The most common patient safety issues resulting in legal action against neonatologists.

Common patient safety issues may result in injuries to babies in the newborn period. A medical malpractice lawsuit is one way in which an injured patient can obtain compensation for the injuries they sustained as the result of an error. There are a number of common areas of malpractice risk for neonatologists including the delivery room, jaundice, hypoglycemia, and late preterm infants. A better understanding of the medical malpractice system and common patient safety issues in neonatology can lead to protective strategies to reduce risk for untoward events and subsequent litigation. Strategie

Predictors of radiologists' perceived risk of malpractice lawsuits in breast imaging.

OBJECTIVE: The shortage of radiologists in breast imaging may be related to heightened malpractice lawsuit concerns. Our objective was to examine radiologists' reported experiences and perceptions of future lawsuit risk and explore personal and professional factors that may be associated with elevated perceptions of risk. MATERIALS AND METHODS: Radiologists who routinely interpret mammography examinations in diverse regions of the United States (Washington, Colorado, and New Hampshire) completed a mailed survey in 2002 and 2006, including questions on demographics, practice characteristics, a

[Criminal responsibility in schizophrenia with special attention to the mental state during the criminal act--a study based upon the activation-recurrence phenomenon].

In this article, psychiatric arguments regarding criminal responsibility in schizophrenia are reviewed, and it is pointed out that the arguments have been influenced by the theory of process psychosis. Moreover, two cases judged on the basis of the activation-recurrence phenomenon are exemplified, and fundamental issues are discussed. Investigating the mental state just before the crime helps when deliberating over criminal responsibility. A study of the activation-recurrence phenomenon, conducted by Shinkai and Miyasaka, contributes toward clarifying the recurrence of the micropsychotic state

[Selective indications of skull radiography after head injury in children].

PURPOSE OF THE STUDY: Skull X-rays are systematically performed on children after head injuries in most hospitals. However, the discovery of a skull fracture as an isolated finding rarely warrants intervention. In february 1994, we stopped performing systematical skull X-rays in children after head injuries. We report the results of this experience. MATERIALS AND METHODS: Since February 1994, only children with possible skull penetration, depressed fracture, or presenting signs of basilar fracture had X-ray examination. Facial injuries were excluded in this study. In case of focal neurologic

Collaborative patient care protocols: a development process.

Computerization of these protocols is in progress. This project is funded for one year with projected completion in January 1994. This study will form a framework in which further research can be completed. Utilizing protocols will allow the measurement of nursing decision making by testing relationships between parameters and interventions and by identifying rules for decision making. For example, questions that may be answered include which physiologic parameters do clinicians treat and in what order or priority, as well as what is the impact on patient outcomes in regard to cost of care and

The AANA Foundation Closed Malpractice Claims Study on nerve injuries during anesthesia care.

Anesthesia-associated nerve injury is a common cause of patient morbidity and litigation. To identify factors associated with perioperative nerve injuries and rationalize preventive strategies, 44 cases from the American Association of Nurse Anesthetists (AANA) Foundation Closed Malpractice Claims Database pertaining to nerve injuries in which nurse anesthetists provided care were analyzed. Emerging patterns and themes related to the development of injury were identified. The database is a collection of medical liability claims filed against CRNAs insured by the St Paul Fire and Marine Insuran

Medicolegal Considerations Involving Iatrogenic Lingual Nerve Damage.

The aim of this review is to improve risk management strategies through analysis of the anatomic, semeiotic, and medicolegal aspects that characterize iatrogenic lingual nerve damage (LND) and its legal consequences in the case of legal proceedings for a claim for compensation. In dental practice, LND can be caused by local or general anesthesia or by mechanical, chemical, or thermal mechanisms. A certain postoperative identification of LND etiopathogenesis is often very challenging because it can be difficult to show at what time the damage occurred and which mechanism actually caused it. Cli

Advancing HIV research with pregnant women: navigating challenges and opportunities.

