BACKGROUND AND OBJECTIVES: Understanding the role of immunization legislation limiting non-medical vaccination exemptions is vital for sustaining protection against vaccine preventable diseases (VPDs). Our study objective was to explore healthcare provider (HCP) vaccine knowledge, beliefs, and practices related to medical exemption (ME) legislation in California mid-COVID-19 pandemic.
METHODS: We conducted a cross-sectional study by administering a survey among California-based HCPs from 2021 to 2022. Physicians reporting primary areas of practice in pediatrics, family and internal medicine,

The population is well aware today that the emergency doctor holds a strong position in the field of preclinical care. The time of onset of expert care of the emergency patient is of great significance in regard to survival and prevention of further damage. Whereas equipping of ambulance vehicles and training of orderlies are controlled by rigid regulations, there are no particular requirements concerning the training of ambulance doctors. Definite minimal training should be required of the ambulance doctor because of mistakes made and care services often being insufficient. In respect to cont

The landmark federal Emergency Medical Treatment and Active Labor Act of 1985 (EMTALA) requires that all patients who seek emergency treatment be given an adequate medical screening examination and prohibits discrimination on the basis of patients' ability to pay. Although the impact of EMTALA on psychiatric practice is clinically, ethically, and legally significant, many psychiatrists have had little formal training in the provisions of this legislation, and little discussion of it is found in the psychiatric literature. EMTALA will become increasingly important in a managed care environment

Abortion prohibitions in some states include carve-outs based on the medical condition of either the mother or the fetus. These carve-outs, however, may be couched in limiting language structured by legislators rather than in language understandable in the context of medical care. In circumstances where legislative bodies fail to adequately incorporate medical professionals in the drafting of medical laws, the resulting vagueness or ambiguity may lead to a lack of utility or viability. This paper considers the consequences of such legislative misreading of medicine. It does so with a particula

During the relatively short history of class proceedings in Canada, developers and manufacturers of medical devices and pharmaceuticals ("medical products"), including medical products designed for patients with diabetes, have found themselves at the receiving end of a significant number of class action claims. As a result, medical products litigation has become the battleground for some of the most significant developments in Canadian class actions law. This article provides a broad overview of some of the most significant developments. The authors pay particular attention to developments reg

The first jurisdictions in the world to introduce legislation regulating donor conception were Victoria (Australia) and Sweden in the 1980s. Under the Infertility (Medical Procedures) Act 1984 (Vic), donor-conceived people (aged 18 years and over), their parents (if children were under 18 years) and donors gained the right to apply for identifying information about each other. Information can only be given with the consent of each party. To date, over 3,500 donor-conceived children have been born in Victoria since the 1984 Victorian legislation was introduced (and enacted in 1988). The first 1

Although the federal government and most states have enacted laws protecting healthcare providers' rights to refuse to provide or participate in procedures to which they have moral or religious objections, most such laws are deficient and many have been met with hostile judicial interpretations that have diminished their scope and strength. Deficiencies found in nearly all conscience clause laws include limitations on the specific conduct or procedures protected, restrictive definitions of the healthcare providers covered, and inadequate implementing procedures and remedies. Most conscience cl

In 1986, Congress passed legislation intended to prevent hospitals from "dumping" patients who were unable to pay for their care. This legislation was appended to the Consolidated Omnibus Budget Reconciliation Act as the Emergency Medical Treatment and Active Labor Act (EMTALA). The EMTALA imposes two sets of duties on all hospitals that receive Medicare funds. Since 98% of hospitals in the United States participate in the Medicare program, EMTALA applies to nearly all hospitals in the United States. In short, hospitals with an emergency department must provide an appropriate screening examina

The movement to reduce tobacco use has been gathering pace in the Eastern Mediterranean Region (EMR), as governments aim at implementing legislation to encourage populations to turn away from tobacco consumption and avoid the associated health risks. Indeed, within the Region it was in 2007 that Egyptian cardiologist Prof. Hamdi El Sayed, former member of parliament and former head of the Medical Syndicate, successfully proposed legislation for the implementation of graphic health warnings on tobacco packets covering 50% of visible packaging. In 2011, cardiologist Dr George Saade, former focal

Good medical practice: a code of conduct for doctors in Australia provides uniform standards to be applied in relation to complaints about doctors to the new Medical Board of Australia. The draft Code was criticised for being prescriptive. The final Code employs apparently less authoritative wording than the draft Code, but the implicit obligations it contains are no less prescriptive. Although the draft Code was thought to potentially undermine trust in doctors, and stifle professional judgement in relation to individual patients, its general obligations always allowed for flexibility of appl

The role of the attending physician and the district medical examiner in the case of a natural or unnatural death is subject to a number of legal regulations. The different parts of a postmortem examination, the conditions for the issue of a death certificate, the term 'attending physician', and the position and duties of the district medical examiner are not, however, unequivocally specified in Dutch law. This gives rise to frequent misunderstandings.

The author goes into five ethical problems involved in foetal indication for termination of pregnancy: 1. The method of prenatal diagnosis is considered to be ethically neutral. 2. Arguments and indication for termination of pregnancy in case of foetal indication are critically reviewed. Four degrees of severity are distinguished in the field of prenatal damage. 3. After expounding the arguments for a continuation of pregnancy, the only case in which termination is declared as ethically justifiable is the occurrence of "total malformation" of the foetus (anencephaly). 4. In everyday practice,

INTRODUCTION: There is an increasing body of legislation that limits access to electroconvulsive therapy (ECT) with a relative lack of directives and recommendations from psychiatrists regarding these laws.
METHODS: The authors utilized LexisNexis to examine newer legislation related to various aspects of ECT and the implications of these laws in ECT treatment.
RESULTS: These laws include regulations regarding informed consent, age restrictions, and approved practitioners. All but one of these enacted laws are restrictive.
DISCUSSION: Such laws reduce the availability of this life-saving tr

In the debate surrounding secrecy in donor insemination (DI), the semen donor is often cited as a person needing the protection of anonymity. Sweden's unique legislation, the 1985 Insemination Law which, among other things, gives mature DI offspring the right of access to donor identity, has attracted much comment. Prior to the legislation's enactment, there were fears that the law would result in a rapid and irreversible decline in DI as a treatment in Sweden. It was also predicted that it would be almost impossible to recruit donors under the legislation. This paper describes the provisions

This paper offers a qualified defence of physician non-compliance with antiabortion legislation in the wake of the Supreme Court's decision in Dobbs v. Jackson Women's Health Organization. The paper examines two ethically troubling trends of post-Dobbs legislation: narrow and vague maternal health exemption clauses and mandatory reporting of miscarriages in jurisdictions where patients may criminal prosecution for medically induced abortions. It then examines and defends a professional obligation on the part of physicians to comply with the law. This obligation, however, is defeasible. The pap
