary injunction against a Santa Barbara ordinance limiting protests outside medical facilities and places of worship. Passed by the city council in May 1993, the measure prohibits "demonstration activity" in "or within eight (8) feet of the driveway" and bars anyone from obstructing access by refusing to stay eight feet away at the request of a person within 100 feet of the facility. Judge Gadbois recognized that the Santa Barbara council was not "motivated by hostility to the ant

Driving under the influence--a level-I trauma center's experience.

Alcohol-impaired driving is a major issue confronting today's society. New legislation is emerging to help curtail this ongoing problem. To evaluate the legislative effects in terms of outcome pertaining to injured drivers, we analyzed the records of 116 consecutive motor vehicle drivers who were admitted to our trauma center over a 16-month period. Medical reports, police reports, and drivers' abstracts were reviewed. Of the 116 drives, 61 (53%) had blood alcohol concentrations that exceeded the legal limit (blood alcohol level greater than or equal to 100 mg/dL) on arrival at the emergency d
