The ethics of electro-shock therapy.

Last September the Italian National Commission on Bioethics issued an opinion on the use of electro-shock (or electroconvulsive) therapy. It has now been made available in English translation and is reprinted here. The commission had been asked for an opinion by the leader of the Green Party group on Rome City Council. The request specifically asked whether it was now advisable to suspend the practice of this particular therapy. In producing its opinion, the commission's members seem to have consulted widely within Italy but not much outside.

[Vaccination--duty and voluntary consent].

High mass inoculation rates--e.g. against measles, mumps and rubella or German measles--are mandatory in highly industrialised countries to keep circulation of wild strains of viruses as low as possible. In the GDR this was achieved, inter alia, by compulsory vaccination. Although compulsory vaccination is possible in the FRG as well, in accordance with the Federal Epidemics law, it needs a special ordinance requiring to be approved by the Federal Council. This, in turn, will be forthcoming only if there is an incidence of infectious diseases occurring in a malignant form of if it is to be exp

The procurement of kidneys for transplantation in Scandinavia.

In countries with active renal transplant programs and wide acceptance criteria for transplant patients, the number of cadaveric donors is not, and probably never will be, sufficient to meet the demand for renal allografts. In general between 15 and 20 cadaveric donors PMP per year (maximum 23.7 in Denmark in 1986) have been available in the Scandinavian countries in the 1980s. In most other countries fewer donors are available, but there are regions where higher figures have been reached. Continuous registrations of potential cadaveric donors in Sweden have shown that the number of donors cou

National Kidney Foundation report on dialyzer reuse.

Numerous organizations have presented their views previously on the reprocessing of hemodialyzers. These were well summarized by Easterling (Easterling, RE: Regulations and Standards, in Deane, Wineman, Bemis [eds]: Guide to Reprocessing of Hemodialyzers. Martinus Nijhoff, 1986, pp 183-197). The publication of the Recommended Practice by the Association for the Advancement of Medical Instrumentation (AAMI) on the reprocessing of dialyzers, coupled with the announcement of the Federal Government to accept these as the basis for Regulations administered by HCFA (now published as "Standards for t

[The dignity of the patient: a legal problem?].

Rules of medical ethic bid since the times of antiquity to respect the patients dignity. Today to respect the dignity of any man is a general legal rule. In the same way other rules of the traditional medical ethic became legal norms as for instance the command forbidding to do harm to someone. The law intends to limit the possibilities to exercise power. Therefore it does not compete to the doctor alone to decide that a medical treatment has to be applied. The legal base of a medical treatment lies in the consent of the patient who has been duly cleared up on his state, the necessary treatmen

Parent views on a two-step consent process used in emergency neonatal research in the delivery room in Eastern Uganda.

BACKGROUND: Obtaining ethically valid consent for delivery room research from parents facing the imminent birth of a sick or preterm infant is particularly challenging. While deferred consent has been used successfully in some delivery room studies - especially in low-risk observational research - its application is more complex in settings with high neonatal mortality and in the context of interventional trials. In such contexts, alternative approaches such as two-step consent - where initial verbal consent is obtained at enrolment, followed by full written informed consent after maternal and…

What rhinologists and allergists should know about the medico-legal implications of corticosteroid use: a review of the literature.

BACKGROUND: Corticosteroids are a mainstay of treatment in the management of sinonasal inflammatory disease. Despite their common use, many practitioners are not well versed in their potential complications or the medico-legal ramifications of their use. The objectives of this review were to outline the existing data of the medico-legal implications of oral steroids. METHODS: An OVID database search of the terms "corticosteroids OR adrenal cortex hormones" AND "medico-legal OR malpractice OR jurisprudence OR expert testimony OR informed consent" was performed. This search was then narrowed to…

Toward a national framework for the secondary use of health data: an American Medical Informatics Association White Paper.

