The non-disclosure of foetal exomphalos discovered on intra-uterine ultrasound to the mother and anaesthesiologist in this case report, was based on the obstetricians' assumption that it will reduce maternal stress in the antenatal period. There was mis-information that all was well in the antenatal period in spite of maternal informed consent. However, it led to maternal stress and dissatisfaction with the physician. The patient was referred to the psychiatrist for management of her stressful encounter in the postoperative period. Ethical and medico-legal issues raised by therapeutic non disc…

BACKGROUND: Research funders, regulatory agencies, and journals are increasingly expecting that individual-level data from health research will be shared. Broad consent to such sharing is considered appropriate, feasible and acceptable in low- and middle-income settings, but to date limited empirical research has been conducted to inform the design of such processes. We examined stakeholder perspectives about how best to seek broad consent to sharing data from the Mahidol Oxford Tropical Medicine Research Unit, which implemented a data sharing policy and broad consent to data sharing in Januar

This research investigated the information needs of patients receiving ED procedural sedation to determine the best format to consistently deliver key information in a way acceptable to all involved. Of particular interest was the question concerning patients' need for receiving written information. A descriptive exploratory study gathered qualitative data through face-to-face interviews and focus groups involving patients, nurses and medical staff. Individual interviews were conducted with eight adult patients following procedural sedation. They identified very few gaps in terms of specific i

UNLABELLED: Biobanks are increasingly central to precision medicine, particularly in rare diseases and paediatric oncology, where small and molecularly heterogeneous populations make access to high-quality, longitudinally annotated biological material essential. This narrative review examines the scientific value of paediatric biobanking and the ethical, regulatory, and organisational challenges that distinguish it from adult biobanking. Relevant scientific literature, European and Italian regulatory sources, international biobanking standards, and guidance on data protection and research gove

PURPOSE: The rapid advancement of automatic speech recognition (ASR) and natural language processing technologies has created significant opportunities for clinical applications within speech and language disorders, yet these capabilities remain largely confined to high-resource languages and populations. As research communities work to address these inequities through inclusive speech data collection, the intersection of clinical vulnerability, linguistic diversity, and emerging speech and language technologies creates ethical considerations that are rarely addressed by existing guidelines. BACKGROUND AND OBJECTIVES: Decision-making capacity (DMC) is a prerequisite for valid informed consent, as well as being a key methodological requirement in clinical and epidemiological research. For individuals with neurocognitive disorders, DMC assessment is frequently based on subjective clinical judgment, with limited standardization and significant variability across settings. Current instruments are resource-intensive and not sufficiently adapted for stage-specific or real-world applications. To develop and internally validate a structured multimodal framework for assessing DMC in indivi…

Cesarean delivery on maternal request presents an ethical challenge in obstetrics. This comprehensive ethical examination of cesarean delive … rred mode in the absence for indications for cesarean delivery. We propose a systematic approach to informed consent that incorporates trauma-informed care, considers future reproductive plans, and addresses both immediate and long-term implications for mother and child. The framework includes comprehensive discussion of maternal risks (surgical complications, pla …

Emergency departments (EDs) are increasingly sites of interaction between clinicians and federal immigration authorities. Recent shifts in federal enforcement policy have intensified these encounters. Patients now more frequently arrive in custody, accompanied by immigration enforcement officers who may assert control over communication, decision-making, or access to patients. These circumstances introduce challenges for maintaining standard clinical practice. Clinicians may encounter situations in which patient confidentiality, informed consent, and independent medical judgment are difficult …

OBJECTIVES: Ethical compliance of randomised controlled trials (RCTs) documented as ethics committee (EC) approval is vital for participant protection but is often overlooked by evidence synthesis producers despite regulatory mandates. We aimed to systematically assess reporting of ethics approval and informed consent (IC) in RCTs included in evidence syntheses and examined its potential impact on the study pool as part of a research integrity assessment (RIA).
DESIGN: Meta-epidemiological study.
SETTING: Assessment of ethics approval; domain 3 of the RIA tool developed for evidence synthese…

In this case study, I consider Mr. A, a Jehovah's Witness with chronic vertebral osteomyelitis in need of surgical debridement. Prior to proceeding to the OR, he was unwilling either to explicitly consent to or refuse blood transfusion, while indicating he was open to transfusion intraoperatively, if the team judged it necessary. Ethics was consulted to determine if it would be morally justifiable for the team to proceed with blood transfusion during the course of surgery without Mr. A's documented consent to being transfused. I argue that in this case, what might be termed indirect consent-na

The implementation of non-invasive prenatal screening (NIPS) in Canada will be affected by legal norms. The law can shape physician behaviour, help to crystallize standards of care, influence utilization patterns, and reflect and reinforce patient expectations. In Canada, failure to inform a patient about NIPS, or misinterpretation of NIPS results, could result in a successful "wrongful birth" claim if the patient subsequently gives birth to a child with a condition that had been detectable. Given that research shows that physicians' decisions are influenced by concerns about liability, malpra

The concept of affirmative consent presumes a subject who is fully transparent to herself and who can anticipate the precise effects of her assent. This essay proposes limit consent, a concept that offers us different ways to think about the sexual-and about the analytic encounter. Limit consent involves a more nuanced negotiation of limits and becomes possible when the subject makes herself passible (Lyotard 1988) to an other-a condition that is neither active nor passive. Processes described in depth here suggest that passibility has ties to the rousing of infantile sexuality (Freud) and to

It's commonplace to declare that seniors are more fragile, because of a higher rate of comorbidities and complex coronary lesions. However, they take great benefit from angioplasty during acute coronary syndrome, with a higher rate of complications. Based on the study of claims reported to a French medical insurer, it is found that people over 75 years old among victims of interventional cardiology accidents is proportional to the population of seniors in the French population (around 10%). Conversely, the mortality of those seniors was much higher than patients under 75 (83% versus 30%). A st

Must we obtain a patient's consent before posthumously removing her organs? According to the consent requirement, in order to permissibly remove organs from a deceased person, it is necessary that her prior consent be obtained. If the consent requirement is true, then this seems to rule out policies that do not seek and obtain a patient's prior consent to organ donation, while at the same time vindicating policies that do seek and obtain patient consent. In this paper, however, I argue that once we recognize the difference between consent, on the one hand, and wishing or desiring, on the other

A provocative question has emerged since the Supreme Court of Canada's decision on assisted dying: Should Canadians who request, and are granted, an assisted death be considered a legitimate source of transplantable organs? A related question is addressed in this paper: is controlled organ donation after assisted death (cDAD) more or less ethically-problematic than standard, controlled organ donation after circulatory determination of death (cDCDD)? Controversial, ethics-related dimensions of cDCD that are of relevance to this research question are explored, and morally-relevant distinctions b
