Changing the law, changing the culture: rethinking the "sleepy resident" problem.

Ms. Whetsell examines the Bell Regulations, which limit New York's hospital residents' work hours and require increased supervision from sen … ke of government interference; and a general fear within the medical community of increased medical malpractice liability and other indicia of "blame culture." The Article concludes that the most effective approach to patient safety related to residency sleep deprivation should work within hospital culture, not against it. The proposed alternative approach wo …

Use of Unsolicited Patient Observations to Identify Surgeons With Increased Risk for Postoperative Complications.

IMPORTANCE: Unsolicited patient observations are associated with risk of medical malpractice claims. Because lawsuits may be triggered by an unexpected adverse outcome superimposed on a strained patient-physician relationship, a question remains as to whether behaviors that generate patient dissatisfaction might also contribute to the genesis of adverse outcomes themselves. OBJECTIVE: To examine whether patients of surgeons with a history of higher numbers of unsolicited patient observations are at greater risk for postoperative complications than patients whose surgeons generate fewer such u…

Litigation and Complications Arising from Aesthetic Body Surgery: A Systematic Review.

BACKGROUND: Aesthetic body surgeries such as liposuction, abdominoplasty, gluteoplasty, and breast augmentation have seen a global rise. However, the growing popularity of these procedures has led to increased reports of postoperative complications and medico-legal disputes. OBJECTIVE: To systematically review complications and litigation outcomes associated with aesthetic body surgeries and identify the most common risk factors contributing to legal claims. METHODS: A systematic review was conducted in accordance with PRISMA guidelines (registration on PROSPERO ID: CRD420251043585). Forty-o

Nerve injury after total hip arthroplasty: etiology, preventive strategies and medico-legal considerations.

BACKGROUND: Nerve injuries in total hip arthroplasty (THA) are rare but clinically and medico-legally significant adverse events, sometimes severely affecting patients' wellbeing through motor dysfunction and often permanent sensory alterations. Nerve injuries can result from complex interactions between a patient's pathophysiology, the technical aspects of surgery and individual response to surgical trauma - often rendering them not entirely avoidable. Professional liability should be assessed within a comprehensive framework, considering biological and procedural variables, adherence to clin

The "No-Fault" Principle in the Context of the Compensation System for Patients Affected by Bariatric Surgeons' Medical Services.

Introduction: The high risk associated with bariatric procedures prompts an analysis of the civil liability of bariatric surgeons towards patients. This liability may arise from medical errors, lack of appropriate patient consent, or insufficient information about possible procedure outcomes. The high risk of postoperative complications, independent of physician errors, makes bariatrics a particularly significant field for considering the "no-fault" principle.Aim: The aim of this paper is to demonstrate the need to introduce the "no-fault&qu

Anesthesia Liability Related to Pre-existing Conditions.

In 1985, the American Society of Anesthesiologists initiated a quality improvement closed claims analysis project for anesthetic injury to elevate patient safety. To date, there have been a total of 8954 documented claims, describing injuries contracted under sedation, regional anesthesia, or failure to attend to a patient's post-operative needs. The Closed Claims database reveals that the most highly documented health care complications were a loss of life at 2%, nerve injuries at 2%, and damage to the brain at 9%. The highest documented cases of damage from anesthesia involved regional-block

Litigation Patterns in Inguinal Hernia Surgery: A 25 Year Review.

BACKGROUND: Inguinal herniorraphyis among the most common procedures performed by general surgeons, but risk factors for litigation related to this surgery are poorly defined. METHODS: Cases were retrieved by searching the Westlaw database from 1991 through 2016 using the search terms "inguinal hernia" OR "inguinal herniorrhaphy" OR "inguinal hernioplasty" and "medical malpractice." Data were compiled on the demographics of the patient, operative case details, nature of injury, legal allegations, verdicts, and indemnities. RESULTS: Forty-six cases met inclusion criteria and were selected for…

Ischemic colitis following left antegrade sclerotherapy for idiopathic varicocele.

The Tauber procedure, i.e., antegrade sclerotherapy for varicocele, can lead to ischemic colitis. The pathogenesis can involve an atypical systemic-portal communication, which could represent an infrequently reported (rare) anatomical variant. The aim of this study is to review clinical cases from the literature to highlight the anatomical bases of such complications. A computer-aided and hand-checked review of the literature was used to identify relevant publications. Also, the computed tomography (CT) examination of a clinical case with medico-legal implications due to severe vascular compli

Feigned visual loss misdiagnosed as occult traumatic optic neuropathy: diagnostic guidelines and medical-legal issues.

The medical-legal problem of occult traumatic optic neuropathy diagnosed in patients who actually have feigned visual loss (malingering) is reviewed along with guidelines for suspecting and differentiating feigned visual loss from true traumatic optic neuropathy. We explain why we feel the term occult optic neuropathy is inappropriate and misleading, and the medical-legal consequences of this misdiagnosis are discussed.

Why can Taiwan utilize criminal law to discipline physicians?

Modern medicine was first introduced into Taiwan by missionary hospitals in 1865. However, Japanese governors following Japan's medical reform applied modern medicine as the standard of practice in the year 1896. They also imported 150 doctors from Japan to promote public hygiene and control infectious diseases, such as malaria, plague, cholera, dysentery, etc. The reasons that the Courts started to use criminal law to deal with medical malpractice during 1950-1960s may be attributed to the following: costly and ineffective civil actions, chaotic medical licensing, a period of upheaval during …

Development and progression of age-related macular degeneration after cataract surgery--in the near future it could become a forensic medicine problem.

After testing all types of implanted IOLs with spectrophotometer, author estimated that filtering of sun light is not successful, leaving open the possibility of development of AMD after cataract surgery. This is especially serious problem in implantation of IOLs to children. Until recently, implantation of intraocular lenses without or with inappropriate UV protection was not considered a serious problem. Nowadays we know that, especially in children, such treatment is no longer acceptable and results in AMD. It is only a matter of time when the first lawsuit will appear on it. We suggest obl
