Biobanks play a central role in pediatric translational research, which deals primarily with genetic data from sample-based research. The use of legal guardianship appears to offer a ready resolution to the complex forensic issue of involuntary medication for psychiatric inpatients. The authors, with the aid of clinical examples, show that the gap between theory and practice may render this solution illusory and illustrate the profound complications for treatment introduced by the guardianship process itself. After examining the complexities of this problem, they consider alternative methods for preserving the patient's rights both to receive and to refuse medication.

INTRODUCTION: South Africa has one of the highest incidences of HIV among adolescent girls and young women (AGW), ages 15-24, and recent research has focused on developing interventions for HIV prevention. However, the South African National Health Act requires those under 18 years of age to obtain a guardian's permission to participate in research. Guardianship courts seem to issue decisions in case of the need to obtain consent for surgery, amongst other things, when the patient is unable to consciously express written consent, and at the same time does not have a legal representative or a statutory representative does exist, but settlement with him is impossible. The presented study case demonstrated the abnormalities of applying court procedures, as well as the responsibilities and dilemmas posed in front of a surgeon. A specialist surgeon wanted to help the patient and he was able to accomplish his mission.

Child custody and visitation remain vexing problems requiring input from mental health professionals as public policy decisions are formulated. Difficult problems do not have easy solutions, but through continued exploration of the issues using clinical and research methods, perhaps innovative programs will be developed and evaluated. Ultimately, this may lead to better ways of helping families cope with the trauma and the consequences of the family break-up and the resulting attempt to establish custody and visitation.
