Trial and error in my quest to be a partner in my health care: a patient's story.

A fearful stranger to the healthcare sector when she became a frequent user 2 years ago, Goeltz clearly is now a sophisticated and creative partner. She is fully engaged in decision-making and holds the decisions made as her own. Physicians often worry that their patients don't fully consent to the treatment given them because they don't fully understand the risks. This is often a factor in malpractice litigation. Goeltz's healers don't have that worry. When it comes to the complicated process of treatment, Goeltz doesn't take for granted that the system will operate optimally and holds hersel…

Morbidity and mortality from pharmacosedation and general anesthesia in the dental office.

Morbidity and mortality (M&M) statistics have been used to determine the safety of pharmacosedation and general anesthesia for dental procedures. Although relevant, these data often do not describe what actually caused the problems. Descriptive data are needed to understand etiologic factors and to accurately set malpractice insurance rates, establish legislative regulations, and determine means of prevention. The purpose of this study was to characterize the factors involved in causing M&M in a national data base of dental patients who received either pharmacosedation or general anesthesia. L…

Tort Immunity and Nursing Home Staffing.

IMPORTANCE: A central goal of medical malpractice law is to ensure quality of care by deterring negligent treatment. Although previous research has produced mixed results, much of it finds no clear association between liability exposure and medical treatment. During the COVID-19 pandemic, many states adopted immunity from tort liability for harms to nursing home residents, creating a natural experiment. OBJECTIVE: To examine the association between immunity from tort liability and nursing home staffing. DESIGN, SETTING, AND PARTICIPANTS: This cohort study using a difference-in-differences mo…

Trends and contributing factors in medicolegal cases involving cranial surgery in Canada.

OBJECTIVE: Neurosurgery is a high-risk specialty with a low margin of error, and neurosurgeons have a higher medicolegal risk than practitioners in many other specialties. The aim of this study was to provide a current medicolegal landscape of cranial surgery in Canada. METHODS: In this retrospective descriptive study, the authors evaluated 10 years (2012-2021) of cranial neurosurgical data on closed legal actions, medical regulatory authority (College) cases, and hospital complaints against neurosurgeons that had been submitted to the Canadian Medical Protective Association (CMPA). Only cran

Ten years of clinical negligence claims in otolaryngology: trends, costs, and preventable harm in the UK national health service.

PURPOSE: Litigation across surgical specialties is rising amidst increasing pressures on the United Kingdom's National Health Service (NHS). However, national litigation trends in otolaryngology, particularly following the COVID-19 pandemic, remain underexplored. This study aimed to analyse NHS litigation data in otolaryngology over the past decade, assessing the pandemic's impact on claim volumes and costs. Our secondary objective was to identify key areas of concern in patient care. METHODS: National-level anonymised negligence claims data for the financial years 2013/14 to 2023/24 were obt

Litigation related to intrapartum fetal surveillance.

The role of intrapartum care including cardiotocography (CTG) monitoring in cases of perinatal neurological injury receives considerable debate in both clinical and medicolegal settings. The debate, however, has distracted attention from fundamental questions about the timing, mechanism, and preventability of perinatal injury. CTG tracings are used as a surrogate for asphyxia with the timing of intervention ("rescue") predicated on the presumed severity of asphyxia. Using CTG in this way has prevented intrapartum stillbirth, but it has not reduced the long-term injury in part, because, contrar

EMTALA and patients with psychiatric emergencies: a review of relevant case law.

STUDY OBJECTIVE: Emergency department (ED) care for patients with psychiatric complaints has become increasingly challenging given recent nationwide declines in available inpatient psychiatric beds. This creates pressure to manage psychiatric patients in the ED or as outpatients and may place providers and institutions at risk for liability under the Emergency Medical Treatment and Labor Act (EMTALA). We describe the patient characteristics, disposition, and legal outcomes of EMTALA cases involving patients with psychiatric complaints. METHODS: Jury verdicts, settlements, and other litigation

Incidents of catastrophic overhydration (maternal and neonatal) identified through medico-legal reviews.

The authors describe two incidents where a mother postpartum and a neonate in the nursery were grossly overhydrated in tertiary care medical centers. In the first case, while receiving intensive care for HELLP (hemolysis, elevated liver enzymes and low platelets) syndrome, involving the participation of eight specialists and subspecialists, the weight of the mother increased by 54% between the 2nd and 8th postpartum days. In the second case, between the time of his birth and his demise 13 days later, the weight of the newborn child increased by 67%. In neither of these cases, was the significa

[Laryngopharyngeal morbidity following general anaesthesia. Anaesthesiological and laryngological aspects].

Laryngeal and pharyngeal complaints are among the subjective problems most frequently reported by patients after general anaesthesia involving endotracheal intubation, others being pain, nausea and vomiting. Hoarseness, sore throat, and vocal cord injuries restrict patients' social lives, and in some cases also their working lives. The most frequent types of laryngeal injury are swollen mucosa and haematoma of the vocal cords. Vocal cord paralysis occurs much less frequently. Knowledge of the pathophysiological aspects and other relevant factors associated with laryngopharyngeal morbidity are

Death during or following surgical procedure and the allegation of medical negligence: an overview.

A great variety of mishaps can occur during or following the administration of anesthesia and operative or investigational procedures that do not necessarily convey an error of judgment or negligence on the part of the surgeon or the anesthetist. However, all deaths occurring during the course of anesthesia and surgery or within a reasonable period thereafter (commonly referred to as peri-operative period) have to be reported to the police as these deaths cannot be regarded as natural. Despite the death occurring due to some preexisting disease or some co-existent condition, there may be a ten

Some aspects of wave aberrations of the human eye and supervision: a review.

Supervision is defined by a visual acuity of 20/10 or 20/8 and may be attained by custom-correcting the aberrations of higher order of the human eye. Higher order aberrations are those aberrations which are left in the eye after having corrected lower order aberrations, i.e., defocus (myopia, hypermetropia) regular astigmatism, and which can be corrected by ordinary spectacle lenses or contact lenses. Higher order aberrations are found to a higher or lesser degree in normal or pathological human eyes and in eyes having undergone conventional corneal surgery. According to custom keratorefractiv

The potential pitfalls of ear syringing. Minimising the risks.

Case histories are based on actual medical negligence claims. However, certain facts have been omitted or changed by the author to ensure the anonymity of the parties involved. Ear syringing is a common procedure performed in general practice. It has been estimated that major complications occur in 1 in 1000 ears syringed. This article discusses the common complications of ear syringing and provides some tips on how to minimise the possibility of a complication and claim arising from this procedure.
