Not just "bodies with vaginas": A Kantian defense of pelvic exam consent laws.

Medical students commonly learn how to administer pelvic exams by practicing on unconscious patients, often without first obtaining explicit consent from patients to do so. While 21 states currently have laws that require teaching hospitals to obtain consent from patients to participate in this educational experience, opposition from the medical community has stymied legislative progress. In this paper, I respond to the two most common reasons offered to oppose the legislation, which appeal to (1) the educational benefits of these exams or (2) protecting institutional autonomy. Kantian ideas a

Psychiatric advance directives and consent to electroconvulsive therapy (ECT) in Australia: A legislative review and suggestions for the future.

Psychiatric Advance Directives (PADs) have been adopted in many jurisdictions around the world and in most Australian states and territories. They are seen as a less restrictive and patient-centered approach to the provision of mental health care. Electroconvulsive therapy (ECT) is a restricted treatment in most jurisdictions in Australia and across the world. This paper explores the history, regulation and use of ECT and PADs and the intersections between them. It provides an overview of the legislative framework in each Australian state and territory and explores some of the issues which hav

Consent in organ transplantation: putting legal obligations and guidelines into practice.

Consent in medical practice is a process riddled with layers of complexities. To some extent, this is inevitable given that different medical conditions raise different sets of issues for doctors and patients. Informed consent and risk assessment are highly significant public health issues that have become even more prominent during the course of the Covid-19 pandemic. In this article we identity relevant factors for clinicians to consider when ensuring consent for solid organ transplantation. Consent to undergo solid organ transplantation is more complex than most surgical and other clinical …

[Ethical issues for the further development of psychiatric deep brain stimulation].

BACKGROUND: Except in the case of obsessive-compulsive disorder, deep brain stimulation (DBS) for psychiatric indications is an experimental … S. Apart from that, special care should be taken in assessing competency and the ability to provide informed consent. CONCLUSION: Interest in the subjective experiences of patients being treated with DBS, proactive ethical reflection and an increase in the scale of research efforts are essential for the acceptance and further development of DBS for psychiatric in …

A review of medicolegal malpractice suits involving cervical spine: what can we learn or change?

STUDY DESIGN: Utilizing Verdict Search (East Islip, New York), a medicolegal research service for civil and criminal court cases, 78 cervica … ing cervical suits, and typical for most surgery-related suits, included negligent surgery, lack of informed consent, and failure to diagnose/treat; the fourth unanticipated factor was failure to brace. Outcomes for these suits included 30 defense verdicts (10 quadriplegic patients), 22 plaintiffs' verdicts (average payout $4.0 million dollars), and 26 settlements …

Consent for childhood cancer tissue banking in the UK: the effect of the Human Tissue Act 2004.

The obtainment, storage, and use of human tissue taken from children for research purposes is an area that is notable for its complexity and legal uncertainties. In the UK, the controversy surrounding organ retention prompted radical legislative change in the form of the Human Tissue Act 2004, which came into force from September, 2006. This Review paper explores the effect of the Human Tissue Act on consent, in the context of childhood tissue banking. We take as our case study the UK Children's Cancer Study Group tumour bank. Although the Human Tissue Act provides a new, detailed statutory fr

BACKGROUND: Thought disorder (TD) is a core feature of severe mental illnesses such as schizophrenia, characterized by disruptions in speech … TS: We argue for a shift toward supported inclusion through tailored capacity assessments, enhanced informed consent procedures, targeted training of research personnel, and systemic institutional practices. Incorporating lived experiences of those with TD as research partners is integral to this approach, fostering co-production of research that is more valid, in …

A FHIR Consent Profile for European Research Biobanks.

Digital dynamic consent is a key element to improve the involvement of participants as proactive partners in research and requires the adoption of standard-based information models to support data reuse. In this work we present the HL7 FHIR Consent Profile we developed to integrate individual consent preferences on biobanked samples and relative information within the infrastructure of the the Biobanking and BioMolecular Resources European Research Infrastructure Consortium (BBMRI-ERIC). The Profile builds on the official HL7 FHIR Consent Resource and adopts the Common Condition of use Element

Is assisted dying a treatment?

This paper focuses on the nature of the assisted dying (AD) decision including the object of the mental capacity test. Specifically, we inquire into whether AD is a treatment decision. In Part I, we analyse how the AD decision is characterised in all international AD statutes also analysing what government guidance says when the primary legislation is ambiguous. In Part II, we address the question normatively: firstly, from the perspective of clinical ethics and secondly from the perspective of legal rules (the doctrine of informed consent and the duties of governments in states with socialise…

Navigating Autonomy: Enhancing Accuracy in Medical Decision-making Capacity Assessment.

Evaluating medical decision-making capability (DMC) is critical for maintaining patient autonomy and informed consent in health care. DMC refers to a patient's ability to comprehend information about their treatment, recognize its implications, reason through the options, and articulate their decision. Several assessment techniques, including the Aid to Capacity Evaluation, the Hopkins Capacity Assessment Test (HCAT), Understanding Treatment Disclosure (UTD), and the MacArthur Competence Assessment Tool, have been discussed in this review. The legal distinction between decisional ability and c…
