Statutory Compensation for the Wrongly Imprisoned.

This article provides an overview of the unique challenges faced by men and women who have been wrongly convicted, imprisoned, and subsequently exonerated, and discusses the relevance of social work to exoneration. The ways in which exonerees can seek compensation are described, and state compensation statutes are examined, delineating monetary and reentry support provisions. Currently, 30 states and the District of Columbia have compensation statutes. Monetary and reentry support provisions vary greatly by state, with few providing both. The wrongly imprisoned experience the same effects of i

Hand eczema-Part 2: Prevention, management, and treatment.

Prevention methods are important for patients with hand eczema (HE), especially those with risk factors. Frequent use of moisturizers is encouraged. Few drugs have been approved specifically for HE. Topical corticosteroids remain the mainstay treatment. Several new topical and systemic drugs are currently in development for HE. Dupilumab has recently been shown effective for chronic HE. Established criteria can be used to help determine causality for occupational HE, which is important for worker's compensation. The second article of this CME series discusses prevention, management, treatment,

The impact of income support systems on healthcare quality and functional capacity in workers with low back pain: a realist review.

Low back pain (LBP) is a leading cause of work disability. While absent from work, workers with LBP may receive income support from a system such as workers' compensation or social security. This study examines how and in what contexts income support systems impact the healthcare quality for people with work disability and LBP and their functional capacity. We performed a realist review. Five initial theories about the relationship between income support systems and outcomes were developed, tested, and refined by acquiring and synthesising academic literature from purposive and iterative elect…

Analysis of text from injury reports improves understanding of construction falls.

OBJECTIVE: We combined payroll data, coded workers' compensation (WC) data, and text descriptions of injuries from the construction of Denver International Airport to create a more comprehensive picture of falls from height (FFH) than is typically available from WC data. Text descriptions were coded to identify circumstances surrounding falls. Slips/trips preceded one third of FFH, often involving motor vehicles or heavy equipment. Another third involved movement or collapse of work surfaces, usually ladders or scaffolds. CONCLUSIONS: The significant contribution of motor vehicles and heavy e…

Changes in logging injury rates associated with use of feller-bunchers in West Virginia.

PROBLEM: It is well documented that logging is one of the most dangerous occupations and industries in which to work, and trees fellers are at greatest risk of injury. The objective of this study was to determine whether West Virginia (WV) logging companies experienced a reduction in injuries after beginning to use feller-bunchers (tree cutting machines, which replace some of the work done with a chainsaw) during harvesting operations. METHODS: WV workers compensation claims and employment data from 1995 to 2000 were used to calculate injury rates. Injury trends in the rest of the WV logging

Epidemiology of foot and ankle injuries in the workplace.

Injuries to the ankle, foot, and toes of injured workers are common. Although the workers' compensation system attempts to collect information about these injuries and report them in a meaningful way, the process is somewhat inconsistent, inaccurate, and provides information relevant to government agencies but not to physician organizations seeking to improve the prevention and treatment of work-related injuries. Several improvements in data collection could greatly increase the system's efficiency and usefulness. The first is to establish a national system of uniform data collection from each…

[Rehabilitation program for assurance of occupational capacity].

This article concerns the specific Federal German regulations governing payment of rehabilitation costs by the statutory insurance body within the framework of the legally prescribed pension fund insurance. Rehabilitation measures covered by this legislation should be taken as soon as initial health disorders are noticed that do not yet seriously hamper the personal and professional performance of the relevant individual. The number of persons to be treated for rehabilitation is determined inter alia by job factors that are injurious to health as well as by factors representing the individual'

Emotional adjustment in compensated head injury patients.

Patterns of emotional adjustment based on the Minnesota Multiphasic Personality Inventory (MMPI) were examined in a group of 124 patients who had suffered head injuries, reported postconcussional symptoms, and were receiving compensation. Cluster analytical procedures were used to identify subgroups. The sample was divided into two equivalent groups for purposes of crossvalidation. The results of the analyses in the two samples yielded similar patterns. Within each subgroup, the groups differed on the level and pattern of emotional disturbance. Approximately 65% of the sample had normal profil

Factors underlying observed injury rate differences between temporary workers and permanent peers.

