No-fault system of compensation for obstetric injury: winners and losers.

OBJECTIVE: To determine whether Florida's implementation of a no-fault system for birth-related neurologic injuries reduced lawsuits and total spending associated with such injuries, and whether no-fault was more efficient than tort in distributing compensation. METHODS: We compared claims and payments before and after implementation of a no-fault system in 1989. Data came from the Department of Insurance's medical malpractice closed claim files and no-fault records. Descriptive statistics were compiled for tort claims before 1989 and for tort and no-fault claims for 1989-1991. We developed t…

Legal issues in managing breast disease.

The impact of legal issues in breast cancer care reflects the significance of breast cancer as a health concern of women. Breast cancer has emerged as a leading liability risk for primary care physicians, with most cases focusing on delayed diagnosis. Although the clinical impact of delayed diagnosis of breast cancer is often controversial, physicians should strive to diagnose breast cancer as early as possible in the natural history of the disease. No currently available data suggest that a delay of less than 2 months between the onset of symptoms and diagnosis or treatment adversely influenc

These scenarios are based on composites of actual court cases that have been tried to verdict or decision. Valuable risk management lessons may be learned from careful analysis of the course of the events described. Please be advised that the standard of care determined in any case is specific for that jurisdiction and that set of facts as established by expert testimony for the prevailing party.

[Severe complications of tonsillectomy].

The authors report 15 fatal complications after tonsillectomy based on the claims made between 1976 and 1986 to three insurance companies specialised in medical defence. The advantages and disadvantages of tonsillectomy with intubation and with the Sluder apparatus are recalled. Analysis of the legal proceedings of these cases reveals the principal points of jurisprudence: the importance of the preoperative assessment, pre-anaesthetic examination and informed consent. The concept of shared responsibility means that the surgeon must ensure the quality of the technical equipment of the establish

Alleged resection of the vas deferens: medicolegal implications.

New York state law requires that significant complications be reported by telephone within 24 hours, followed by a full written report within five days with the names of the alleged involved physicians. This case illustrates the potential medicolegal consequences following the mandated immediate nonsubstantiated report of an alleged bilateral vas deferens injury during a bilateral inguinal herniorrhaphy in a 7-month-old male. Review of the surgical pathologic specimen showed that both hernial sacs did indeed contain segments of vas deferens structures, which based on the findings at reexplorat

Popliteal artery injury following total knee arthroplasty due to a very rare variant of the popliteal artery: A case report of an unusual complication.

Variations of the popliteal artery are uncommon but often associated with popliteal artery injuries. Thus, in cases of popliteal artery injury, popliteal artery variations should be one of the primary differential diagnoses. Due to the poor prognosis that may result in amputation or mortality, such injuries are serious complications that can lead to medical malpractice cases. This report presents a case of a 77-year-old woman with bilateral knee osteoarthritis who sustained a popliteal artery injury during total knee arthroplasty due to the highly uncommon type II-C popliteal artery variation.…

Informed Consent for Intraoperative Neural Monitoring in Thyroid and Parathyroid Surgery - Consensus Statement of the International Neural Monitoring Study Group.

In the past decade, the use of intraoperative neural monitoring (IONM) in thyroid and parathyroid surgery has been widely accepted by surgeons as a useful technology for improving laryngeal nerve identification and voice outcomes, facilitating neurophysiological research, educating and training surgeons, and reducing surgical complications and malpractice litigation. Informing patients about IONM is not only good practice and helpful in promoting the efficient use of IONM resources but is indispensable for effective shared decision making between the patient and surgeon. The International Neur…

Delivering eye health education to deprived communities in India through a social media-based innovation.

In this article, Chandrani Maitra, with her supervisor, Prof. Jennifer Rowley, reports on her PhD research conducted at Manchester Metropolitan University. This research aimed to develop understanding of the benefits of, and the challenges associated with the use of social media to disseminate eye health information in deprived communities in India. Such communities typically have a low level of access to health information, as the result of poor literacy, poverty, lack of women's empowerment, cultural practices, society dynamics, and medical malpractice. This study used an intervention based …
