Civil commitment practices in 1977: troubled semantics and/or troubled psychiatry.

This paper examines the practice of involuntary mental hospitalization through examination of criteria used for committment in a sample of 200 civil commitment certificates. Special reference is made, following previous research, to criteria used to describe the person deemed dangerous to himself or to others. The relevance of the findings of present practices in mental health is discussed. New procedures which facilitate presentation of factual evidence, and which eliminate gratuitous information, are required without delay.

Assessment of the criminal recidivism among individuals with mental disorders.

Epidemiological studies conducted in various regions through the world point to an increased risk of violence among individuals with mental disorders. Violent behaviour occurs in a certain social system that involves a whole person with a certain history of life, with a certain state of health or disease, and interaction with other socal circumastances. There are different methods of risk assessment, but basically two broad categories of methods determine assessment of the risk: clinical and statistical. The main purpose of the investigation is by using the statistical scale to determine risk

[Forensic-Psychiatric Consultations in General Psychiatry - Supporting Treatment of Patients Prone to Commit Violence].

A subgroup of psychiatric patients are at increased risk of committing interpersonal violence, which may lead to placements in forensic-psychiatric institutions. The majority of patients treated in forensic hospitals have had contact with the general psychiatric care system years before being forensically committed due to an offence. Nevertheless, attempts to establish models related to violence prevention in general psychiatry have remained sparse. In the Canton of Zurich, the forensic psychiatric consultation liaison service provides the general psychiatric clinics with access to forensic ps

Aspects of Mental Health Act 1990 in New South Wales Australia.

The Mental Health Act 1990 replaced the 1958 Act and brought in many innovations which will be discussed. Mental illness is now defined therein but to be mentally ill under the Act additional criteria of being a danger to oneself or others has to be fulfilled. As a result many patients who are obviously suffering from a mental illness but not posing a danger cannot be compulsorily detained in hospitals and treated, much to the frustration of doctors, other staff and carers. The legislators had the view that a person has the right to go silently mad. Obviously such patients will not admit thems

Medication refusal and the rehospitalized mentally ill inmate.

Records of all inmates committed to a state forensic hospital in fiscal year 1982 (N = 472) were studied to examine the inmates' hospital utilization between September 1977 and April 1984 and the reasons for their admissions. Medication refusal, hallucinations and delusions, and threatened or potential violent behavior toward others were the most frequently documented reasons for admission. Medication refusal was associated with a greater number of hospitalizations, shorter hospitalizations, diagnoses of paranoid schizophrenia or schizophreniform disorders, longer prison sentences, and convict

Updating Winterwerp with Rooman to add a requirement for 'Real therapeutic measures' to legal criteria for admission without consent in psychiatry.

Admission without consent and treatment without consent are topics of prolonged discussion throughout the history of psychiatry. These practices raise significant issues pertaining to human rights to liberty, bodily integrity, and treatment. Balancing rights is always challenging, especially when people lack decision-making capacity owing to the impact of mental illness. In 1979, the European Court of Human Rights outlined criteria required to justify lawful admission without consent owing to mental disorder in Winterwerp v. the Netherlands. These criteria were: (a) a competent national author

Differentiating Between Sexual Offending and Violent Non-sexual Offending in Men With Schizophrenia Spectrum Disorders Using Machine Learning.

Forensic psychiatric populations commonly contain a subset of persons with schizophrenia spectrum disorders (SSD) who have committed sex offenses. A comprehensive delineation of the features that distinguish persons with SSD who have committed sex offenses from persons with SSD who have committed violent non-sex offenses could be relevant to the development of differentiated risk assessment, risk management and treatment approaches. This analysis included the patient records of 296 men with SSD convicted of at least one sex and/or violent offense who were admitted to the Centre for Inpatient F

Evaluation of the Brief Psychopathological Rating Scale in relation to aggressive behavior by acute involuntarily admitted patients.

Aggressive behavior during acute involuntary admission was related to ratings on the Brief Psychopathological Rating Scale, age, sex and global assessment in 38 patients. The best prediction model of aggressive behavior was achieved when predicting more serious incidents occurring during the first 8 days of admission. In this prediction model, high scores of hostility and anxiety, together with low scores of grandiosity significantly and accurately predicted more serious violent behavior.

