Medico-legal considerations and operative vaginal delivery.

Women undergo operative vaginal delivery (OVD) as an alternative to caesarean section when complications arise in the second stage of labour. The perinatal mortality associated with OVD is very low, and most of the perinatal morbidity is minor. However, when serious adverse events occur, such as traumatic birth injury, shoulder dystocia, cerebral palsy and perinatal death, there are medico-legal implications. There is also the potential for litigation in relation to maternal pelvic floor injury, which is increased with OVD. Obstetricians performing and supervising OVDs need to be aware of the

[Case report: Iatrogenic shoulder pain syndrome following spinal accessory nerve injury during lateral cervical neck dissection for tongue cancer: the role of rehabilitation and ethical-deontological issues].

The shoulder pain syndrome is the most frequent complication of lateral cervical neck dissection and may be caused by iatrogenic injury to the spinal accessory nerve, causing pain and functional limitation of the upper limb and of the cervical spine. Interdisciplinary collaboration and early rehabilitation can reduce the consequences of disability and the possible issues that can arise due to inadequate management of the problem.

Cosmetic surgery in Australia: a risky business?

Cosmetic surgery is increasing in popularity in Australia and New Zealand, as it is across other Western countries. However, there is no systematic mechanism for gathering data about cosmetic surgery, nor about the outcomes of that surgery. This column argues that the business of cosmetic surgery in Australia has questionable marketing standards, is conducted with little scrutiny or accountability and offers patients imperfect knowledge about cosmetic procedures. It also argues that while medical practitioners debate among themselves over who should carry out cosmetic procedures, little attent

Risk management strategies following analysis of cataract negligence claims.

INTRODUCTION: Clinical governance and risk management is very important in today's clinical practice. Cataract surgery is one of the most common procedures performed in the NHS, with around 200,000 operations per year. In order to help minimise the frequency of negligence claims, we performed a collaborative study to analyse claims relating to cataract surgery, dealt with by the defence organisations of England, Scotland, Wales, and Northern Ireland. MATERIALS AND METHODS: All claims dealt with by the Medical Defence Union, the Medical Protection Society, and the Medical and Dental Defence Un

Medicolegal considerations in the diagnosis of breast cancer.

From the standpoint of the obstetrician, gynecologist, failure to diagnose breast cancer is a significant medicolegal issue in terms of the number of claims initiated and the indemnity awards paid to successful plaintiffs. The incidence of breast cancer may continue to increase. Without quality care and good risk management on the part or health care providers, claims for failure to diagnose cancer in a timely manner will also increase. The challenge for the health care provider is to formulate a plan that promotes early detection and treatment while allowing for independent clinical judgment.

[Complaints by complainers?].

For Dutch physicians being sued is one of their worst nightmares in professional life. Dutch dentists as a group do not seem to bother. This article shows that the light-heartedness of the dental profession is incorrect. A Dutch dentist has the same reason for being worried about the chance of facing a (disciplinary) council, about the procedure and about (disciplinary) measures as Dutch physicians have. For dentists who actually had to face a disciplinary council, their experience was very frightening and affected their professional satisfaction. Knowledge of public health legislation and a b

[Complications in laparoscopy--what can we learn by experiences?].

Complications after laparoscopic procedures in gynecological and surgical clinics were discussed at a symposium held in Stockholm in September of 2000. According to official and professional records the number of laparoscopic operations has increased, especially in surgical clinics. Although this technique entails many advantages for patients, it is accompanied by an increase in the number of complications, some of which are not seen in open surgery. About ten injuries to vessels in the abdominal wall or the abdominal cavity, leading to major bleeding, occur yearly in the course of insertion o
