Medical-legal issues regarding patients with low back pain.

Low back pain can present legal issues that require input from the patient's treating physicians. Because low back pain can lead to partial or complete disability, either on a short-term or long-term basis, patients may be unable to earn a living, which may make it necessary for patients to seek government aid, personal insurance benefits, or insurance benefits through workers compensation or even, when the low back pain was caused by an incident that was the fault of a third party, through a personal injury claim lawsuit. This article reviews the legal issues relevant to low back pain.

Clay-shoveler's fracture. Stress fracture of the lower cervical and upper thoracic spinous processes.

Clay-shoveler's fracture is a fatigue fracture of a lower cervical or upper thoracic spinous process. This occupational injury occurs primarily in workers who shovel heavy loads for long periods of time. It was common and well known at the beginning of the XXth century, but has become relatively rare since the introduction of earth-moving machinery, and is now frequently overlooked. A review of clay-shoveler's fracture is presented. Emphasis is put on the legal aspects that can raise problems for rheumatologists, radiologists, occupational physicians and physicians performing expert evaluation

Assessment of aphasia in relation to communication and cognitive impairments among stroke patients.

Methods for assessing language impairments differ from those needed for communication problems. The article presents results from three previously published studies by the author and co-workers. It is concluded that information about the impairment and training in compensation should be offered the spouse as well as speech therapy to the patient in order to improve reduced communication due to aphasia. Measures of neuropsychological impairments, communication skills and awareness of deficits should be included as well as tests of linguistic competency if a comprehensive aphasia assessment is s

Creating a culture of change through implementation of a safe patient handling program.

Health care professionals have a high risk for being injured while moving patients manually. The University of Iowa Hospitals and Clinics (UIHC) realized a need to reduce injuries suffered during patient movement. A UIHC multidisciplinary task force consulted the latest research, trialed products, and involved employees in selecting equipment for and implementing a safe patient handling program. This program resulted in a 76% reduction in lost workdays and an 85% reduction in workers' compensation costs. The keys to this program were involving employees, partnering with a key vendor, engaging …

Bloodborne pathogens exposure from occupational fingernail scratches.

Following occupational fingernail scratches (OFSs) in a developmental center, the source resident and the injured employee were tested for bloodborne pathogens (BPs). The pros and cons of this practice were scrutinized since fingernails usually contain no blood. Available records revealed no OFS-related BP transmission in 14 years. PubMed displayed no article linking OFS with BP. The facility's practice was discontinued as it was deemed unnecessary, wasteful, an impediment to the event's expeditious closure, an ineffective workers' compensation safeguard, and a potential source of venipuncture…

Redecompression and fusion in failed back syndrome patients.

Between 1979-1985, 45 patients underwent redecompression, neural exploration, and lateral mass fusion for failed back syndrome. Average follow-up was 29.2 months. Of the 45 patients, 47% had good results, 22% fair and 31% poor. Those factors that were found to correlate with a poor result were Workers' Compensation cases, less than six months pain free interval from the previous operation, male sex, history of psychiatric illness, and predominant diagnosis of perineural fibrosis. Our findings show that with meticulous surgical technique and careful selection of patients, a better than satisfac…

We examine the affective engagement of workers in app-mediated food delivery who continue working while explicitly describing the work as harming them financially, emotionally, and bodily, while using the language of betrayed intimacy. Evaluation and management of the acutely injured worker.

Approximately 3 million work-related injuries were reported by private industries in 2011, and primary care physicians provided care for approximately one out of four injured workers. To appropriately individualize the treatment of an injured worker and expedite the return to work process, primary care physicians need to be familiar with the workers' compensation system and treatment guidelines. Caring for an injured worker begins with a medical history documenting preexisting medical conditions, use of potentially impairing medications and substances, baseline functional status, and psychosoc…

Mandating reimbursement for non-FDA-regulated cannabis is bad public policy.

An influential cannabis lobby and its allies are engaged in an aggressive initiative to mandate health and worker's compensation insurance coverage for non-standardized, non-FDA-regulated cannabis products. If successful, mandated reimbursement would present a severe public health risk and force taxpayers to fund a risky and under-regulated industry. Leaders in psychiatry and other medical specialties have sounded the alarm about the marketing and sale of cannabis products for medical uses without prior review by the FDA. We echo their strong opposition to bills requiring workers' compensation…

A comparison of the burden and resultant risk associated with occupational falls from a height and on the same level in Australia.

Occupational falls are one of the leading causes of occupational injury and death internationally. This study described the nature of occupational falls following an analysis of workers compensation data in Western Australia. Frequencies, proportions and incidence rates were calculated following mechanism, gender, age and industry stratification. The natures of injury and bodily locations affected were compared between mechanisms of fall. Industry incidence rates were ranked and their corresponding proportions reported. Cost and lost time were described and risk scores for each burden type (in

Detection of cumulative trauma disorders of upper extremities in the workplace.

Surveillance for musculoskeletal disorders of the upper extremity in industry is in its infancy. Research efforts to elucidate the causal factors of these disorders often rely on either the analysis of existing medical records, worker compensation records (passive surveillance), or the surveying of workers with questionnaire and physical examination (active surveillance). The use of either type of data for routine surveillance presents several difficulties illustrated with the results presented in this paper. The analysis of existing records is generally less costly but the reliability of the

A matched case-control study of circumstances of occupational same-level falls and risk of wrist, ankle and hip fracture in women over 45 years of age.

This study examined the association between circumstances of occupational same-level falls and the risk of wrist, ankle and hip fracture in women over 45 years of age. Cases of fractures and matched controls who suffered non-fracture injuries, all from same-level falls, were selected from workers' compensation claims data. Cases and controls were matched on age, season of fall, industry and state. Information was obtained about manual material handling, fall hazard, initiating event and fall location. Falls during pushing/pulling were associated with increased wrist fracture risk. Falls due to…
