[The horizon of medical attention in pediatrics: what to do in the case of children who are in abandonment, conflict, harm or danger situations in combination with a severe disease?].

BACKGROUND: Laws refer that minors do not have the capability to give informed consent for their own medical attention. However, there are special conditions in which they are allowed to decide about their health. The greater the judgement and experience limitations in minors, the less weight is given to the values and objectives they express. Also, the more adverse consequences might be, the higher the level of authority that is demanded to decide on behalf of the minor, thus granting the State the capability to guarantee the well-being of the minor. CASE REPORT: 12-year-old female patient w…

Case reports on dangerous infectious diseases: a review of patient consent.

Case reports are commonly used to describe new infectious diseases. In the past 20 years, there have been an increasing number of emerging infectious diseases that could constitute a major threat to global health security (through naturally occurring pandemics or deliberate release of infectious agents). It is vitally important that case reports related to infectious diseases are written up according to the highest possible standards and that guidelines regarding patient consent to publish are followed. So, do case reports that relate to dangerous infectious diseases follow guidance related to

Seeking consent for research with indigenous communities: a systematic review.

BACKGROUND: When conducting research with Indigenous populations consent should be sought from both individual participants and the local community. We aimed to search and summarise the literature about methods for seeking consent for research with Indigenous populations. METHODS: A systematic literature search was conducted for articles that describe or evaluate the process of seeking informed consent for research with Indigenous participants. Guidelines for ethical research and for seeking consent with Indigenous people are also included in our review. RESULTS: Of 1447 articles found 1391 …

Tubal sterilisation without consent: a case report.

Severe vitamin D deficiency has been found to be prevalent in institutionalized elderly persons in several countries. The aim of the present work was to assess the vitamin D status of institutionalized elderly and compare it to that of community-living independent elderly in southern Greece during summer. Serum 25-hydroxyvitamin D [25(OH)D] and plasma PTH were measured in 58 (aged 68-103 yr, median 83.5) elderly inmates of a nursing home (IE) in the town of Kalamata (latitude N 37 degrees ) and in 48 (aged 60-89 yr, median 72) community-dwelling elderly (CDE) in Athens (latitude N 38 degrees )

Potentially incapable patients objecting to treatment: doctors' powers and duties.

Generally, a patient may only be assessed and treated with his or her consent. It is difficult to interpret the law regarding doctors' powers and duties to assess and treat in cases where a patient refuses to accept medical advice but it is unclear whether the patient has decision-making capacity (DMC) or whether they are mentally ill. An examination of legal principles in this area suggests that there is a limited justification for doctors to detain a person for the purpose of assessment if they have good reason to suspect the person may either lack DMC or be mentally ill and if failure to de

Cardiovascular implantable electronic devices: patient education, information and ethical issues.

Cardiovascular implantable electronic devices (CIED) are implanted increasingly frequently. CIEDs are indicated for the treatment of bradycardia, tachycardia and heart failure and therefore improve quality of life and life expectancy. CIED can treat ventricular arrhythmias that would be fatal without immediate care. However, CIEDs raise several patient education, medico-legal, and ethical questions that will be addressed in this article. Information is a patient's right, and necessary for informed consent. When implanting a CIED, the patient must be educated about the need for the device, the …

[Epiduroscopy].

Epiduroscopy is a minimally invasive diagnostic and therapeutic technique used in patients with chronic low back pain with or without radiculopathy. Epiduroscopic procedures are particularly indicated in cases of failed spinal surgery. This review discusses the indications, contraindications, and complications of the technique, describing in detail the sacral (caudal) and interlaminar approaches and noting their advantages and disadvantages. Practical recommendations are made, along with an attempt to assess future prospects for epiduroscopy.

Written consent for laparoscopic tubal occlusion and medico-legal implications.

OBJECTIVE: To analyse the completeness of written consent for laparoscopic tubal occlusion and to consider the medico-legal implications of incomplete written consent. METHODS: A retrospective review was undertaken of the medical records of all women who had laparoscopic tubal occlusion in 2006 in a district general hospital to elicit details of risks of the procedure as recorded on the consent form. The extent of documentation of risks and complications that were cited in the guidelines was analysed. In addition, the grade of doctor and the timing of obtaining written consent were studied.

Adjudicative competence.

PURPOSE OF REVIEW: Although the basic standards of adjudicative competence were specified by the US Supreme Court in 1960, there remain a number of complex conceptual and practical issues in interpreting and applying these standards. In this report we provide a brief overview regarding the general concept of adjudicative competence and its assessment, as well as some highlights of recent empirical studies on this topic. RECENT FINDINGS: Most adjudicative competence assessments are conducted by psychiatrists or psychologists. There are no universal certification requirements, but some states a

[Pre-randomisation in study designs: getting past the taboo].

In October 2006 the Dutch Ministry of Health, Welfare and Sport announced that the use of pre-randomisation in study designs is admissible and not in conflict with the Dutch Medical Research in Human Subjects Act. With pre-randomisation, the conventional sequence of obtaining informed consent followed by randomisation is reversed. According to the original pre-randomisation design (Zelen design), participants are randomised before they are asked to consent; after randomisation, only participants in the experimental group are asked to consent to treatment and effect measurement. In the past, pr…

Competence and paternalism.

Some bioethicists have argued in favor of a sliding scale notion of competence, paternalistically requiring greater competence in relation to more significant risk. I argue against a sliding scale notion, taking issue with the positions of Allen E. Buchanan and Dan W. Brock, Ian Wilkes, and Joel Feinberg. Rejecting arguments that a sliding scale is supported by legal cases, by ordinary usage, and by fallible judgments about competence, I argue in favor of greater evidence of competence when risk is greater. Two clinical cases are examined, both involving amputation, to show that my fixed conce

An unidentified substance.

AT 5.00 am one Friday morning a 19-year-old woman was brought into the Accident & Emergency (A&E) department following a head on collision with a van. The young woman had sustained severe head injuries, along with a fractured pelvis and a ruptured spleen. Following resuscitative surgery, the patient was taken to the intensive care unit, where she remained unconscious following her head injury. Two patients from the van were admitted to A&E with minor injuries, and were discharged home mid-morning. When staff checked the woman's belongings and listed them in a property book, they discovered whi

[Therapeutic strategies in respiratory insufficiency in amyotrophic lateral sclerosis. Possibilities and limits].

In the final stage of amyotrophic lateral sclerosis (ALS) the majority of patients develop chronic respiratory failure due to respiratory muscle weakness. The interaction between the patient with ALS and the physician should be characterized by continuous communication, especially with respect to the prospect of ventilatory failure and for support. The patient and his family must be informed thoroughly about the natural history and the prognosis of ALS, depending on the individual disease process. Already in the early stage of the disease coping strategies should be discussed so that imminent

HIV disease in pregnancy. Ethics, law, and policy.

Legal and ethical principles mandate that informed consent be an integral element of HIV-related education, counseling, testing, treatment, and intervention. Minimizing patient counseling and education (for economic reasons or otherwise) is likely to backfire. The presumption that a parent will act in her child's best interest, accepted in analogous contexts, should be foundational in the development of HIV policy in the obstetric and gynecologic setting. Most women, when provided with counseling, care, and confidentiality, consent to prenatal or perinatal testing and, most important, engage t…