Secondary use of health data applies personal health information (PHI) for uses outside of direct health care delivery. It includes such activities as analysis, research, quality and safety measurement, public health, payment, provider certification or accreditation, marketing, and other business applications, including strictly commercial activities. Secondary use of health data can enhance health care experiences for individuals, expand knowledge about disease and appropriate treatments, strengthen understanding about effectiveness and efficiency of health care systems, support public health

Patient misconceptions and ethical challenges in radioactive iodine scanning and therapy.

The use and nature of radioactive iodine (RAI) are complex topics for patients with thyroid conditions to understand. Fear and anxiety over its use, misinformation in patient advocacy books and on the Internet, medical jargon, confusion regarding postscanning and posttreatment procedures, patient literacy, thyroid health status, and several other socioeconomic factors can create serious barriers to genuine informed consent in RAI scanning and treatment. The following discussion will review the origins of patient misconceptions and misinterpretations, including international differences in phys…

Rights not restrictions for learning disabled adults: a response to Spiecker and Steutel.

What follows is a response to an article by Spiecker and Steutel in which they pose the question of whether sex between people with "mental retardation" (sic) is morally permissible and in which they argue that since many such people cannot give "valid consent", the additional consent of caretakers may be required. However, we argue that the term "mental retard" is offensive and that either the UK terminology ("the learning disabled") or the internationally accepted term ("intellectually disabled") are more acceptable. Moreover, we point out that Spiecker and Steutel are mistaken. Many "learni

Improving Consent in Trauma: Recall (ICIT: Recall) : a multicentre study protocol of consent for hip fractures.

AIMS: This study investigates the effectiveness and adequacy of the informed consent process for patients undergoing hip fracture surgery. While informed consent is a legal and ethical responsibility, factors in the trauma setting can impair patients' understanding and retention of information. This study seeks to evaluate patients' recall of perioperative complications and explore their perceptions of the consent process. METHODS: A mixed-methods, multicentre cohort study will be conducted in the Southeast of Scotland. Adult patients with hip fractures will be recruited via purposive samplin…

Ethical issues surrounding high-risk kidney recipients: implications for the living donor.

Evaulating patients for living kidney donor transplantation involving a recipient with significant medical issues can create an ethical debate about whether to proceed with surgery. Donors must be informed of the surgical risk to proceed with donating a kidney and their decision must be a voluntary one. A detailed informed consent should be obtained from high-risk living kidney donor transplant recipients as well as donors and family members after the high perioperative risk potential has been explained to them. In addition, family members need to be informed of and acknowledge that a living k…

Looped quality improvement project of consent forms in patients admitted with hip fracture.

INTRODUCTION: Neck of femur (NOF) fractures constitute a significant proportion of the workload of orthopaedic departments, with approximately 65 000 admissions across the UK annually. There are various surgical procedures available to repair NOF fractures and each is associated with numerous intraoperative and perioperative risks. Informed consent is an essential part of the workup when planning to undertake any surgical procedure, whereby the risks and benefits of surgery are discussed with the patient, so they are able to make decisions about their care. It is therefore important that conse…

Linguistic and Cultural Challenges in Communication and Translation in US-Sponsored HIV Prevention Research in Emerging Economies.

Linguistic and cultural differences can impede comprehension among potential research participants during the informed consent process, but how researchers and IRBs respond to these challenges in practice is unclear. We conducted in-depth interviews with 15 researchers, research ethics committee (REC) chairs and members from 8 different countries with emerging economies, involved in HIV-related research sponsored by HIV Prevention Trials Network (HPTN), regarding the ethical and regulatory challenges they face in this regard. In the interviews, problems with translating study materials often a…

Legal issues in the provision of medical abortion.

As early medical abortion becomes more widespread in the United States, those who wish to provide it need to understand how existing abortion restrictions apply to this procedure. Although these laws were written with a primary regard for surgical procedures, most will be broadly applicable to the provision of medical abortion as well. In this article we briefly describe common abortion regulations, including physician-only laws, reporting requirements, targeted regulation of abortion providers, "informed consent" laws with mandatory waiting periods, parental involvement requirements, and laws…
