Systematic review of iatrogenic lesions during endoscopic procedures and medico-legal implications.

BACKGROUND: Endoscopic procedures, while minimally invasive and generally safe, carry inherent risks, including the potential for iatrogenic lesions that can lead to significant complications and, in some cases, medico-legal implications. This narrative review with a forensic focus aims to evaluate the incidence, types, and medico-legal considerations of iatrogenic lesions resulting from endoscopic proce-dures, with an analysis of selected case studies to underscore clinical and forensic aspects. METHODS: We assessed data from peer-reviewed publications focusing on complications associated wi

The standard of medical care under the Australian Civil Liability Acts: ten years on.

It has been more than a decade since the modified Bolam test was legislatively enacted.by the Australian States following the medical indemnity crisis. Since its implementation, the modified Bolam test has been configured by judges as a defence to the common law standard of care in medical diagnosis and treatment. The article argues against this interpretation and suggests an alternative way of implementing this statutory test. It is proposed that the modified Bolam test ought to have been applied as a single yardstick to determine the required standard of care in diagnosis and treatment. Chan

[Distinction between medical error and complication in indemnification of damage].

There are many articles present in literature dealing with the difference between the medical error and the complication in indemnification of damage caused by the medical act. It is a very challenging and sometimes even impossible task. The criteria usually used are defined by the accumulated medical knowledge and the complexity of interactions and conditions under which the medical service is provided. Contemporary medicine is reaching increasingly better results aiming to treat the rapidly ageing population. Consequently, the expectations of patients are growing, and sometimes exceeding rea

Birth-injured infants: legal definitions, claims frequency in Virginia.

This review of claims supports the findings of an earlier study on the incidence of injuries defined by the Injured Infant Act. Assignment of children to Virginia's definition of injury was associated with death in the neonatal period and preexisting maternal conditions likely to contribute to a poor outcome. Expanding the definition was more likely to capture living children needing substantial assistance in all phases of daily living. Further refinement of the definition appears advisable to assure that those receiving support meet the Act's intent.
