Analysis of NHSLA claims in hand and wrist surgery.

Claims for negligence are increasing in medical practice. We analysed data provided by the UK NHS Litigation Authority (NHSLA) on all hand and wrist surgery from 1995-2001. The numbers of claims increased from 13 to 40, but the number being successfully defended also increased from 2 to 13 during this period. Claims were most commonly attributed to errors at surgery (56%) or in outpatient clinics (24%). Strikingly the claims are clustered to a few common conditions, particularly the treatment of carpal tunnel syndrome (22%) and wrist fractures (48%). There were no claims related to complex han

Breast implants and illness: a model of psychological factors.

Studies of disease outcomes have not produced an explanation or an intervention for the symptoms and complaints that some women have attributed to breast implants. Reviews of the literature have found no increased risk of specific systemic disease, and no treatment recommendations have emerged. However, similar symptoms in fibromyalgia, chronic fatigue, and other contexts have been considered to be stress or behaviourally mediated, and a number of promising behavioural interventions have been developed. Aetiological, research, and treatment implications may follow from the consideration of suc

[Lesions of the lingual nerve during extraction of the mandibular wisdom teeth. Consequences--etiopathogenesis--prevention--prognosis--legal medical aspects].

A brief review of the lingual nerve anatomy is followed by an examination of the consequences of injury to the lingual nerve during mandibular wisdom tooth extraction on sensibility and sensorial activities. The circumstances of such injury are described as a function of the position of the tooth together with means of prevention. The clinical course of injury to the lingual nerve is unpredictable and varies over time and in quality of recovery. No prognosis can be made before a reasonable delay of 18 months to 2 years. Prevention remains the best treatment and consists of using a flexible bar

Fetal versus maternal rights: medical and legal perspectives.

This report deals with a patient's refusal to undergo cesarean section, which was recommended when fetal distress occurred in labor. Faced with this conflict of maternal and fetal rights, the physicians, administrators, and attorneys of the hospital requested a hearing and decision on the issue by the juvenile court. As a result cesarean section was performed as ordered by the court to safeguard the life of the unborn infant in spite of the objections of the mother. This case, in part, illustrates the need for the administrative capability to deal with such a situation even on an emergency bas

Kidney donation--where some of the problems lie.

If a viable kidney transplant programme is to be continued on a national basis, many of the problems at present surrounding organ transplantation must be tackled urgently. This paper discusses the psychological and emotional problems which are presently seen to hinder a successful renal transplantation policy, and considers the relative advantages and disadvantages of the kidney donor card scheme.

Extended-release naltrexone and drug treatment courts: Policy and evidence for implementing an evidence-based treatment.

With insufficient access to treatment and a tradition of criminalizing addiction, people with substance use disorders - including opioid dependence - are more likely to be incarcerated than they are to receive the treatment they need. Drug treatment courts aim to address this problem, engaging their participants in substance use treatment in lieu of incarceration. Drug courts offer an especially important window of opportunity to connect opioid-dependent participants to extended-release naltrexone (XR-NTX), at a time when they are under highly-structured court supervision and required to detox

Judges' delivery of ground rules to child witnesses in Australian courts.

Ground rules directions are given to children in forensic interviews to explain what is expected of them, and to reduce their tendency to acquiesce to erroneous or incomprehensible questions. Ground rules may also be necessary when children provide testimony in court. Drawing on research conducted for the Australian Royal Commission into Institutional Responses to Child Sexual Abuse, the present study examined the use of ground rules directions delivered in court in 52 trials by 24 presiding judges in three jurisdictions to 57 child complainants (aged 7-17.5 years). Eleven categories of rules

Getting evidence into action to tackle institutional child abuse.

The Australian Royal Commission into Institutional Responses to Child Sexual Abuse is an example of a government response to survivors' demands to address the harm they suffered. It is also a major response by a national government to improve child safety in the future. Facing up to child abuse is difficult and in other countries similar inquiries have suffered delays and derailing. This commentary uses an evidence-to-action lens to explore why clear evidence of child sexual abuse may be ignored and side-lined. It argues that where evidence challenges the powerful, is surprising and shocking,