OBJECTIVE: Concerns about including pregnant women in research have led to a dearth of evidence to guide safe and effective treatment and prevention of HIV in pregnancy. To better understand why these evidence gaps persist and inform guidance for responsible inclusion of pregnant women in the HIV research agenda, we aimed to learn what HIV experts perceive as barriers and constraints to conducting this research. METHODS: We conducted a series of group and one-on-one consultations with 62 HIV investigators and clinicians to elicit their views and experiences conducting HIV research involving p

[Recycling and reuse of disposable products in radiology].

Legitimacy and appropriateness of recycling and reuse of single-use disposable medical devices is a common issue in many areas of medicine. Advocates of reprocessing claim economic savings and environmental benefits. From the manufacturers' point of view, the single use is a characteristic property of their products. Moreover, they warn that using of recycled instruments makes the procedure more difficult and increases the rate of adverse events. As comparative tests demonstrate, reused products are sometimes inferior to the genuine ones with respect to mechanical properties, but these differe

Civil medical liability in cardiology: a systematic review.

Civil medical liability in cardiology is an important but fragmented field. The specialty's emergent nature, high-risk conditions, complex diagnostic processes, and invasive procedures increase the likelihood of claims following adverse or preventable events. However, comprehensive data on the causes of claims and their financial impact are limited. This review synthesizes evidence on the primary causes of claims against cardiologists and the associated compensation amounts. The review was conducted in accordance with the PRISMA 2020 guidelines. A systematic search of PubMed and Scopus was per

Locomotor stimulant and drug discrimination effects of five synthetic cathinones in rodents.

Synthetic cathinones are synthesized as legal alternatives to methamphetamine, cocaine and MDMA, and can produce serious health risks. The DEA identified five synthetic cathinones of interest: N-ethylpentedrone, N-ethylheptedrone, N-butylhexedrone, 4-methylpentedrone, and 4-methyl-α-ethylaminopentiophenone (4-MEAP). These compounds were tested to determine their locomotor stimulant and psychostimulant-like discriminative stimulus effects. Locomotor activity was tested in male Swiss-Webster mice to identify behaviorally active dose ranges and time courses. Discriminative stimulus effects of the

Fatal ileal perforation following umbilical granuloma excision: A medico-legal case analysis.

Umbilical granuloma (UG) is a benign and common umbilical anomaly in neonates and infants, typically managed conservatively with salt application or silver nitrate. While rarely requiring surgical intervention, complications arising from invasive treatments are significantly underreported. We present a rare, but fatal case, of bowel perforation following electrocautery excision of a UG in an 11-month-old male infant. The child had a persistent pinkish umbilical lesion unresponsive to conservative treatment. Ultrasonography ruled out underlying vitellointestinal anomalies, and surgical excision

Constitutional Challenges to Liver Transplant Policy.

BACKGROUND: Liver transplant candidacy determination can be contentious. When transplantation is declined for reasons perceived as violating fundamental rights or discriminating against a protected class-for example, age, race, religion, nationality-the case may involve a constitutional claim. Judicial review of such cases may result in decisions with sweeping implications for transplant policy. METHODS: We reviewed all published court opinions involving liver transplantation in 2 legal databases (Lexis Nexus and WestLaw). We included all cases that involved a denial of liver transplant candi

A tough pill to swallow: Medicolegal liability and dysphagia.

LEVEL OF EVIDENCE: Level 4 (Case Series). OBJECTIVE: Dysphagia is a debilitating condition that is associated with many etiologies. It can have a devastating effect on a patient's quality of life with long-term sequelae that make it a source of medical malpractice litigation. This study analyzed medical malpractice cases involving dysphagia and looked for factors determining legal liability. METHODS: The Westlaw Next legal database (Thomson Reuters, New York, NY) was searched for relevant malpractice cases and assessed for several factors including if the dysphagia was iatrogenic, the amount
