Comparison of Asbestos Victim Relief Available Outside of Conventional Occupational Compensation Schemes.

The asbestos victim relief schemes were introduced to resolve the issue of victims of asbestos-related diseases not receiving compensation through conventional legal orders. This article seeks to derive the differences and commonalities of various asbestos victim relief schemes available outside of the conventional occupational compensation system along with a systematic understanding and to propose plans for improvement through a comparative study. After the degree of asbestos exposure, the population, and the period of implementation were corrected, the recognized claims of the total of conv

Legal claims for malignant mesothelioma: dealing with all cases.

BACKGROUND: Apart of medical reasons, a definitive diagnosis of malignant mesothelioma may be required as a basis for a claim of financial compensation although a pathological source of conclusive evidence is missing. Clinical assessment of all available data is then the only option to come to a final conclusion. We evaluated the diagnostic work-up of a large cohort of Dutch patients who applied for financial compensation due to mesothelioma. We determined how often a pathological or clinical diagnosis can be made, and which factors are associated with making the final diagnosis malignant meso

The Energy Employees Occupational Illness Compensation Program Act: new legislation to compensate affected employees.

Nurses make a bureaucracy work on behalf of clients. Occupational health nurses who are already versed in basic concepts applicable to EEOICPA--confidence intervals, occupational histories, exposure assessment, and dose response--can play constructive, caring roles in assisting claimants in securing benefits under this landmark program. Occupational health nurses know that chronically ill employees have a finite number of hours a week to make phone calls, visit providers, and advocate on their own behalf. Thoughtful referrals to occupational health providers who are both experienced and suppor

Occupational cancer in Germany.

As in probably mostly all other European countries, the incidence of occupational cancer in Germany increased steadily after World War II. In 1994 about 1,600 cases of occupational cancer were compensated--more than ever before. More than half of these cases were lung cancer, most caused either by asbestos (n=545) or by ionizing radiation ((italic)n(/italic)=306). Other frequent target organs of asbestos were the pleura and the peritoneum with 495 cases of mesotheliomas. Asbestos was the single most important risk factor for occupational cancer, causing more than 1000 deaths per year. All othe

[Quality assurance in sociomedical decision processes exemplified by documentation of occupational anamnesis in final sociomedical expert assessment].

426 German sociomedical expertises written by sociomedical specialists appointed by various German statutory insurance bodies were examined (compulsory pension fund, medical services of statutory health insurance, medical officers of the German government-controlled labour offices and experts appointed by various rehabilitation centres). A wide gap was found between reality on the one hand--as represented by the patient's previous work and the conditions prevailing at his particular place of work and on the labour market in general--and the theoretical postulates set by the doctor on the other

Validity of psychotraumatic reactions.

To determine whether posttraumatic reactions occurred in injured individuals not confronted with litigation or compensation (as reckoned in the U.S.), a parallel study was undertaken in a social-democratic country (Austria) between ski- and work-injured groups. Although each group had a significantly different way of regarding the injury, there appeared to be a comparable incidence of posttraumatic psychiatric reaction in each. The absence of compensation (in contrast to disability maintenance) did not inhibit the appearance of the posttraumatic reaction. A discussion of the effects of compens

Psychiatric diagnoses after hospitalization with work-related burn injuries in Washington State.

This study aims to describe workers who were hospitalized with work-related burn injuries and their psychiatric sequelae in Washington State. Psychiatric sequelae of interest were depression, posttraumatic stress disorder, and other anxiety disorders. Workers' compensation claims meeting a definition for a hospitalized burn patient from Washington State from January 2001 through April 2008 were analyzed. The resulting claims were searched for the presence of certain psychiatric diagnoses or treatment codes, and descriptive analyses performed. In Washington State during the time period, the pre…

Results of Operative Intervention for Finger Stiffness After Fractures of the Hand.

Background: Posttraumatic finger stiffness can occur as a result of hand fractures. The purpose was to assess and quantify the improvement in range of motion (ROM) after surgical management of the stiff finger in patients who developed loss of motion following treatment for a metacarpal or phalangeal fracture. In addition, an aim was to identify possible risk factors for suboptimal improvement in ROM postoperatively. Methods: A retrospective review was performed on 18 patients who underwent surgery to improve finger stiffness following metacarpal or phalangeal fracture. Demographic data includ

Comparing Profiles of Mental Illness and Positive Mental Health Between Injured Workers and the General Working Population in Ontario.

BACKGROUND: Mental illness (MI) is prevalent among workers with work-related injury. However, complete mental health includes both MI and positive mental health (PMH). To better understand differences in prevalence, this study compared MI and PMH profiles among injured Ontario workers to a representative sample of the general Ontario working population. METHODS: We studied 1132 Ontario workers with a physical work-related injury from the Ontario Life After Work Injury Study (OLAWIS) and 1652 general workers in compensation-covered industries from the 2012 Mental Health Canadian Community Heal

Toward an Asbestos Ban in the United States.

Many developed countries have banned the use of asbestos, but not the United States. There have, however, been multiple efforts in the US to establish strict exposure standards, to limit asbestos use, and to seek compensation through the courts for asbestos-injured workers' In consequence of these efforts, asbestos use has declined dramatically, despite the absence of a legally mandated ban. This manuscript presents a historical review of these efforts.

[Management of carpal tunnel syndrome--"bread and butter" in the United States].

In the United States, carpal tunnel syndrome (CTS) is one of the most common diseases and is well recognized by the general population. The number and amount of workers' compensation claims in the U.S. are enormous and the news has been received high degree of attention. Similar to Japan, the initial treatment is non-surgical, but the failure to non-surgical treatment usually leads to surgical intervention without delay.
