Monetary lessons from litigation involving laparoscopic cholecystectomy.

Limited information exists on the relationship between adverse events associated with laparoscopic cholecystectomy (LC) and subsequent litig … fferences between a settlement and a plaintiff's verdict, when a surgeon is the sole defendant in a malpractice case concerning LC, the surgeon should encourage their carriers not to settle before trial; as only a trial will exonerate the surgeon. Erb's palsy after delivery by Cesarean section. (A medico-legal key to a vexing problem.).

Despite impressive progress in perinatology, fetal injuries from arrest of the shoulders at birth have not decreased in recent decades. Based upon sporadic reports of Erb's palsy in neonates born by Cesarean section, some obstetricians embraced the theory recently that brachial plexus lesions often derive from spontaneous forces acting in utero. Having reviewed three hundred malpractice claims involving fetal injuries attributed to shoulder dystocia at birth, the authors found only two cases connected with abdominal deliveries. One followed manual replacement of the already delivered fetal hea…

Professional liability and potential liability.

Operations on the nervous system continue to result in claims that rank among the most costly. A retrospective review of 300 cases of alleged or potential liability referred for opinion over an 11-year period is reported to catalog areas of vulnerability for the neurosurgeon and to alert younger practitioners in particular. Spinal surgery produced the largest single group of neurosurgical malpractice cases, 136 of the 300; among these, 71 came from operations on the lumbar spine. Cerebral and spinal trauma accounted for 54 cases, the next largest group. Subgroups were studied in detail and pro…

Towards improved understandings of medical manslaughter: fatal medical error, accountability, and wider paths to learning.

Criminal liability for fatal errors made by healthcare professionals, medical manslaughter (MM), has prompted much academic and professional debate. There is concern that doctors are increasingly vulnerable to this offence when they make inadvertent clinical errors in complex healthcare systems where mistakes are common and often arise from systemic causes. Yet, these discussions have been dominated by a few appellate court cases and focused on doctors, not victims. This highlights a key data gap and suggests that there may be patterns in MM cases not fully understood. This article analyses 19

Establishing new boundaries for medical liability: The role of AI as a decision-maker.

The introduction of artificial intelligence (AI) in healthcare has created novel challenges for the field of medical malpractice. As healthcare professionals increasingly rely on AI in their decision-making processes, traditional medicolegal assessments may struggle to adapt. It is essential to examine AI's role in clinical care - both its current applications and future advancements - to clarify accountability for diagnostic and therapeutic errors. Clinical decision support systems (CDSSs), in particular, unlike other traditional medical technologies, work as co-decision makers alongside phys…
