Medicolegal aspects of robotic-assisted surgery: litigation trends, complication risks, and human factors interventions.

Robotic-assisted surgery (RAS) sees over six million procedures performed annually. Malpractice claims involving RAS increased by more than 250% between the periods 2006-2013 and 2014-2021 [1]. Understanding the legal landscape, risk profile, and evidence-based mitigation strategies is critical for all stakeholders. This scoping review aimed to: (1) map medicolegal cases involving RAS; (2) quantify complication incidence (3) characterise general and procedure-specific risks; and (4) synthesise interventions capable of reducing adverse events and litigation exposure. A structured search of PubM…

Review of tissue plasminogen activator, ischemic stroke, and potential legal issues.

The use of tissue plasminogen activator in ischemic stroke is controversial. Many practicing physicians believe that its usefulness is established, while others, including professional specialty societies, are less sanguine. A review of the literature appears to show that the use of tissue plasminogen activator is efficacious and can result in highly improved outcomes for a majority of eligible patients. These findings may implicate important potential legal issues. Informed consent concerns and, potentially, medical malpractice claims may result, particularly in the context of evidence-based …

Incidence of risk in shoulder surgery : medical-legal repercussions.

It is generally recognised that any medical-surgical activity entails the risk of failure, placing the physician at risk of malpractice claims. In order to protect both the physician and the patient, it is important to identify the risk factors relating to the various pathological situations and assess both the incidence and significance of such risks. Hence, a "Potential Failure Rating" could be devised already during the preliminary stages for every type of medical process. Such a rating would be useful both in clinical and medicolegal settings. This article considers the most common and imp…

The expert witness. Neither Frye nor Daubert solved the problem: what can be done?

Flawed expert scientific testimony has compromised truth finding in American litigation, including in medical malpractice and in product liability cases. The Federal Rules of Evidence and the Supreme Court in Daubert and other cases have established standards for testimony that include reliability and relevance, and established judges as gatekeepers. However, because of lack of understanding of scientific issues, judges have problems with this role, and juries have difficulties with scientific evidence. Professionals and the judiciary have made some advances, but a better system involving the …

No-fault compensation for medical injury: a case study.

Changes in malpractice law remain an important goal of health care reform. Many state and federal legislators continue to call for measures that would limit the ability of injured patients to sue. There is also growing interest in alternatives to fault-based litigation. As legislators consider no-fault proposals, they can look to Florida's experience with the Neurological Injury Compensation Association (NICA), which for the past four years has been providing no-fault compensation for injured newborns. NICA provides some insights into the ways in which claims are generated, the nature of risk …

Lethal esophageal rupture following treatment with Sengstaken-Blakemore tube in management of variceal bleeding: a 10-year autopsy study.

We report six cases of lethal esophageal rupture following treatment with Sengstaken-Blakemore (SB) tube in management of acute variceal bleeding. Esophageal rupture is a known complication to SB tube treatment which unfortunately often is a result of iatrogenic misplacement of the tube. Our report indicates that despite additional guidelines to verify correct placement and new promising treatment modalities, lethal esophageal rupture still occurs. For a proper evaluation of potential malpractice cases we find it important for forensic pathologists to have knowledge of procedures and complicat…

Gastric mucosal tears and wall micro perforations after cardiopulmonary resuscitation in a drowning case.

A fifty year-old woman died after drowning in a swimming-pool. Rescue and ambulance paramedic teams started resuscitation attempts followed by a medical care helicopter team. Acute haematemesis, mucosal tears and gastric micro perforations occurred, due to the cardiorespiratory resuscitation manoeuvres. Death occurred seven days later due to the cerebral anoxia and multiorgan failure. Forensic investigations excluded possible malpractice during external cardiac massage as responsible for the woman's death, while Judicial Authority considered the death as the consequence of the delayed interven…

[Placental findings in perinatal cases of death].

Autopsy is an indispensable tool to clarify the cause of death in perinatal cases of death. The authors report on two cases of perinatal death, in which not only a forensic autopsy including histological and microbiological examinations had been performed, but the placenta had also been pathologically assessed. Only on the basis of the placental findings was it possible to clarify the cause of death and to answer the question if the physician had committed medical malpractice. The results underline the importance of examining the placenta in perinatal deaths as a matter of routine. In forensic…

Benefits and risks of orthodontic treatment. Report of the 2005 NZAO Symposium.

The biennial symposium of the Education, Research and Development Group (ERDG) of the New Zealand Association of Orthodontists (NZAO) was held in Tauranga on August 5 and 6, 2005. Following a well-tested format the symposium considered the benefits and risks of orthodontic treatment, a timely topic in an age when the role of health-related professions is under increasing public scrutiny in New Zealand. The registration fee included a copy of the book Risk Management in Orthodontics: Experts' Guide to Malpractice, edited by Graber et al (2004). The findings reported here represent the consensus…
