Mainstreaming informed consent for genomic sequencing: A call for action.

The wider availability of genomic sequencing, notably gene panels, in cancer care allows for personalised medicine or the tailoring of clini … d genomic information. When genomic tests are mainstreamed into cancer care, so should accompanying informed consent practices. This paper outlines what mainstream oncologists may learn from the ethical tradition of informed consent for genomic sequencing, as developed within clinical genetics. It argues that mainstream informed consent practices should focus on p …

[Proposal of informed consent by representation for treatment with clozapine].

Clozapine-induced agranulocytosis, a potentially serious adverse effect, is a limiting factor for its therapeutic use, leading to the suspension of the drug. Its annual incidence in Argentina is 0.05%. In 2000, under provision number 935, the ANMAT approved the Monitoring Program for Ambulatory and Inpatient Patients Treated with Clozapine. In this provision arises the obligation to sign the informed consent where the patient is informed of the risks and benefts of the treatment. In psychiatric care practice patients may not possess, because of their altered psychic state, the level of compete…

Informed consent for biobanking: consensus-based guidelines for adequate comprehension.

PURPOSE: Federal regulations and best practice guidelines identify categories of information that should be communicated to prospective biobank participants during the informed consent process. However, uncertainty remains about which of this information participants must understand to provide valid consent. METHODS: We conducted a Delphi process to define "adequate comprehension" in the context of biobanking consent. The process involved an iterative series of three online surveys of a diverse panel of 51 experts, including genome scientists, biobank managers, ethics and policy experts, and …

Heroin addiction and voluntary choice: the case of informed consent.

Does addiction to heroin undermine the voluntariness of heroin addicts' consent to take part in research which involves giving them free and legal heroin? This question has been raised in connection with research into the effectiveness of heroin prescription as a way of treating dependent heroin users. Participants in such research are required to give their informed consent to take part. Louis C. Charland has argued that we should not presume that heroin addicts are competent to do this since heroin addiction by nature involves a loss of ability to resist the desire for heroin. In this articl…

Ethics of Frey syndrome: ensuring that consent is truly informed.

Frey syndrome is a widely recognized sequela of parotidectomy with a variable prevalence dependent upon diagnostic criteria. There exists a multitude of strategies for both prevention and treatment. Surgeons are obligated to engage patients in a frank and open discussion of the operative risks, benefits, and alternatives. Due to uncertainty regarding the significance of Frey syndrome postoperatively, the process of informed consent and preoperative decision-making pose a potential ethical quandary. This commentary is designed to heighten the awareness of the preoperative informed consent proce…

Implications of late complications from adhesions for preoperative informed consent.

The process of informed consent is a critical aspect of the doctor-patient relationship. Doctors have a professional duty to provide patients with sufficient information if a treatment is associated with a significant risk. NHS guidelines advise doctors to mention risks that occur more frequently than 1-2% or risks that are serious even if the likelihood is very small. In the case of abdominal and pelvic surgery, risks can broadly be divided into early and late complications. Early complications, such as bleeding and infection, have a close temporal relationship with the operation. Such compli…

Informed consent as a source of bias in clinical research.

Clinical observation suggested that schizophrenic patients more often refused to participate in experiments. In two studies psychiatric patient volunteers and nonvolunteers were compared on discharge diagnoses (psychiatric and medical), medication given, demographic measures, and hospitalization characteristics. In each study, patients with paranoid schizophrenia were more likely to refuse participation. Also, in each study, volunteers received more benzodiazepines and more nonpsychiatric medication. The latter difference could not be explained on the bases of rated severity of or probability

Reconceptualizing Informed Consent as the Objective Activity of Real Person.

This paper argues that viewing informed consent as an autonomous action is problematic because it is based on an idealized conception of the person and of autonomy. Instead, informed consent should be viewed as the objective activity of real, concrete persons. In this activity, an individual, acting as a subject, authorizes a specific object for a particular purpose. A person's choice is fundamentally constrained by the reality of both the object and the subject (the individual themselves). Accordingly, individuals must understand the nature of the object and its relevance to their own situati…

[Improper informed consent of the patient: legal and expert assessment].

The purpose of the study is to draw the attention of the legal and medical community to the problem of insufficient awareness of the patient about the upcoming medical intervention; to identify the scope of interaction between the court and the expert in relation to disputes related to improper information. Despite the fact that the conclusion about improper informing of the patient implies a legal assessment of the circumstances, special medical knowledge is needed to identify some defects of voluntary informed consent. The expert, in particular, can answer the questions of the court about wh…

Informed consent and biological agents in rheumatology and internal medicine.

BACKGROUND: The need for highly effective therapies in rheumatologic diseases has led to the widespread and growing use of a heterogeneous class of molecules called biological agents. The increasing experience with biological agents has raised concerns about safety and efficacy issues that need to be discussed in the informed consent acquisition process. METHODS: The authors performed a review of the literature on biological agents focusing on their most important characteristics concerning the informed consent procedures. RESULTS: No studies specifically addressed the issue of informed cons…

Adolescent Gender Dysphoria and the Informed Consent Model of Care.

The informed consent model of care for people who identify as transgender is predicated on the idea that a careful mental health assessment and a formal diagnosis of gender dysphoria are not necessary preconditions before starting a person on cross-sex hormones. This article considers the legality of the informed consent model in relation to adolescents under 18 in Australia in the light of the decisions of the Family Court in Re Kelvin (2017) 327 FLR 15; [2017] FamCAFC 258 (Re Kelvin) and Re Imogen (No 6) (2020) 61 Fam LR 344; [2020] FamCA 761. The approach taken by the Family Court is predic…

I'm shocked: informed consent in ECT and the phenomenological-self.

This paper argues that phenomenological insights regarding selfhood are relevant to the informed consent process in the treatment of depression using electro-convulsive therapy (ECT). One of the most significant side-effects associated with ECT is retrograde amnesia. Unfortunately, the current informed consent model does not adequately appreciate the full extent in which memory loss disturbs lived-experience. Through the philosophy of Merleau-Ponty, it is possible to appreciate the way in which memory loss affects a person's self-experience, with emphasis given to one's pre-reflective and embo…
