It is not usual to use care without consent in the management of eating disorders when the patient refuses the care indicated. Yet, these are psychiatric disorders responsible for a high mortality rate and a high risk of chronicity. Their management is complex, multidisciplinary and the refusal of care in the most severe cases raises ethical questions. It is important for the clinician to know the impact of these disorders, notably on the patient's cognitive and judgment capacities, in order to evaluate the necessity of implementing a restraint measure.

There are several points where ethical decision-making has become paralyzed and inefficient as the field of Alzheimer's disease study has advanced. The focus of this review is to highlight these points and several lines of research that can inform ethical decision-making. The goal is to identify barriers and to move toward solutions. Examples of other fields of study that can be particularly useful for innovative ways to study effective ethical decision-making include implementation science and neuroscience of decision-making, as well as therapeutic investigations of other domains such as the

In some 'covert' participant-observation studies, social researchers defend their omission of informed consent on the basis of a need to protect subjects from apprehension, nervousness, or even criminal prosecution. In other instances, researchers contend that deception is rampant in society, and that their methods are no more immoral than the behaviour that ordinarily prevails. These defenses of covert methods fail to appreciate the range of risks that may be involved, and in the latter case, fail to show that these methods are in fact morally indistinguishable from the 'deception' that peopl…

BACKGROUND: The tension between the ideal of informed consent and the reality of the process is under-investigated in spine surgery. Guidelines around consent imply a logical, plain-speaking process with a clear endpoint, agreement and signature yet surgeons' surveys and patient interviews suggest that surgeons' explanation is anecdotally variable and patient understanding remains poor. To obtain a more authentic reflection of practice, spine surgeons obtaining 'informed consent' for non-instrumented spine surgery were studied via video recording and risk/benefit discussions were analysed.

Recent revisions to the Common Rule require that consent documents begin with a focused presentation of the study's key information that is organized to facilitate understanding. We surveyed 1,284 researchers working with older adults or individuals with Alzheimer's disease, supplemented with 60 qualitative interviews, to understand current use and barriers to using evidence-based formatting and plain language in key information. Researchers reported using formatting in 42% of their key information sections, and plain language in 63% of their key information sections. Perceived barriers includ

INTRODUCTION: Obtaining valid consent is a legal and ethical obligation when performing any procedure in clinical practice. This study was performed to identify the validity and effectiveness of the new consent form and any potential improvement that could be made when taking consent.
PATIENTS AND METHODS: Case notes of 173 patients undergoing surgery for fractured neck of femur were retrospectively reviewed. Risks and complications of the surgery as listed on the consent form were noted. Sixty-five cases were excluded from the study as they had either old consent forms with no risks recorded

Stem cell-based models of the human brain benefit from biospecimens that can be used for a broad range of future research. But current regulations do not address the desire of research participants to remain engaged beyond initial biospecimen donation. We present practicable strategies for engaging participants while preserving scientific potential.

BackgroundIndividuals with intellectual and developmental disabilities (IDD) face significant health disparities, often exacerbated by ethical and legal complexities in nursing care. Nurses are frequently challenged to balance autonomy, informed consent, patient safety, and human rights, especially in settings with unclear guidelines or insufficient training. This narrative review explores the ethical and legal considerations in nursing care for individuals with IDD, aiming to highlight challenges and propose best practices.MethodsA narrative review methodology was employed to synthesise evide…

The four-skills model of decisional capacity for providing informed consent for medical treatment developed by Appelbaum and Grisso is codified into most state statutes in articulating the legal criteria for establishing capacity. Decisional capacity is traditionally determined at a point in time based on a narrow clinical question; however, there are clinical scenarios in which patients may currently have decisional capacity but their recurrent nonadherence to care places them at foreseeable risk of being acutely incapacitated, both decisionally and functionally, in the near future. There is …

BACKGROUND: The emergence of molecular HIV surveillance (MHS) and cluster detection and response (CDR) programs as key features of the United States (US) HIV strategy since 2018 has caused major controversies. HIV surveillance programs that re-use individuals' routinely collected clinical HIV data do not require consent on the basis that the public benefit of these programs outweighs individuals' rights to opt out. However, criticisms of MHS/CDR have questioned whether expanded uses of HIV genetic sequence data for prevention reach beyond traditional public health ethics frameworks. This study

Our study examined the association between HIV disclosure without consent and verbal and/or physical violence due to HIV status among women living with HIV (WLWH). This study draws on baseline data of a sample (N = 316) from SHAWNA, a longitudinal community-based open cohort with WLWH in Metro Vancouver, Canada (2010-2019). Bivariate and multivariable logistic regression was used to investigate factors associated with physical and/or verbal violence due to HIV status. Adjusted odds ratios (AOR) and 95% confidence intervals [95%CIs] are reported. In total, 46.5% experienced non-consensual discl
