Top five legal pitfalls in retinopathy of prematurity.

PURPOSE OF REVIEW: This review highlights the common areas of medicolegal risk during retinopathy of prematurity (ROP) screening. RECENT FINDINGS: Most malpractice risk in ROP comes from systemic errors that ultimately result in failure to screen the patient in a timely fashion, resulting in failures to intervene and/or refer in a timely fashion. Currently, the emphasis is engaging the family members, the hospital staff, and clinic staff to pro-actively manage ROP patients and ensure that they are screened in a timely fashion. Coordinating care between multiple caregivers can minimize risk. R

Medication associated with hearing loss: 25 years of medical malpractice cases in the United States.

OBJECTIVES: Many medications have the potential for ototoxicity. To potentiate management of this risk, this study examines malpractice litigation trends of lawsuits involving hearing loss associated with medication use. As experts in hearing loss, it may benefit otolaryngologists to be familiar with this information. STUDY DESIGN: Retrospective review. SETTING: All US civil trials. SUBJECTS AND METHODS: Court records of legal trials from 1987 to 2012 were obtained from 2 major computerized databases. Data were compiled on the demographics of the defendant and plaintiff, use of otolaryngolo

Genetic testing in the workplace: the employer's coin toss.

A toss of the coin by the modern-day employer reveals two options regarding genetic testing in the workplace. The employer may choose to take advantage of increasingly precise, available, and affordable genetic testing in order to ascertain the genetic characteristics--and deficiencies--of its employees. This outcome exposes the employer to a vast array of potential litigation and liability relating to the Americans with Disabilities Act, the Fourth Amendment, Title VII of the Civil Rights Act, and state legislation designed to protect genetic privacy. Alternatively, the employer may neglect t

Peer deviance, parental divorce, and genetic risk in the prediction of drug abuse in a nationwide Swedish sample: evidence of environment-environment and gene-environment interaction.

IMPORTANCE: Peer deviance (PD) strongly predicts externalizing psychopathologic conditions but has not been previously assessable in population cohorts. We sought to develop such an index of PD and to clarify its effects on risk of drug abuse (DA). OBJECTIVES: To examine how strongly PD increases the risk of DA and whether this community-level liability indicator interacts with key DA risk factors at the individual and family levels. DESIGN, SETTING, AND PARTICIPANTS: Studies of future DA registration in 1,401,698 Swedish probands born from January 1, 1970, through December 31, 1985, and the

Slow Harm After Dobbs v. Jackson Women's Health Organization: An Analytic Scoping Review of How Data and Surveillance Infrastructures Reshape Emergency Obstetric Care.

Following Dobbs v. Jackson Women's Health Organization on June 24, 2022, abortion criminalization in the United States has converged with interoperable health data systems, making reproductive health documentation more portable and legally legible across jurisdictions. This analytic scoping review, guided by Systematic Reviews and Meta-Analyses Extension for Scoping Reviews (PRISMA-ScR), examined U.S. literature published from June 2022 through October 2025 in PubMed, OpenAlex, Google Scholar, and HeinOnline. Sources were organized by evidentiary role into Tier C (legal and analytic conditions

Life, death, and liability: duties of health care providers regarding withdrawal of treatment.

Many of the issues surrounding refusal and withdrawal of medical treatment are so new and complex that the U.S. society has not resolved the ethical or legal questions involved. Questions such as where life ends and death begins, how to determine the circumstances when withdrawal of treatment is appropriate, and who should make such decisions will have to be resolved before the law in this area can become settled. Naturally, society is a long way from resolving these issues, since they involve such fundamental social, moral, medical, and legal considerations. Nevertheless, a body of law has de

Outcomes of bellwether cases related to inferior vena cava filters in multidistrict litigations.

