Classification of a continuous risk score into risk levels is common. However, while the absolute risk score is essential, it is arguably unethical to label anyone at 'high, moderate or low risk' of a serious event, simply because management based on a single criterion (e.g. avoiding the target condition) has been determined to be effective or cost-effective at a population level. Legally, mono-criterial risk labeling can inhibit the obtaining of a fully-informed, preference-based consent, since multiple considerations (various benefits and harms) matter to most individuals, not only the singl

BACKGROUND: In an effort to intervene earlier in Alzheimer's disease (AD), clinical trials are testing promising candidate therapies in preclinical disease. Preclinical AD trial participants are cognitively normal, functionally independent, and autonomous decision-makers. Yet, like AD dementia trials, preclinical trials require dual enrollment of a participant and a knowledgeable informant, or study partner.
MAIN TEXT: The requirement of dyadic enrollment is a barrier to recruitment and may present unique ethical challenges. Despite these limitations, the requirement should continue. Study pa

Skin damage secondary to peristomal leakage is a fairly common complication of ileostomies in infants. Traditional conservative measures, including skin barriers, ointments, and agents to reduce bowel movements, initially may be helpful but not in all patients. The purpose of this case series was to describe a new and relatively simple procedure to temporarily manage severe peristomal dermatitis caused by ileal peristomal leakage in infants. After obtaining informed consent from the parents, a mushroom-type (de Pezzer) catheter was inserted into the ileostomy of 11 1- to 4-month-old infants (s…

At the 2010 Conference on Living Kidney Donor follow-up, a workgroup was convened to comment on the state of the evidence in 4 broad areas: (a) health-related quality of life postdonation; (b) donors' financial and economic concerns; (c) outcomes issues specific to newer areas of donation, namely, kidney exchange and anonymous (directed and nondirected) donation; and (d) the role of informed consent in relation to postdonation psychosocial outcomes. The workgroup sought to offer recommendations regarding research priorities for the next decade and data collection strategies to accomplish the n…

Legal problems occur in sports medicine as well as in other fields. To whom do sports doctors owe their duty - to the club, to the team or to its members? Doping has become a part of competitive sport. What is the doctor's responsibility in relation to this? Medical "treatments" given sometimes on demand, in order to enable athletes to continue the game or competition despite the high risk of future severe irreparable damage, may constitute gross negligence. Consent given by athletes in such circumstances may be considered invalid. The club is obliged to insure its members against personal inj

A survey of Washington state pediatricians and allied health professionals showed that two thirds provide written information to parents on diphtheria-tetanus-pertussis; measles-mumps-rubella; and oral polio vaccines. Twenty-two percent of pediatricians provide written information on inactivated polio vaccine. Sixty-two percent of pediatricians who give immunizations require a parent's signature as evidence of having provided information or obtained consent.

AIM: To investigate whether the guidelines set out by the UK Department of Health on informed consent are being followed nationally in orthopaedic surgery.
METHODS: A postal questionnaire of UK orthopaedic consultants was undertaken asking about consenting procedures for an elective and a trauma situation.

Decision-making capacity in health care refers to a person's ability to understand information relevant to a decision, appreciate how the decision affects them, make a choice, and communicate that choice. Capacity is essential in ethics and professional nursing practice because it forms the basis of informed consent. Nurses encounter various medical conditions, such as dementia, that can contribute to changes in cognitive abilities and result in diminished capacity. However, having a cognitive condition such as dementia does not necessarily mean a person lacks the capacity to make a specific d…

BACKGROUND: Living wills/advance directives (AD) are an important tool for specifying patient wishes regarding medical care in the case of future inability to consent. Since 2009, German legislation defines framework conditions for the creation and validity of such directives in § 1901a BGB.
METHODS: An extensive literature search in an international and a German-language database was conducted to identify, analyze, and evaluate scientific articles on opportunities, risks, and problems in the creation and implementation of living wills.
RESULTS: Between 10 and 40% of patients have an AD. Amo

Informed consent is mandatory for an individual to receive a clinical service, yet the process is often still tough and twisty. This is a hot topic also for patient associations and thus PaLiNUro associaton set the objective to produce, with a multidisciplinary approach, a simple but comprehensive information note to the informed consent for people with urothelial cancer about to undergo to a radical cystectomy surgery. After assessing as not valid 12 information notes from nine Italian hospitals, the multidisciplinary group produced an eight-page document accompanied by a supplemental documen…
