Radiation litigation and the nuclear industry--the experience in the United Kingdom.

In the United Kingdom, the Nuclear Installations Act 1965 places a "strict" statutory duty on the operators of nuclear facilities to ensure that any exposure to radiation resulting from operations does not cause injury or damage. A claimant does not have to prove fault to receive compensation under the Act, only causation. The 1965 Act has been fundamental in shaping litigation involving the nuclear industry in the UK. Civil law cases brought under the Act will be heard before a single judge (with no jury or technical assessor) who must present his or her decision in a reasoned judgment. This

Hereditary cancer litigation: a status report.

During the past few decades, cancer patients have sued their physicians for negligence in diagnosing or managing their disease, based on the charge that the clinician failed to consider the patient's genealogy when trying to arrive at a diagnosis. Other suits have charged that the clinician is liable for failing to investigate other members of the cancer patient's family, regardless of whether they were his or her patients. Although these cases have been successful only sporadically, they underscore the importance of obtaining a complete cancer history not only of the patient but also the imme

Legal aspects involved in the development of anti-progesterones for fertility control.

The development of medical means of inducing abortion requires a detailed knowledge of the abortion legislation. It is vital that these compounds are developed and used within the legal constraints of the country involved. In the United Kingdom, despite the Act of Union (1707), England and Scotland have not united under one legal system. In England the common law on abortion was superseded by the Offences Against the Persons Act (1861) which declared abortion illegal. This Act does not apply to Scotland where, up until 1967, common law applied. The Abortion Act of 1967 is an exemption act allo

Judgment, 22 July 1987.

The Court held that a husband who, after intensive advice and warning, signs a waiver of his right to contest the legitimacy of a child born through artificial insemination of his wife with the semen of another man must be held to the waiver. It pointed to the extensive counseling received by the husband, concluding that his behavior constituted exceptional circumstances that were against faith and credit, and it noted the difficulties that would be encountered by the child because it would not know the identity of its father. On this basis, it distinguished its decision from the 1983 judgment

Lesbian couples: should help extend to AID?

A considerable amount of publicity has recently centred on a few Lesbian couples who have successfully obtained artificial insemination by donor (AID) in order to have a child. Advice was orginally sought on a private basis from the Journal on the following case: now the issue is public knowledge, the doctor presenting the case has agreed to open discussion, and a case conference was convened to consider it. Those taking part were: Jackie Forster, Co-editor of Sappho; lesbian feminist magazine; Carola Haigh, General Practitioner, London; Ian Kennedy, Barrister and Lecturer in Law, Kings Colleg

The Karen Quinlan case: problems and proposals.

Karen Quinlan, a young American girl, has lain in hospital since 15 April 1975 without any prospect of recovering consciousness. Her breathing is assisted by means of a respirator and she is fed through a tube inserted in her stomach. Her adoptive parents applied to the courts for permission for the respirator to be switched off. The judge refused permission. Using the Quinlan case as an exemplar, Mr. Kennedy analyses the medical points one by one against the legal background. He would like to see established a code of practice to assist doctors in such cases who at present have no legal guida

Mass Probation: Effects of Sentencing Severity on Mental Health for Black and White Individuals.

BACKGROUND: Incarceration is associated with negative impacts on mental health. Probation, a form of community supervision, has been lauded as an alternative. However, the effect of probation versus incarceration on mental health is unclear. Our objective was to estimate the impact on mental health of reducing sentencing severity at individuals' first adult criminal-legal encounter. METHODS: We used the US National Longitudinal Survey on Youth 1997, a nationally representative dataset of youth followed into their mid-thirties. Restricting to those with an adult encounter (arrest, charge alone

Breast cancer medical malpractice litigation in New York: The past 10 years.

Medical error is a leading cause of preventable death in the U.S., with diagnostic errors comprising the majority of errors. Delay in diagnosing breast cancer is a unique multidisciplinary phenomenon involving primary care physicians, gynecologists, radiologists, pathologists, and general surgeons. The New York medical malpractice court system remains among the most active court systems in the country. The purpose of this study is to analyze the characteristics of medical malpractice litigation involving breast cancer in New York for the past 10 years. Jury verdicts and settlements from 2007 t

Revealing the secrets of the body: medical tests as legal evidence in personal status disputes in modern Egypt.

The study seeks to answer the following question: In the field of personal status, what kinds of medical tests have been considered reliable and acceptable by Egyptian courts of law, what kinds have been less accepted, and why? The main finding is that, on the one hand, the judges (qădĭs) have welcomed tests that seek to determine age or to discover physical diseases and/or mental disorders. On the other hand, they have been reluctant to introduce tests to determine virginity and pregnancy tests, and even more so to introduce paternity tests that might bring into light manifestations of moral