BACKGROUND: Temporary workers face increased risk of injury as compared to permanent workers in similar occupations. This study explores the role played by several potential risk factors. METHODS: Injured temporary and permanent workers, matched by industry, tenure and demographic characteristics, were interviewed to isolate the association of temporary employment with several injury risk factors. RESULTS: Temporary workers had higher workers' compensation claims rates than their permanent worker-peers. In interviews temporary workers a reported a lower frequency of exposure to hazards. Howe…

Insurers' perspective on barriers and facilitators for return to work after occupational injuries.

BACKGROUND: Despite the importance of the legislative and insurance systems in the return to work process after an occupational injury, the perspective of the insurer on what influences return to work has rarely been documented. OBJECTIVE: To understand the barriers or facilitators for return to work, from the perspective of the insurer. METHODS: A comprehensive qualitative approach was used. Semi-directed interviews were done with nineteen (19) insurers (claims adjudicator and rehabilitation case manager) from a Canadian workers' compensation board. A thematic analysis was done using QDA Mi…

Impact of work-related compensation claims on surgical outcome of patients with rotator cuff related pathologies: a matched case-control study.

BACKGROUND: The purpose of this matched case-control study was to examine the impact of an active compensation claim following a work-related shoulder injury on reporting disability, as measured by subjective and objective outcomes at 1 year postoperatively. METHODS: Data of 517 consecutive patients who had undergone a decompression or rotator cuff repair were reviewed. One-hundred and ten patients were on compensation related to their shoulder problems. These patients were matched with a historical control group (patients without a compensation claim) based on age, sex, and level of patholog

Impact of compensation on work outcome of carpal tunnel syndrome.

BACKGROUND: Work-related carpal tunnel syndrome (CTS) is a complex and costly condition. There is some evidence that the employment outcome may be worse in cases of CTS where the condition is being considered for compensation. AIM: To examine whether workers' compensation status is an important determinant of outcome of CTS. METHODS: Cases, with a Workers' Compensation Board (WCB) claim, and referents, in work but without a WCB claim, were identified from the practice of a single specialist physician. Data on history prior to and at the time of diagnosis, and events since diagnosis, were col…

Predictors of Postoperative Patient-Reported Outcome Measure Response Rates Among Patients With Rotator Cuff Repair.

BACKGROUND: Patient-reported outcome measures (PROMs) contribute to evaluating and improving the quality of patient care. Patient outcomes a … (complete or partial) were associated with older age, later year of surgery, White race, and having workers' compensation insurance. The strongest predictor of PROM response was having workers' compensation insurance. CONCLUSION: Patients with workers' compensation insurance compared with other insurance types responded to PROMs at disproportionately higher rates. Thi …

A 1- to 4-year follow-up review of treatment of sciatica using chemonucleolysis or laminectomy.

To help clarify the comparative effects of chemonucleolysis and discectomy, the author studied 178 consecutive patients with sciatica who did not respond to conservative treatment. None had previously undergone laminectomy or chemonucleolysis or had spinal stenosis. All received postmyelography computerized tomography (CT) and, if the radiological interpretation was that of an extruded migrated disc, a laminectomy was performed; otherwise, the patient was given a choice of the two procedures. Of the 178 patients, 106 underwent chemonucleolysis and 72 laminectomy. Workers' compensation was bein…

Preplacement nerve testing for carpal tunnel syndrome: is it cost effective?

UNLABELLED: Is not hiring otherwise-qualified workers who have an abnormal post-offer preplacement (POPP) median nerve test a cost-effective strategy to reduce workers' compensation expenses related to carpal tunnel syndrome (CTS)? We performed a retrospective dynamic cohort study based on 2150 workers hired at a company between January 1996 and December 2001 and who underwent POPP median nerve testing. Workers were followed until they left the company or until follow-up ended in May 2003. RESULTS: Thirty-five cases of work-related CTS occurred during follow-up, and 9.13 cases could have been…

Managing disease on the goldmines: 'work-related' and 'non-work-related' diseases.

OBJECTIVE: The mining industry in South Africa makes a distinction between work-related and non-work-related diseases because of the legal obligation to provide compensation for work-related diseases such as the various pneumoconioses. In this paper we consider the ways in which this distinction helps or hinders the delivery of health care services in the mining industry in South Africa. In particular we examine the inter-relationship between silicosis, which is compensatable, tuberculosis, for which limited compensation is made, and HIV, which is not compensatable, in order to suggest ways to