OBJECTIVE: In the present study, we identified and reviewed the outcomes of bellwether cases related to inferior vena cava (IVC) filter multidistrict litigations (MDLs). METHODS: The legal research database, LexisNexis (New York, NY), was used to identify all cases related to IVC filters. Cases unrelated to the MDLs were excluded. Court documents recording the proceedings for bellwether cases sent to jury trials were retrieved from the LexisNexis subsidiary, Law360. Data on plaintiffs, filter models, reported complications, filed claims, decision-making body, verdicts, and rewards were review

Talc Pleurodesis: A Medical, Medicolegal, and Socioeconomic Review.

BACKGROUND: Talcum has been used in pleurodesis for more than 8 decades. Despite a wealth of research, controversy remains over the optimal sclerosant for pneumothorax and pleural effusions. Talc's historical primacy has been challenged because of its potential for pulmonary toxicity, possible carcinogenicity, and recent concerns surrounding availability and legal liability, thus making this an ideal time for a review. METHODS: This systematic review of the talc literature, focused on publications after the year 2000, evaluated mechanism of action, efficacy, side effect profile, and alternati

[Migration of an axillary plexus catheter fragment : A severed catheter tip unnoticed on removal wandered into the central nervous system].

MIGRATION OF AN AXILLARY PLEXUS CATHETER FRAGMENT INTO THE INTRACEREBRAL COMPARTMENT: During removal of an axillary plexus catheter used for pain therapy, the catheter was probably inadvertently and unnoticed severed together with the suture fixation. The error went unnoticed and an approximately 14 cm long catheter fragment remained in the patient. The patient complained of neck pain, nausea and vomiting 2.5 years later. A computed tomography scan of the cranium and neck region revealed a tubular foreign body with a diameter of ca. 1 mm and a length of ca. 14 cm. The foreign body was identifi

Image-guidance in endoscopic sinus surgery: is it associated with decreased medicolegal liability?

BACKGROUND: The use of image-guidance (IG) in endoscopic sinus surgery (ESS) has escalated over the last decade despite a lack of consensus that its use improves outcomes or decreases complications. One theoretical reason for using IG in ESS is its potential to minimize legal liability should an adverse outcome occur. In this study, we aimed to characterize the role of IG in ESS litigation, and further detail other factors in pertinent cases. A secondary objective was to characterize recent malpractice litigation for other relevant factors. METHODS: Relevant cases from Westlaw were examined t

Employers' concerns regarding research participation.

Occupational health research depends on the cooperation and participation of employers. The authors describe employers' reasons for non-participation in a prospective study examining risk factors for carpal tunnel syndrome (CTS) and the usefulness of preplacement, post-offer nerve conduction screening. Companies were contacted to solicit participation. Non-participation explanations were reviewed. Of 73 eligible employers, 58 declined participation (participation rate: 20.5%). Reasons for non-participation included lack of interest (32.8%), liability concerns (awareness of CTS may increase wor

Medical malpractice and the thyroid gland.

BACKGROUND: A medical malpractice litigation "crisis" exists in this country. Analyzing litigation trends through verdict summaries may help understand causes. METHODS: Jury verdict reviews from 1987-2000 were obtained from a computerized database. Reviews compile data on defendants, plaintiffs, allegations of wrongdoing, and verdict summaries. RESULTS: Thirty suits from nine states occurred. Plaintiffs were women in 80% of the cases, with a median age of 41. Fifty percent of patients (15 of 30) had a bad outcome, (9 of 30 dead, 4 of 30 with neurologic deficits, 1 blind, and 1 alive with can

Use of intravenous heparin by North American neurologists: do the data matter?

BACKGROUND AND PURPOSE: Our aim was to determine current usage patterns of intravenous heparin for patients with acute ischemic stroke. METHODS: A survey was undertaken of 280 neurologists from the United States and 270 neurologists from Canada. Brief vignettes were presented for the following 5 scenarios: stroke in evolution, atrial fibrillation-related stroke (A FIB), vertebrobasilar stroke, carotid territory stroke, and multiple transient ischemic attacks. The effect of medicolegal factors was also ascertained. Statistical comparisons were done with chi-squared testing. RESULTS: US neurol
