Case reports. II. Sterilization litigation.

Legal questions will continue to increase with this popular operation because sterilization is the second most common procedure performed by gynecologists. Because of patient's expectation, the sterilization patient is particularly vulnerable to suggestions of malpractice after a complication or failure. Careful preoperative preparation of the patient and family; strict attention to equipment, education and outcome statistics; a conscientious concern when complications do occur will help to reduce sterilization legal claims. A thorough knowledge of the proper management after a complication mu…

Characterization of litigation after tonsillectomy in the United States.

BACKGROUND: Tonsillectomy is a common procedure performed for both adults and children. The aims of this study were to identify reasons for litigation after tonsillectomy and to examine outcomes of tonsillectomy-related litigation in the United States. METHODS: All available court decisions associated with medic…

Simulation beyond Residency: A Call to Action for Anesthesiology Leaders and Perioperative Teams.

Simulation-based training is a proven modality for developing critical technical and nontechnical skills in anesthesiology. While simulation-based training has been linked to improved patient outcomes, team performance, and reduced malpractice risk, postresidency simulation remains underutilized. Drawing on parallels from other high-stakes professions and a faculty-focused simulation program developed by the authors, they propose a model for embedding simulation-based training into clinical practice using real-world quality data, subspecialty alignment, and interprofessional collaboration. Pediatric High-Risk Conditions.

Meningitis, appendicitis, and testicular torsion are among the most common conditions resulting in malpractice litigation in Pediatric Emergency Medicine. With meningitis, most litigation claims involved patients <2 years old. Notably, 25% of patients had no fever and many lacked classic signs of meningitis. For appendicitis, nearly 3/4 of litigated cases claimed delayed/missed diagnosis. A non-diagnostic ultrasound (eg, no appendix visualized) has a negative predictive value of only 86%. Finally, testicular torsion carries a 34-42% testicular loss rate and 10% of patients with torsion only pr…

Rapid death following undiagnosed stercoral perforation in a chronic opioid user.

A case of rapid demise following an undiagnosed stercoral perforation is reported. A 57-year-old woman on chronic opioid replacement therapy presented with constipation and abdominal pain to the hospital. Following an unremarkable abdominal radiograph and admission for laxation and pain therapy, she was found dead only 18 h later. To exclude medical malpractice, a postmortem investigation was ordered. Postmortem computed tomography and autopsy revealed fatal fecal peritonitis based on a stercoral perforation of the rectosigmoid, which had been undiagnosed. This report highlights the need for e…

[Anesthesia accidents: accidental esophageal intubation].

Accidental oesophageal intubation is a common mistake in inexperienced anaesthetists, but unrecognized oesophageal intubation is fortunately a rare event because, in anaesthetic malpractice claims, it frequently resulted in death or brain damage. The connection of these complications with the lack of experience of the anaesthetist and/or the difficult intubation is not so evident in the literature. The precocious detection of tube dislocation depends on the systematic verification of endotracheal tube position after insertion. The paper describes the clinical and instrumental tests used for de…

Defensive Medicine Attitudes and Associated Factors Among Physicians Working in Obstetrics and Gynecology Clinics in Istanbul, Türkiye: Cross-Sectional Analytical Study.

BACKGROUND: Defensive medicine (DM) is particularly relevant in obstetrics and gynecology (OB/GYN), where physicians face substantial medicolegal risks and malpractice-related pressures. Defensive practices may involve cost-increasing diagnostic or therapeutic behaviors and avoidance of high-risk patients or procedures. Identifying factors independently associated with DM may help inform organizational and medicolegal interventions. OBJECTIVE: This study aimed to evaluate DM attitudes among physicians working in OB/GYN clinics in Istanbul, Türkiye, and to identify professional, organizational…

Anatomical variations of the thymus in relation to the left brachiocephalic vein, findings of necropsia.

Two cases of anatomical variations of the thymus are presented with respect to the anatomical relations with the left brachiocephalic vein and found during the necropsy process. Less than 2 days after birth with Noonan Syndrome, when the left brachiocephalic vein was scanning behind the upper thymus horns, there were other adjacent lesions consisting of three supernumerary spleens and three hepatic veins. The second case was an 8-year-old infant with child malpractice who died from urinary sepsis due to obstructive uropathy, in which case the upper lobes of the thymus were fused and formed a r…

Fact and fancy. What can we really tell from the placenta?

Considerable interest in the clinical significance of placental abnormalities has been fueled by malpractice claims when perinatal outcome is less than optimal. The pathologist must be aware of those placental lesions that may contribute to perinatal morbidity and mortality. This article reviews the abnormalities of placentation, placental weight, maternal uteroplacental blood flow, villous histological makeup, fetoplacental blood flow, the umbilical cord, and the membranes, as well as the problems of multiple pregnancy. The important contribution of abnormal uteroplacental blood flow to adver…

Iatrogenic Nerve Injuries Affecting Upper Limb Function: Medicolegal Implications.

PURPOSE: Nerve injuries are among the commonest iatrogenic complications and most frequently are the result of direct intraoperative damage causing serious distress and long-term morbidity. Additionally, they can add a considerable financial burden to health care systems, while they constitute a well-known source of medicolegal implications. There are few published articles addressing the medicolegal consequences of the iatrogenic nerve injuries affecting upper limb function. Our aim was to identify malpractice claims related to iatrogenic nerve injuries affecting upper limb function and to de…

Central venous catheters: legal issues.

In dialysis patients, both central venous catheter (CVC) insertion and CVC use during the dialysis procedure pose important legal issues, be … mainly thrombosis and infection. These are theoretically expected as pure complications (and not as malpractice effects), but legal issues might relate to inappropriate catheter care (in both the inpatient and outpatient settings) rather than to the event per se.