Race, History of Abuse, and Homelessness Are Associated With Forced Medication Administration During Psychiatric Inpatient Care.

OBJECTIVE: Although previous research has suggested that racial disparities exist in the administration of forced medication (FM) in psychiatric inpatients, data remain scarce regarding other contributing variables. Therefore, this study examined sociodemographic and clinical variables associated with FM administration in psychiatric inpatients. METHODS: Electronic medical records from 57,615 patients admitted to an academic psychiatric hospital between 2010 and 2018 were reviewed to identify patients who received FM. These records indicated that FM petitions were requested and approved for ∼

A clinical study of violence in patients referred on a Form I to a general hospital psychiatric unit.

A retrospective examination of all patients referred by the emergency department of a medium sized general hospital for a mandated Form I psychiatric assessment during a 12 month period was conducted. The principal aim was an analysis of the clinical phenomena and especially the antecedents and course of violent behaviour (following admission and throughout the hospital stay) which in the majority of cases was the reason for the referral. Thirty percent had behaved violently prior to admission but within 24 hours all had settled and during the remainder of their hospital stay were indistinguis

Reviving Ulysses contracts.

Ulysses contracts have faced paternalism objections since they first were proposed. Since the contracts are designed to override a present request from a legally competent patient in favor of a past request made by that patient, enforcement of these contracts was argued to be unjustifiable strong paternalism. Recent legal developments and new theories of practical reasoning suggest that the discussion of Ulysses contracts should be revived. This paper argues that with a proper understanding of the future-directed planning embodied in Ulysses contracts, the charge of strong paternalism can be a

Dual harm: Violent behaviour to others and self-harm behaviour in adults compulsorily admitted to a Dutch psychiatric hospital.

BACKGROUND: Verbal and physical violence in psychiatric hospitals can have harmful consequences for staff members, such as physical injury, traumatisation, and sick leave, and they often accompany involuntary admission. Harm to others may co-occur with self-harm, i.e., dual harm. However, little is known about the association between dual-harm and violent behaviour towards staff members and its clinical outcomes, such as seclusion and rapid tranquilisation after involuntary admission to a psychiatric inpatient unit. METHOD: A convenience sample of patients admitted involuntarily (N = 384; mea

Psychiatric emergencies.

Psychiatric disorders are common in medical inpatient and outpatient populations. As a result, internists commonly are the first to see psychiatric emergencies. As with all medical problems, a good history, including a collateral history from relatives and friends, physical and mental status examination, and appropriate laboratory tests help establish a preliminary diagnosis and treatment plan. Patients with suicidal ideation usually have multiple stressors in the environment and/or a psychiatric disorder (i.e., a major affective disorder, dysthymic disorder, anxiety or panic disorder, psychot

[Human dignity as foundation of an ethics in psychiatry].

Psychiatry is distinguished from other fields of medical expertise and bears a particular kind of responsibility, namely the treatment of persons incapable of informed consent per se. The History of psychiatry shows that much too often inhuman abuse was happening in psychiatric facilities. An ethics of psychiatry therefore requires a reliable and stable foundation for values that allow justifying normative claims embracing both characteristics. Such a basic foundation already exists in form of the pluralistic and international recognition of human dignity. We argue that human dignity does and

Recalibrating deprivation of liberty: The Supreme Court, Article 5 ECHR and the Mental Capacity Act (Northern Ireland) 2016.

The Supreme Court's decision in Reference by the Attorney General for Northern Ireland [2026] UKSC 16 represents the most significant development in deprivation of liberty jurisprudence since P v Cheshire West and Chester Council; P and Q v Surrey County Council [2014] UKSC 19. Whilst the proceedings arose from a challenge to proposed revisions to the Northern Ireland Deprivation of Liberty Safeguards (DoLS) Code of Practice under the Mental Capacity Act (Northern Ireland) 2016 (MCA (NI) 2016), the judgment extends considerably beyond the issue of consent that formed the basis of the Attorney
