Contraception failure and wrongful birth claims.

Case histories are based on actual medical negligence claims, however, certain facts have been omitted or changed by the author to ensure the anonymity of the parties involved. Medical negligence claims involving an allegation or 'wrongful birth' can arise from a negligent failure of contraception. In these wrongful birth claims, the patient sues the medical practitioner who failed to prevent her conception and subsequent pregnancy. This article outlines some risk management strategies for general practitioners to minimise the possibility of a claim arising from a failure of contraception invo

Chappel v Hart: the High Court considers causation of damage from a surgeon's negligent failure to warn.

In Chappel v Hart, the High Court upheld the decision of the Supreme Court of New South Wales that a surgeon was liable for failing to warn a patient of a previously unreported complication of a procedure. The patient, if properly warned, would have had the operation at another time, probably with a more experienced surgeon. The decision has important implications for doctors when advising patients of the risks of surgery.

Shoulder dystocia.

Shoulder dystocia is an infrequent and unexpected emergency requiring rapid and deft solution. Identifiable risk factors include maternal diabetes, fetal macrosomia (especially in the presence of diabetes), and maternal history of previous delivery of a large infant. Other reported risk factors include arrest and protraction disorders of labor and midpelvic operative delivery; however, more than 50% of shoulder dystocia occurs in instances without identifiable risk factors, and permanent neonatal injury is thus unpredictable. Therefore, all personnel in the delivery suite must be well versed i

Medicolegal analysis of bile duct injury during open cholecystectomy and abdominal surgery.

To understand the medicolegal impact of bile duct injury, we analyzed 68 cases of biliary injury resulting from open cholecystectomy and abdominal surgery. Cases were litigated within the US civil justice system between 1970 and 1991. Operations resulting in bile duct complications included cholecystectomy for cholelithiasis in 49 patients (72%), common bile duct exploration in 5 patients (7%), and other abdominal operations in 7 patients (10%); 7 operations were of unknown type. The average delay in recognition of injury was 16 days (range 3 to 42). The mortality rate was 18% (12 of 68). Medi

Closed Claims Analysis of Data for Ambulatory Anesthesia.

Ambulatory anesthesia has grown rapidly, encompassing more complex procedures and higher-risk patients. Analysis of closed claims reveals that while major complications and mortality remain rare, moderate injuries such as dental trauma, nerve damage, and communication-related issues are frequent and remained largely stable in frequency over the past decade. Patient comorbidities-including obesity, obstructive sleep apnea, and diabetes-significantly increase perioperative risks. Improving patient safety in this setting depends on careful risk assessment, multimodal analgesia, opioid-sparing tec
