In the recent past there has been considerable discussion about the legal and legislative aspects of transplantation surgery. The present legal codes with German reunification now require a uniform law for the country as a whole. In addition to the different legal models already presented, any "expanded" agreement must not only respect the right of self-determination but also the responsibility of the individual for his societal obligations. The German legislator is now required to enact a uniform law which is reasonable and also considers the necessities of modern transplantation medicine in

Claims for compensation following dissatisfaction with the results of medical treatment have increased in frequency over the last few years. Medical records, such as declarations of consent and operation reports, often constitute important evidence in legal proceedings, particularly in the field of surgery. Before a vasectomy is performed for the purpose of contraception, detailed information must be given on how safe this is as a method of birth control and the patient must be made aware of the importance of sperm count controls after the operation. The surgeon is held responsible if it can b

Twenty-three patients with severe hemophilia were given single or multiple doses of diphenhydramine hydrochloride, chlorpromazine hydrochloride, or guaifenesin to test their effects on hemostasis. In contrast with earlier studies with aspirin, bleeding times were not prolonged after ingestion of these three drugs. No patient had hemorrhage because of the drugs, and none recalled excessive bleeding following drug ingestion. These results greatly extend the clinical implications of prior observations carried out in normal subjects demonstrating that many antiplatelet drugs have no effects on in

Millions of people want to donate their organs after they die for transplantation, and many of them have registered their wish to do so or told their family and friends about their decision. For most of them, however, this wish is unlikely to be fulfilled, as only a small number of deaths (1% in the United Kingdom) occur in circumstances where the opportunity to donate organs is possible. Even for those who do die in the "right" way and have recorded their wishes or live in a jurisdiction with a "presumed consent" system, donation often does not go ahead because of another issue: their familie

INTRODUCTION: Clinical trials conducted in low resource settings of vaccines against unlikely pandemics generate practical barriers to achieving genuine informed consent. Uncertainty over the likelihood of the occurrence of emerging disease threats complicates risk-benefit considerations. We explored how people interpreted the language of a draft consent form for a Phase II trial of a vaccine against Nipah virus (NiV), a lethal bat-borne zoonosis, and assessed their willingness to participate after learning about the trial procedures.
METHODS: We conducted a mixed-methods study collecting dat…

In clinical research, decision-making capacity is often equated with unspecified conceptions of autonomy, and autonomy is often equated with personhood. On this view, the loss of decision-making capacity is seen as a loss of autonomy, and the loss of autonomy subsumes a loss of personhood. An ethical concern arises at the intersection of those philosophical considerations with the legal considerations in informed consent. Because persons with inadequate decision-making capacity cannot provide legally effective consent, enrollment in research can occur only if a surrogate gives permission on th…

Health professionals have a legal and ethical obligation to obtain a valid consent before any procedure. The aim of this study was to assess the adequacy of consent for treatment of distal radius fractures. It also outlines potential improvements that could be made. A study of patients undergoing treatment for distal radius fracture was undertaken. We analysed the risks and complications recorded on the consent form. The common recorded risks were infection (95.6%), vascular injuries (77.8%), nerve injuries (66.7%) and stiffness (42.2%); 31.1% of the consent forms had abbreviations. Junior doc

BACKGROUND: Many adolescents and young adults (AYAs; 10-24 years old) are excluded from HIV research because of social, ethical, and legal challenges with informed consent, resulting in limited AYA-focused data. We use a participatory approach to identify strategies for improving AYA consent processes in HIV research in low- and middle-income countries (LMICs).
METHODS: We conducted a digital crowdsourcing open call for ideas to improve AYA consent to HIV research in LMICs. Crowdsourcing involves engaging a group of people in problem-solving, then sharing emergent solutions. Submissions were …

BACKGROUND: In 2015-16, the National Health Service (NHS) Litigation Authority received 10,965 claims for clinical negligence, with surgery having the highest number of claims. Currently a sum amounting to 25% of the annual NHS budget has been ring-fenced to meet extant claims. Claims made on a basis of inadequate informed consent are increasingly seen with many achieving a successful plaintiff outcome. There are presently no UK guidelines for thyroidectomy consent.
METHOD: A prospective study was performed to investigate current consent practice among the British Association of Endocrine and…

IntroductionLiving donor liver transplantation is expanding worldwide as a treatment for end-stage liver disease, especially in high-risk recipients. No standardized information is provided to donors during the informed consent process. Consequently, variable information may be provided to the donor about the recipient, which may undermine donor-informed consent.Research QuestionsIn high-risk donation scenarios, it is uncertain whether information disclosed about the recipient is sufficient for donor-informed decision-making. Would information about the recipient's potential adverse and benefi…

People's understanding of psychotherapy influences their treatment expectations and engagement. Informed consent is often one of the first formal processes through which this understanding is shaped. Yet, little cross-cultural research has examined its impact on lay people's pre-treatment attitudes. This study investigated whether the perceived importance of common factors and cognitive behavioral therapy (CBT) techniques varies across cultural contexts and informed consent framing. Chinese (n = 297) and U.S. (n = 303) participants with no prior therapy experience were randomly assigned to sta…

PURPOSE OF REVIEW: Since the recent black-box warning regarding the use of electromechanical morcellation, there has been a hesitancy to utilize the product and even to perform other types of morcellation by gynecologists. Unfortunately, this Food and Drug Administration action and the continued public criticisms of this procedure are grounded in poor data and faulty reasoning. To truly perform informed consent to patients considering procedures involving morcellation, a thorough review of the facts, not alternative facts, must be communicated.
RECENT FINDINGS: Misrepresentation of the ethics…

Living kidney donation requires rigorous medical, psychosocial, and ethical evaluation to safeguard donor welfare, ensure valid informed consent, and prevent wrongful exploitation. In Singapore, the Human Organ Transplant Act mandates review by a transplant ethics committee (TEC) for all living-donor transplants. However, ethical judgment is not reducible to TEC approval or procedural compliance; transplant programs themselves carry a broader responsibility to evaluate relational dynamics that may affect voluntariness and authenticity of consent. This paper examines three cases involving conce…
