[Forensic evaluation of injuries to nerves and jaw bone after wisdom tooth extraction from the viewpoint of current jurisprudence].

The removal of lower wisdom teeth is one of the most frequent operations in oral surgery. Iatrogenic lesions of the lingual and inferior alveolar nerve and fractures of the lower jaw are rare, but can lead to actions for damage and compensation for personal suffering. The aim of our investigation was to elaborate recommendations for the oral surgeon from the legal point of view. Therefore we investigated in two data banks all court decisions concerning wisdom teeth and analysed them in regard to the obligation to provide information, documentation and the minimum requirements of the surgical t

Is childbirth safe in the UK and are there enough obstetricians? Letter to a chief executive.

If you are at term after a normal pregnancy and are not lucky enough to live in Portsmouth, then your chance of losing the baby during labour is higher in Great Britain than in nine other European countries, including Slovenia. The NHS Litigation Authority have put aside 1.3 billion Pounds for the next 5 years to cover litigation relating to cases of cerebral palsy, the majority of which will occur in GP- and midwife-led units. The European work directive will severely restrict staff grade and consultant hours of work over the next few years and this can only be made up by appointing more cons

[Incidence and etiology of brachial plexus upper arm paralysis in newborn infants. A review and basic principles for legal assessment].

OBJECTIVE: Brachial plexus injury (BPI) is a rare complication of pregnancy which is out of proportion involved in medical litigation. The aim of this study was to establish the relationship between shoulder dystocia (SD) and BPI and the frequency of BPI without explanation. METHOD: The pertinent literature was reviewed. In total 86 papers of the international literature were evaluated in regard to the frequency of SD and BPI and their relationship. Also BPI without obstetrical explanation were of interest (birth weight < 4000 g, cesarian section, palsies without SD). CONCLUSIONS: This liter

Retinal detachments and topical ocular miotics.

There is increasing suspicion that topical ocular miotic therapy in selected persons may precipitate retinal detachments. This is a rare event and probably does not occur in patients free of retinal pathology. Data supporting a possible cause and effect relationship, obtained from the National Registry of Drug-Induced Ocular Side Effects, a survey of the Retina Society, medicolegal decisions, and a review of the literature, is presented.

[Perforation of the right ventricle by a central venous catheter (author's transl)].

Two letal iatrogenic cardiac perforations by a subclavian catheter are reported. The cause of this rare but most serious complication is based on the sliding down of a subclavian catheter left in for 9 days in one case, in the other one on the introduction of a polyvinyl-catheter into the right ventricle.

Chorioamnionitis in intrauterine fetal death: A forensic histopathological case study.

INTRODUCTION: Acute chorioamnionitis is a placental inflammatory condition often implicated in adverse pregnancy outcomes, including intrauterine death. The histopathological identification of maternal and fetal inflammatory responses (MIR and FIR) is critical for diagnosis and understanding potential causal mechanisms. Chorioamnionitis frequently warrants medico-legal investigation, particularly for suspected medical malpractice. MATERIAL AND METHODS: Two forensic cases of intrauterine fetal death with histological finding of acute chorioamnionitis are presented. Each case has been investiga…

Non-anatomical MPFL reconstruction and failure to address relevant pathologies are common reasons for treatment injuries following treatment for patellofemoral instability.

PURPOSE: Management of patellofemoral instability (PFI) tailored to the individual patoanatomy can be complex with potential pitfalls. Howev … RESULTS: There were 405 eligible claims. The most frequent cause of treatment injury was surgical malpractice (38%), particularly incorrect femoral graft placement in medial patellar-femoral ligament reconstruction, which accounted for nearly half of these cases. Failure to adequately evaluate or treat anatomical risk factors (20%) often resulted in additio …
