[Bad or mad? Thinking in terms of 'bad or mad' and the (possible) prosecution of offenses committed by the mentally ill].

BACKGROUND: Psychiatrists working for the outreach emergency services of mental health institutions are regularly asked to assess whether a suspect being held at a police station should be charged and later prosecuted or be admitted to a mental institution. In other words, is the suspect 'suited for detention'. Often the representative of the judicial system and the psychiatrist from the emergency services then discuss whether the suspect would be better served by care under the mental healthcare system or under the criminal judicial system. Compulsorily admission to a mental health institutio

Physical restraint of patients in a psychiatric hospital.

Use of physical restraint occurs within British psychiatric hospitals yet there has been little evaluative research on current practice. The present study aims to describe a group of disturbed in-patients who had required physical restraint at some point during the course of their stay in hospital and to classify the reasons for its use. Cases were identified using Case Register data and information obtained from patients' records. In the 48 episodes of physical restraint identified, patients were predominantly schizophrenic (60%), male (67%) and had been restrained because of physical violenc

The mentally disordered criminal offender: a description based on demographic, clinical, and MMPI data.

From 340 MMPIs of male forensic state hospital patients, seven disjoint clusters were obtained by an innovative cluster strategy that combined Ward's hierarchical clustering with a partitioning method. The cluster groups differed on racial composition and DSM-III Axis II diagnoses. The lack of differences among the cluster groups on other clinically relevant variables may be due to the choice of measures and the homogeneous nature of the sample. Two-point code frequencies are presented for these 340 profiles. Demographic variables available on 434 subjects suggested considerable similarities b

North Carolina resident psychiatrists knowledge of the commitment statutes: do they stray from the legal standard in the hypothetical application of involuntary commitment criteria?

Objectives are to examine North Carolina (NC) resident psychiatrists knowledge of commitment statutes and their willingness to involuntarily admit hypothetical patients who do not meet statutory criteria. It is hypothesized that the need for transportation may be a salient factor. In one vignette the patient had schizophrenia and the other alcohol dependence. The respondents were asked to make a decision about commitment and to rate how 9 specified factors affected their decision. Sixty-one residents responded. Thirty percent answered incorrectly about statutory provisions for 'mental illness'

[Changing Forensic Mental Health in France: A Review].

This article describes the background and recent changes in French forensic mental health. The literature suggests that three law reforms have been crucial to changes in the mental health system. First, the Penal Code of 1992 redefined the provisions of criminal responsibility and introduced the category of diminished responsibility. Second, a controversial law for preventive detention (rétention de sûretê) was enacted in 2008, according to which criminals with severe personality disorders are subject to incarceration even after the completion of their prison sentences if they are still consid

Assaults by Mentally Disordered Offenders in Prison: Equity and Equivalence.

Managing the violent behaviour of mentally disordered offenders (MDO) is challenging in all jurisdictions. We describe the ethical framework and practical management of MDOs in England and Wales in the context of the move to equivalence of healthcare between hospital and prison. We consider the similarities and differences between prison and hospital management of the violent and challenging behaviours of MDOs. We argue that both types of institution can learn from each other and that equivalence of care should extend to equivalence of criminal proceedings in court and prisons for MDOs. We arg

[Suicide by a borderline patient at the end of fatal self-destructive behavior].

The presence of a borderline personality disorder must also be considered in forensic medicine appraisements, beside the various motivations for a self injurious behaviour and apart from other psychiatric illnesses. This personality disorder is frequently characterized by cuts and scratches made by the patients using sharp objects to inflict themselves when in situations causing great psychological distress. A case of a young female student is presented who exhibited a clear auto-destructive behaviour. Due to a tragic psychodynamic development, she committed suicide by means of carbamazepine i

Use of the Michigan Alcoholism Screening Test in a prison hospital.

The Michigan Alcoholism Screening Test (MAST) was administered to 214 admissions to a maximum security ward of a prison hospital. Over 70.7% of the patients had scores greater than 5 and 57.8% had scores greater than 10, indicating that they engaged in problem drinking or alcohol misuse before admission. Older patients had higher scores, and a small number of patients with no criminal involvement had lower scores.

Suicide by asphyxiation due to helium inhalation.

Suicide by asphyxiation using helium is the most widely-promoted method of "self-deliverance" by right-to-die advocates. However, little is known about persons committing such suicides or the circumstances and manner in which they are completed. Prior reports of suicides by asphyxiation involving helium were reviewed and deaths determined by the North Carolina Office of the Chief Medical Examiner to be helium-associated asphyxial suicides occurring between January 1, 2000 and December 31, 2008 were included in a new case series examined in this article. The 10 asphyxial suicides involving heli

Mental illness and the late Victorians: a study of patients admitted to three asylums in York, 1880-1884.

The case histories of the patients newly admitted to the Retreat Asylum in York between 1880-1884 were examined. Most patients were aged under 50 years, single and non-Quaker, and a majority satisfied the Research Diagnostic Criteria for a diagnosis of schizophrenia or affective disorder. It was found that 72.9% of the patients were deluded, the most common delusions being of persecution, grandeur and guilt; in 34.9% of the deluded patients, the delusion had a religious content. Suicidal ideation was recorded in the case records of 31.4% of the patients. Drug therapy was commonly prescribed, a

[A mistake in forensic psychiatric evaluation or abuse of psychiatry for non-medical purposes - a case report].

In this study we attempted to visualize certain irregularities that took place in the evaluation of a patient with personality disorders performed by psychiatrist expert witness, which resulted in an incorrect diagnosis, leading to wrong ruling of the court and a referral of the patient to clinical therapy lasting six years. The psychiatric and psychological expert opinions submitted to the court and first-hand psychiatric and psychological examination of the patient were analyzed. Efforts were made to show that the failure to comply with the diagnostic criteria in the process of diagnosis and

At the margins of human rights and psychiatric care in North America.

The roots and expanse of the rights of psychiatric patients in North America are broad and diverse. This paper focuses on four rights that are pushing at the contemporary margins of patients' rights. First, the right to treatment, a moral position casting about for legal grounding. Second, the rights of psychiatrically hospitalized patients, articulated in statutes, court decisions, organizational standards and patients' bills of right. Third, patient participation in treatment planning, a process involving both rights and responsibilities. Fourth, the right to involuntary outpatient treatment
