[Verification of indications and validity of consent to surgical treatment by transsexuals].

The authors analyze some medico-legal aspects concerning the surgical therapy of transsexualism, as it is regulated by the Law N. 442/1982. At first they examine the problems related to the verification of the indications for the surgical treatment, with particular reference to nosography, differential diagnosis and clinical criterions suitable to evaluate the usefulness of this intervention. Afterward they analyze the problem of the validity of the consent, considering the particular kind of treatment and the psychological connotations of these patients.

An expedient and ethical alternative to xenotransplantation.

The current voluntary posthumous organ donation policy fails to provide sufficient organs to meet the demand. In these circumstances xenografts have been regarded as an expedient solution. The public perception seems to be that the only impediments to this technology are technical and biological. There are, however, important ethical issues raised by xenotransplantation that need to be considered as a matter of urgency. When the ethical issues raised by using non-human animals to provide replacement organs for human beings are considered in a wider context and the possible alternatives to xeno

Mandatory PKU screening: the other side of the looking glass.

The challenge that PKU screening programs face is to be effective without sacrificing individual liberty. Most states have assumed that this is impossible, and have enacted mandatory PKU screening tests. It now appears that in fact voluntary screening for PKU can be effective. Accordingly, it seems appropriate to reexamine existing mandatory screening statutes to determine if we can replace government coercion with voluntary informed consent. Focus should be placed on the proper role of the government in screening, and on improving the consent process, and not on those few couples who withhold…

Documentation of consent for blood transfusion.

In 2012, 110 hospitals reported on consent policy against national guidelines, with 105 (95%) including a statement on blood transfusion. Of the 103 hospitals (1788 transfusion episodes) that participated in the consent practice component, 89 specified the method of consent used; 46 (52%) had a specific transfusion consent form and achieved compliance of 90% compared to 43-69% for most other methods. The consent audit shows that a specific blood consent form achieved a high rate of medical record documentation compliance.

[Circumcision--criticism of the routine].

Circumcision is one of the most frequent operative procedures done in males. About 120 circumcisions are performed every 5 minutes over the world [14]. Three different reasons lead to circumcision: 1) Medical reasons in present of a pathologic phimosis. 2) Circumcisions done due to religious, social or cultural rea-reasons. 3) Finally in many countries circumcision is performed as "routine-circumcision" in the newborn period. While in the United States the number of routine-circumcisions decreases (about 60% of all male newborns) South-Korea has a rate near to 100%. Even with no religious or c

Ethical and Linguistic Quality of Participant Information Sheets and Their Association with Recruitment Outcomes : An Empirical Bioethics Study of Clinical Trials.

Informed consent protects autonomy in clinical research, and it is often assumed that clearer Participant Information Sheets and Informed Consent Forms may also improve recruitment. This study examined whether the ethical and linguistic qualities of these documents are associated with accrual-related outcomes in industry-sponsored interventional trials. We conducted a retrospective analysis of ClinicalTrials.gov records with readable consent materials, operationalizing ethical clarity, linguistic comprehensibility, and cognitive burden using large language model-based extraction and quantitati…

A randomized trial comparing concise and standard consent forms in the START trial.

BACKGROUND: Improving the effectiveness and efficiency of research informed consent is a high priority. Some express concern about longer, more complex, written consent forms creating barriers to participant understanding. A recent meta-analysis concluded that randomized comparisons were needed. METHODS: We conducted a cluster-randomized non-inferiority comparison of a standard versus concise consent form within a multinational trial studying the timing of starting antiretroviral therapy in HIV+ adults (START). Interested sites were randomized to standard or concise consent forms for all indi…

Effects of an Audiovisual Intervention to Improve Competence to Consent to Research Participation Among Young Gay and Bisexual Men Who Use Stimulants.

PURPOSE: Standard consent practices in HIV research often do not facilitate truly competent informed consent. We examined a brief audiovisual intervention to enhance competence to consent to participate in a hypothetical trial aimed at promoting sexual health and reducing stimulant use among young gay and bisexual men who use stimulants. METHODS: Between June 2024 and January 2025, we enrolled 115 young gay and bisexual men aged 16-24 years who were at risk for HIV transmission or acquisition and reported recent stimulant use. Participants were randomized to standard consent (i.e., written in…

Surgical consent practice in the UK following the Montgomery ruling: A national cross-sectional questionnaire study.

BACKGROUND: The Supreme Court case of Montgomery vs Lanarkshire Health Board in 2015 was a landmark case for consent practice in the UK which shifted focus from a traditional paternalistic model of consent towards a more patient-centered approach. Widely recognised as the most significant legal judgment on informed consent in the last 30 years, the case was predicted to have a major impact on the everyday practice of surgeons working in the UK National Health Service (NHS). Two years after the legal definition of informed consent was redefined, we carried out an audit of surgical consent pract…

Medicolegal Challenges of Advising At-Risk Patients.

In brief The case of a talented baseball pitcher who has Marfan's syndrome sets the stage for an examination of the medicolegal issues posed by athletes at risk for sudden death. The medical literature is somewhat unclear whether sports participation is unsafe for all individuals with Marfan's syndrome. Legal precedent has established guidelines on the "right to participate" and on informed consent. For medical and legal reasons, physicians need to establish appropriate risk management and informed consent procedures.

As CPTSD moves toward broader formal diagnostic recognition, clinical recommendations should reflect corresponding diagnostic specificit …

Prophylaxis of heterotopic ossification in patients sedated after polytrauma : medical and ethical considerations.

BACKGROUND AND PURPOSE: Heterotopic ossification (HO) often follows acetabular fractures after multitrauma. Irradiation is a mean for prophylaxis. We established a standard procedure in our hospital for patients under sedation, when obtaining informed consent for HO prophylaxis is impossible. PATIENTS AND METHODS: We reviewed current scientific evidence, calculated the risks of radiation and presented the ethical and legal framework. The subject was scrutinised by an interdisciplinary panel. RESULTS: Irradiation is the most effective means for prophylaxis and has few adverse effects in adult…

Immersive Virtual Reality for Enabling Patient Experience and Enrollment in Oncology Clinical Trials: A Feasibility Study.

Background/Objectives: Informed consent is a crucial part of the clinical trial enrollment process in which patients are asked to understand and provide approval for medical interventions. Consent forms can be complex and hinder patient comprehension, highlighting the need for novel tools to improve the patient enrollment experience. This feasibility study aimed to develop an immersive technology to enroll human subjects in oncology clinical trials and provide 3D avatar-based informed consent in a virtual reality (VR) environment. Methods: Clinical feasibility and the effects of head-mounted V…

Supporting Informed Surrogate Decision-Making in Deceased Donor Intervention Research: Co-Creating Educational Materials With Families.

Deceased donor intervention research aims to improve organ donation and transplantation outcomes, but its feasibility often depends on obtaining valid informed consent from surrogate decision makers during a difficult time for families in the ICU. Consent discussions may be complicated by grief, decisional burden, and the complexity of donor interventions, creating risks to comprehension, trust, and voluntariness. In this letter, we describe a collaborative model for co-creating consent and educational materials with deceased donors' family members developed for a donor intervention trial in C…
