Massive hemorrhage: a report from the anesthesia closed claims project.

BACKGROUND: Hemorrhage is a potentially preventable cause of adverse outcomes in surgical and obstetric patients. New understanding of the pathophysiology of hemorrhagic shock, including development of coagulopathy, has led to evolution of recommendations for treatment. However, no recent study has examined the legal outcomes of these claims. The authors reviewed closed anesthesia malpractice claims related to hemorrhage, seeking common factors to guide future management strategies. METHODS: The authors analyzed 3,211 closed surgical or obstetric anesthesia malpractice claims from 1995 to 201…

The time has come for a paradigm shift in obstetrics' medico-legal litigations.

Cerebral Palsy (CP) represents the most common neuromuscular disability in childhood and it is caused by a multiplicity of factors. Intrapartum fetal surveillance is still a controversial issue: even though intrapartum hypoxia alone plays a minimal role in causing neonatal cerebral damage, obstetricians face a large number of medical malpractice litigations for alleged birth mismanagement. The cardinal driver of CP litigation is Cardiotocography (CTG): despite its suboptimal performance in reducing the occurrence of intrapartum brain injury, its ex post interpretation is widely used to evaluat…

Protecting the airway and the physician: Aspects of litigation arising from tracheotomy.

BACKGROUND: In recent decades, medical malpractice costs have increased and have led to a change in the way physicians practice medicine. Tracheotomies are cases in which complications have a high risk of morbidity and mortality and the potential for litigation. METHODS: The Westlaw legal database was used to gather data on 43 jury verdicts and settlements from 1987 to 2013. Various factors included outcome, defendant specialty, and the reason for litigation. RESULTS: Median settlements were $500,000 and median verdict awards were $2,000,000. Postoperative negligence was alleged most often (…

Medical and legal issues related to brachial plexus injuries in neonates.

Injuries to the brachial plexus in neonates present a malpractice dilemma not only for physicians who provide obstetric care, but also for those who administer immediate postnatal treatment for newborns who have these injuries and comorbid medical conditions. Although trauma remains the probable etiology for many brachial plexus injuries, other, nontraumatic etiologies need to be considered. The authors review current medical and legal principles related to brachial plexus injuries-principles that are of concern to all practitioners who provide obstetric and newborn care. They also make a numb…

Post-mortem Imaging of Brain/Spine Injuries: The Importance of a Comprehensive Forensic Approach.

In forensic investigations, the limitations of the traditional purely autoptic approach can be overcome through post-mortem imaging (virtopsy). Virtospy has several applications to the investigation of brain and spinal injuries, whose analysis can be of forensic interest, especially in cases of suspected malpractice. In this scoping review, we briefly describe the main applications of the two most common post-mortem radiological techniques (computed tomography (CT) and magnetic resonance imaging (MRI)) to the forensic investigation of brain and spinal injuries in cases of medical malpractice o…

A Contemporary Analysis of Medicolegal Issues in Obstetric Anesthesia Between 2005 and 2015.

BACKGROUND: Detailed reviews of closed malpractice claims have provided insights into the most common events resulting in litigation and helped improve anesthesia care. In the past 10 years, there have been multiple safety advancements in the practice of obstetric anesthesia. We investigated the relationship among contributing factors, patient injuries, and legal outcome by analyzing a contemporary cohort of closed malpractice claims where obstetric anesthesiology was the principal defendant. METHODS: The Controlled Risk Insurance Company (CRICO) is the captive medical liability insurer of th…

Life-threatening Rash Due to Lamotrigine and a Failure to Understand Its Pharmacology: How Forensic Detective Work Uses Medical Knowledge and Clinical Pharmacology to Solve Cases.

This column is the second of a 3-part series describing cases where general medical knowledge, including psychiatric and clinical pharmacology, were instrumental in determining dereliction and direct cause in a malpractice suit. This case summarizes how lamotrigine can cause dangerous consequences if its pharmacology is not properly understood. The case also illustrates how the 4 Ds of a forensic malpractice suit were met in this case. First, there was duty on the part of the prescriber which, if followed, would have prevented or minimized the damages experienced by the patient. Dereliction in…

A case of fatal perimyocarditis due to a rare disease.

Although myocarditis is caused by viral infections in about 50% of cases in European countries, various other causative agents are known. We report the case of a 51-year-old man who died several months after being diagnosed with asthma by his general practitioner. This diagnosis had been confirmed by a pulmonologist approximately 6 weeks before the man's death. To rule out the possibility of medical malpractice the prosecuting authority ordered a forensic autopsy. At autopsy macroscopic indicators for perimyocarditis and pneumonia were found. Microbiological and histological examination of tis…

Professional responsibility between guidelines and customary practice. A conflict of interest?

In Countries with Common Law, the principles of medical liability in case of malpractice claim are based on the Bolam/Bolitho tests, that is, the opinion of a panel of average professionals of the same specialty. On the contrary, in Countries whose legal system is based on the Corpus Iustinianeum the practice of a doctor is benchmarked against established guidelines. Occasionally, the opinion of an expert panel may not overlap the formal guidelines, in particular in cases like the surgical treatment of acute diverticulitis and that of acute cholecystitis where pre-existing old-fashioned ideas …

The lingual tonsillar hyperplasia in relation to unanticipated difficult intubation: is there any relationship between lingual tonsillar hyperplasia and tonsillectomy?

The lingual tonsillar hyperplasia (LTH) is a rare and dangerous condition of the upper airway because it is one of several risks during intubation which can cause serious complications like cardiac arrest, cerebral anoxia, and death. The LTH is rarely detectable during a routine oropharyngeal examination. The lingual tonsil is of particular interest to forensic medicine to assess cases with malpractice in connection with intubation difficulties. Our study looked at how often autopsy specimens had enlarged lingual tonsils and whether any relationship existed between LTH and tonsillectomies. In …

Development and Validation of Machine Learning Models for Postjudgment Estimation of High Compensation Ratios After Lower Limb Fracture Surgery: Retrospective Study.

BACKGROUND: Orthopedic surgery is the second most common subspecialty involved in medical malpractice claims, wherein lower limb surgery carries a higher risk of claims and involves higher compensation amounts. However, effective tools for postjudgment estimation of high compensation ratios and consistency assessment against prior similar cases after lower limb fracture surgery are currently lacking in medicolegal risk management and judicial practice. OBJECTIVE: This study aimed to develop and validate multiple machine learning (ML) models to estimate a medical malpractice compensation ratio…

Improving Patient Outcomes Through Closed-Claims Analysis: Salient Characteristics and Patterns Associated With Respiratory Events.

A retrospective, exploratory research design was used to analyze salient characteristics and patterns associated with closed claims involving Certified Registered Nurse Anesthetists (CRNAs) in which a respiratory event caused the adverse outcome. Alleged malpractice acts found in these claims occurred between 2003 and 2012. Respiratory events were the most frequent cause of adverse outcomes in the current database (34%). The respiratory adverse outcomes often resulted in mortality or significant and permanent morbidity (69%) and were largely preventable (81%). Of these respiratory outcomes, in…
