Gendered Power Relations and Informed Consent: The I.V. v. Bolivia Case.

In a landmark decision handed down on November 30, 2016, the Inter-American Court of Human Rights analyzed the foundations of the right to informed consent. The court held Bolivia responsible for the forced sterilization of I.V., an immigrant woman from Peru, and recognized the importance of personal autonomy as a constitutive element of personality. This paper discusses the ethical foundations of the decision and explains the relevance of this judgment in furthering women's rights in Latin America.

The Right to Trans-Specific Healthcare in Norway: Understanding the Health Needs of Transgender People.

Human rights discourse on the rights of transgender people has to a large extent focused on access to correction of legal gender and medical preconditions for this change. Jurisdictions across the world are now beginning to free legal gender recognition from medical interventions and examinations. State bodies have, however, done little to realise the rights of transgender people to adequate healthcare. A key issue is whether international law obliges states to ensure access to trans-specific healthcare. This article examines the right to healthcare appropriate to transgender persons' needs. D…

Public Health Policy Responses to Population Aging in Mexico: A Rights-Based and Socio-Legal Approach.

Background/Objectives: Population aging represents a major social and public health challenge in Latin America. Mexico has made significant advances in regulatory and policy frameworks. Notable progress includes accession to the Inter-American Convention on Protecting the Human Rights of Older Persons (IACPHROP). It also includes the enactment of the Law on the Rights of Older Persons, and institutional reforms for social and cultural inclusion. This review evaluates Mexico's alignment of aging policies with IACPHROP standards using an integrated framework of social determinants, policies, and…

Understandings of self-managed abortion as health inequity, harm reduction and social change.

This commentary explores how self-managed abortion (SMA) has transformed understandings of and discourses on safe abortion and associated health inequities through an intersection of harm reduction, human rights and collective activism. The article examines three primary understandings of the relationship between SMA and safe abortion: first SMA as health inequity, second SMA as harm reduction, and third SMA as social change, including health system innovation and reform. A more dynamic understanding of the relationship between SMA, safe abortion and health inequities can both improve the desi…

Models of resistance: "victims" lead.

This author has found through professional and personal experience that throughout the world, women directly affected by injustice have led demands for accountability. The purpose of this article is to challenge mainstream human rights groups to create a different type of partnership between themselves and the people for whom they advocate by seeking the involvement of "victims", including leaders of successful "victim-led" initiatives. This approach will result in more appropriate policy recommendations and will enhance both entities' capacity for outreach. Moreover, it will bring mainstream …

Embryo manipulation and experimentation.

I have argued that early human embryos are not human beings, and do not have normal rights. Like human sperm and ova, they are both alive and biologically human. However, they lack the physiological development necessary to sustain a capacity for sentience. If Ford is right, then they are not yet individual human organisms. But the more important point is that their lack of a capacity for sentience makes them inappropriate candidates for the ascription of moral rights. Thus, research on human embryos produced in vitro is not a wrong against them--at least so long as experimentally manipulated

DOCTORS' LIABILITY TO THE PATIENT'S RELATIVES IN GENETIC MEDICINE: ABC V St George's Healthcare NHS trust[2015] EWHC 1394 (QB).

This comment analyses the recent High Court's decision in ABC v St George's Healthcare NHS Trust. In this case, the court struck out a claim brought by a patient's daughter against her father's doctors for their failure to warn her of his hereditary disease. The claimant argued that the doctors' failure caused her harm and violated her rights under the European Convention on Human Rights. It is argued in this comment that the judge should have accepted the claimant's application.

Vulnerable populations in Nepal face hostile environment.

Members of sexual and gender minorities in Nepal frequently have been denied their rights, have been excluded from services and have been the victims of violence. In this article, adapted from a presentation at a concurrent session at the conference , Sunil Pant provides examples of these problems and describes how the Blue Diamond Society (BDS), an organization which promotes human rights and which fights against HIV/AIDS for lesbians, gay men, bisexuals, transgendered persons and men who have sex with men, has responded.

Youth justice and health: An argument against proposed changes to the Youth Criminal Justice Act.

The Canadian Paediatric Society is deeply concerned about the negative effects on the developmental, psychological and emotional health of young offenders if the Youth Criminal Justice Act is amended as proposed. Changing Canada's youth crime law to achieve stiffer sentences for youth 14 years of age and older who are convicted of serious violent offences is contrary to the United Nations Convention on the Rights of the Child. Treating adolescents as adults puts them at serious health and human rights risks - including trauma, violence and abuse - and interferes with their overall development.…

What does the best interests principle of the convention on the rights of the child mean for paediatric healthcare?

The present review analyses the implications of the best interests of the child principle, which is one of the most widely discussed principles of medical ethics and human rights, for paediatric healthcare. As a starting point, it presents the interpretation of the best interests principle by the United Nations Committee on the Rights of the Child. On this basis, it points out possible fields of application of the best interests principle with regard to paediatric healthcare and discusses the potential difficulties in the application of the best interests principle. Based on this, it illustrat…

Being yourself is a defect: analysis of documented rights violations related to sexual orientation, gender identity and HIV in 2022 using the REAct system in six eastern European, Caucasus and Central Asian countries.

INTRODUCTION: Removing legal barriers to HIV services is crucial for the global 2030 goal of ending the HIV and AIDS epidemic, particularly in eastern Europe, the Caucasus and central Asia. Despite state commitments to uphold human rights, gay, bisexual and other men who have sex with men (gbMSM), along with transgender people (TP) still face stigma and discrimination. This article presents an analysis of rights violations based on sexual orientation and gender identity (SOGI) and HIV reported in 2022 across six countries, highlighting features and their links to legislation and law enforcemen…

Conscientious objection in reproductive health care: Analysis of Pichon and Sajous v. France.

This article explores the issue of conscientious objection invoked by health professionals in the reproductive and sexual health care context and its impact on women's ability to access health services. The right to exercise conscientious objection has been recognized by many international and European scholars as being derived from the right to freedom of thought, conscience and religion. It is not, however, an absolute right. When the exercise of conscientious objection conflicts with other human rights and fundamental freedoms, a balance must be struck between the right to conscientious obj…

Medical interventions for children born with variations in their sex characteristics: what's the rights approach?

There have been growing calls within Australia and beyond to defer medical interventions for children born with variations in their sex characteristics. These calls are increasingly grounded in the claim that such interventions when performed on infants and young children are a violation of their human rights. This paper examines the basis for this claim. It also examines the differences between the principles-based approach to medical ethics which has tended to dominant decisions regarding the treatment of children born with variations in their sex characteristics, relative to the adoption of…

[The trans depathologization perspective: a contribution to public health approaches and clinical practices in mental health? SESPAS Report 2020].

Over the last decade, the academic-activist trans depathologization perspective has contributed to a change in the conceptualization of gender transition processes. Observing an interrelation between psychiatrization and transphobic violence, trans depathologization activist groups and allies demand the removal of the diagnostic classification of transexuality as a mental disorder. Furthermore, they have developed trans health care models and legal gender recognition processes based on depathologization and human rights perspectives. They propose changing the role of mental health professional…

An investigation into the ancient abortion laws: comparing ancient Persia with ancient Greece and Rome.

Since the dawn of medicine, medical rights and ethics have always been one of mankind's concerns. In any civilisation, attention paid to medical laws and ethics depends on the progress of human values and the advancement of medical science. The history of various civilisations teaches that each had its own views on medical ethics, but most had something in common. Ancient civilisations such as Greece, Rome, or Assyria did not consider the foetus to be alive and therefore to have human rights. In contrast, ancient Persians valued the foetus as a living person equal to others. Accordingly, they …
