This article examines the way in which some biomedical ethicists have constructed sexually transmitted AIDS as a significant threat to women's health. We demonstrate that the familiar claim that 'women are the fastest growing group' -- whether of HIV-infected or of AIDS patients -- is misleading because it obscures the distinction between proportional rate of growth and absolute increase. Feminist ethicists have suggested that misogyny of a male dominated health care system has led to underreporting of women AIDS cases in order to support these feminists' claim of AIDS being a real threat to w

I argue that parents ought to be allowed to authorize their child's participation as an organ donor for another family member. I introduce a model of decisionmaking for children in intimate families which I call Constrained Parental Autonomy. This model permits wide parental discretion which is constrained absolutely by a broadly defined principle of respect for persons. In general, parental authorization alone is sufficient but I argue that the respect for persons constraint prevents certain donations and requires the child's assent for other donations. I also consider two controversial impli

Do physicians have a duty to sustain the pregnancies of women who die during the first or second trimester? Physicians cannot simply assume that the woman would have wished the pregnancy to continue, nor (in the U.S., at any rate) is it clear that the state has any interest in fetal life before viability. The conditions for beneficence-based duties of fetal rescue will often be unmet, both because sustaining the pregnancy is not always a clear gain to the born child and because it may impose a substantial burden on the benefactor. And duties of special relationship cannot readily be applied in

If, as I believe, gene therapy is in principle ethically sound except for its possible connection with eugenics then there are two obvious ways of giving a simple and straightforward answer to a question such as this. The first is to say "yes it is, and so what?" The second is to say "no it isn't so we shouldn't worry". If we accept the first of the above definitions we might well be inclined to give the first of our two answers. If on the other hand, we accept the sort of gloss that Ruth Chadwick gives on Galton's account, "those who are genetically weak should simply be discouraged from repr

[I]nterest in animals as a source of organs and tissues for human beings remains strong. New developments in immunosuppression technology promise to lower the technical barriers to a routine use of nonhumans as organ donors, and the image of colonies of animals kept at the ready for supplying the growing human need for new organs seems a much more plausible scenario now than it did when broached by transplantation specialists in the Sixties. As Arthur Caplan has powerfully argued, the prospects that other sources of organs may resolve the supply problem are grim.... In the face of these "pro-x

In his paper on the effects of Prenatal Genetic Intervention (PGI) on personal identity, Noam Zohar comes to a conclusion about genetic makeup and the uses of gene therapy quite different from the one I reach in another piece in this issue. Zohar's argument rests on the contention that personal identity changes with alteration of the genome, following what I have identified as the "constitutive" view. To see that this is the pillar supporting the weight of his argument, consider the following. Questions of identity aside, how can it be that altering the genome of children suffering from Lesch-

... We must attempt to explain, how, if ever, our existence may harm us. To address this and the other questions raised, I propose to examine what constitutes harm and whether it makes sense to say that our genetic makeup may harm us. To do this I will describe three approaches to the problem of describing the status of negative effects our genes have upon us, which I have named the "technical harm" view, the "constitutive" view, and the "harmful conditions" view. On the technical harm view, the standard definitions of harm are applied to genetic disposition in an attempt to couch genetic defe

Liveborn anencephalic infants cannot be used legally as sources for vital organs in the United States and Canada. Understandably, knowledgeable physicians and bioethicists are divided over the ethics of such use and hold various views on whether the legal status of anencephalic newborns should ever be changed. Even if anencephalic newborns could be utilized as organ sources, at best a few hundred infants needing transplant organs would be saved each year. Primarily, this is because the number of anencephalic newborns is likely to diminish due to prenatal diagnosis resulting in abortions. Howev

Bayer's approach is most effective when he uses it to describe the politicized nature of AIDS policy in the United States. He succeeds in showing the reader that public health authorities dealing with the spread of HIV/AIDS had a wide variety of competing interests to take into account in formulating AIDS social policy and that political interest groups, most notably gay community organizations, played a large role in fashioning AIDS policy. Those who might have doubted the significance of contextual factors such as these for health policy, and especially for AIDS policy, will be convinced of

As Tom Tomlinson's study indicates, there is considerable misunderstanding and confusion among physicians and nurses working in the area. Brain death is often not well-understood by healthcare professionals and hence inadequately explained to relatives, leaving them confused as to whether their loved-one is alive or dead. Whilst these healthcare professionals are using whole-brain death as the criterion of death, they have no clear understanding of the definition of death which underpins the brain-death criterion. Lack of this philosophical rationale makes the use of the brain-death criterion

The connection between brain life and brain death is neither as simple nor as defensible as it might at first appear. The problem rests with the two dominant competing definitions of death:...the loss of that which is necessary for the organism to continue to function as a whole;....the loss of that which is essentially significant to the nature of the organism... If death is understood as the loss of that which is necessary for the continued functioning of the organism as whole, then the apparent symmetry breaks down. If...death could be understood as the loss of that which is essentially sig

Tiredness is taken seriously in healthcare where clinicians are concerned since good decisions require the ability to think clearly. The impact of patient tiredness is neglected. This is surprising, as there are healthcare contexts, like maternity care, where tiredness is nearly ubiquitous. Empirical research into sleep deprivation suggests that tiredness undermines substantially our abilities to understand and reason about potential choices. Since these abilities are necessary components of having capacity, tired patients may lack capacity in moments when important choices have to be made, fo

One Medicine is not One Health. Although both concepts connect animal and human health, One Health has arguably become a frame for public health. This paper argues that One Medicine uniquely centres on animal and human patients and speaks to the equal interdependence of their health, though it has also (historically) been adopted as a response to the circumstances of living in and with nature. The evolution of One Medicine can be seen as 'jumping together,' or the consilience of ideas and disciplines over time, giving a new sense in theory that unifies previously unconnected phenomena found in

Responsibility continues to shape how many transplant programs evaluate liver transplantation for patients with Alcohol Use Disorder (AUD), even in settings where the traditional 6-month abstinence rule has been abandoned. This article argues that using past drinking to lower transplant priority, or to break ties between candidates, is ethically mistaken and clinically harmful. Appeals to personal responsibility often misrepresent the nature of addiction and overestimate the degree of knowledge and control individuals possess when harmful drinking patterns begin and escalate. Early onset of al
