Malpractice Litigation and Testicular Torsion: A Legal Database Review.

BACKGROUND: The litigious nature of the American medical environment is a major concern for physicians, with an estimated annual cost of $10 billion. OBJECTIVE: The purpose of this study is to identify causes of litigation in cases of testicular torsion and what factors contribute to verdicts or settlements resulting in indemnity payments. METHODS: Publicly available jury verdict reports were retrieved from the Westlaw legal database (Thomson Reuters, New York, NY). In order to identify pertinent cases, we used the search terms "medical malpractice" and "testicular torsion" with date ranging

Social and ethical issues in environmental remediation projects.

The contamination of environments with radionuclides can give rise to consequences that encompass far more than health risks from exposure to radiation. As experience from Chernobyl demonstrated, both the accident and remediation measures can have serious social and economic consequences. This paper presents a review of some of these issues, including their ethical relevance, and presents a check-list of socio-ethical aspects of remediation measures. The paper concludes with an overview of social remediation measures, encompassing actions that are directed towards benefits other than dose redu

An analysis of successful litigation claims in childhood fatalities in England.

UNLABELLED: This study aimed to analyse the number, nature and costs of successful litigation claims against the National Health Service in England involving fatalities in children. A record of claims involving fatalities in children from 1 April 2004 to 31 March 2011 was obtained from the National Health Service Litigation Authority. The closed cases where compensation had been paid to the claimant were analysed. One hundred thirty out of a total of 234 closed cases (56 %) resulted in payment of compensation. The commonest causes of a fatality were delayed/failed diagnosis (58), delayed/faile

A Comprehensive Analysis of Malpractice Claims Following Management of Hip Fractures.

Hip fractures are highly prevalent and associated with significant morbidity and mortality. This study aims to provide a comprehensive analysis of malpractice claims related to hip fractures. The Westlaw legal database was queried for all malpractice cases involving hip fractures from 1978 to 2020. Demographic data, monetary payouts, reasons for litigation, and case outcomes were analyzed. In total, 80 cases were included with a mean plaintiff age of 58 years and 60% female. Fifty-five cases (69%) resulted in a defendant verdict, while 25 cases (31%) resulted in a plaintiff verdict/settlement.

Loss of chance: the uncertainty of the event or the uncertainty of the conduct? Case Series and Medicolegal Considerations.

BACKGROUND: The concept of damages for loss of chance originated in France in 1877 and was adapted to healthcare in 1962. In Italy, it was first introduced in healthcare liability in 2004, with Civil Court of Cassation decision No. 4400. Italian jurisprudence recognizes the loss of chance as an independent, legally and economically assessable damage, distinct from the actual outcome lost. The landmark St. Martin Judgments of 2019 further established that such damages can be claimed if they involve appreciable, serious, and consistent values. This requires proving a causal link between the cond

Medico-legal considerations in a case of splenic injury that occurred during colonoscopy.

Colonoscopy has became the gold standard diagnostic and therapeutic treatment for rectum and colon diseases. The splenic injury is a rare complication of colonoscopy and relatively few cases (less than 70) have been reported in the literature so far. Here we present a case of splenic rupture identified in an 80 year-old man few hours after an apparently uneventful colonoscopy. Acknowledging a causal relationship between the lesion and the diagnostic procedures, we discuss the possible medico-legal implications with regard to professional liability considering the exceptional nature of such an

A French hospital sentenced for unreasonable obstinacy.

On 2 June 2009, the Nimes administrative court condemned the Hospital of Orange (France) for unreasonable obstinacy after neonatal resuscitation. On 14 December 2002, an apparently stillborn child was resuscitated after approximately 30 minutes of foetal distress. Cardiac activity was recovered, but the child has since suffered from severe disabilities. The court did not find any fault committed by the hospital regarding maternal care. However, the hospital was sentenced to compensate for the injuries caused by unreasonable obstinacy. According to the court, the medical team should have taken

Living donor kidney transplantation: medical, legal, and ethical considerations.

The use of living donor kidneys has dramatically increased the number and success of kidney transplants across the world. But questions remain regarding the subjection of a healthy individual to surgery for the benefit of another. Donors do have medical and financial risks. The stigma of organ brokering remains today, with evidence of commercial transplantation in other countries. Here in the US, we are exposed to advertising for donors using the media. In the hope of increasing living donations, we run the risk of stretching altruism too far. In this manuscript, we highlight and discuss some

Mold hysteria: origin of the hoax.

The topic of building related illness came into the public's eye as a major health issue in the mid 1970s, when several cases of pneumonia were found to be associated with an infectious agent in Philadelphia. This agent was subsequently found to be a gram-positive bacterium known as Legionella pneumoniae. During the ensuing 30 years, a myriad of symptom constellations, disorders, clinical syndromes and illnesses have been attributed to indoor living or working environments. Over time, there appeared to be no limit to claims of building related illness, and it was "reported" that almost any kin

Secondary gait compensations in individuals without neuromuscular involvement following a unilateral imposed equinus constraint.

Ankle equinus is the most commonly identified impairment of individuals with spastic hemiplegia (SH). However, it is not clear how equinus at the ankle may contribute to gait deviations at other joints. The purpose of this study was to determine what compensatory gait deviations may occur as a result of an imposed, unilateral equinus constraint. Gait data were collected on 12 adult subjects with and without one ankle constrained in equinus using a unique taping method. Knee extension at initial contact, knee extension in mid stance, and hip extension at terminal stance were all found to be sig
