Controlling for Confirmation Bias in Child Sexual Abuse Interviews.

Confirmation bias is one of the most important sources of error in clinical assessment and clinical judgment. There has been little scholarship on the role of confirmation bias in forensic interviews with children who may have been abused sexually. This article reviews relevant research and explores the possible role of confirmation bias in forensic interviews. Confirmation bias may come into play because these interviews usually are conducted under the auspices of one side of the adversarial judicial system, the prosecution. In addition, the existing forensic interview protocols have paid lit

Medieval and early modern theories of mental illness.

Historians of medieval and early modern psychiatry have utilized limited source materials in their research. They have focused on printed works, particularly formal treatises by celebrated authors, and neglected manuscript collections. The resulting histories depict early European psychiatric thought as dominated by demonology. Examination of the archives of an early English legal incompetency jurisdiction flatly contradicts this picture. Starting in the 13th century, the English government conducted mental status examinations of psychiatrically disabled individuals, using commonsense, natural

Geriatrics and the Legal System.

Correctional systems, already struggling to meet the basic and functional requirements of older prisoners, will be further challenged by the increasing medical and psychiatric needs of this population. Mental health and general medical care for older adults requires specific on-site or consultation expertise in geriatric medicine and psychiatry, as well as potential changes in infrastructure, both of which may be prohibitively expensive. However, compassionate and effective treatment of older prisoners requires that prison and legal systems facilitate this expert care. To address this situatio

Assessing the role of mega cisterna magna in criminal responsibility: implications for neurocognitive disorders in forensic evaluations.

This article explores the intersection of neurocognitive disorders and criminal behavior, highlighting the significant role of conditions such as traumatic brain injury (TBI), substance misuse, and neurodegenerative diseases in cognitive decline and associated criminal activities. We present three case studies of patients with mega cisterna magna diagnosed through imaging, discussing their legal proceedings and the impact of their cognitive impairments on criminal responsibility. The study underscores the prevalence of neurocognitive disorders among incarcerated and psychiatrically assessed in

Competency for military arrest as a psychiatric problem.

Military law does not invest doctors with the authority to determine whether a soldier is competent to enter military arrest. This determination is legal in nature. Therefore, medical (or psychiatric) examination which is carried out before or within military arrest or detention, is aimed at preventing deterioration in the health of the soldier in prison. Hence, medical opinion serves only as 'credentials' of sorts. This is the formal language of the military law. In reality, the examining psychiatrist has to consider many factors, bearing in mind that his conclusions will probably become a pr

Prospective cohort study of the evaluation of patient benefit from the redevelopment of a complete national forensic mental health service: the Dundrum Forensic Redevelopment Evaluation Study (D-FOREST) protocol.

INTRODUCTION: Secure forensic mental health services are low volume, high cost services. They offer care and treatment to mentally disordered offenders who pose a high risk of serious violence to others. It is therefore incumbent on these services to systematically evaluate the outcomes of the care and treatment they deliver to ensure patient benefit in multiple domains. These should include physical and mental health outcomes, as well as offending related outcomes. The aim of Dundrum Forensic Redevelopment Evaluation Study (D-FOREST) is to complete a structured evaluation study of a complete

Forensic assertive community treatment: an emerging best practice.

People with serious mental illness (SMI) are over-represented throughout the US criminal justice system. To address this issue, forensic assertive community treatment has recently emerged as a best-practice intervention. Also known as forensic ACT, ForACT, or most commonly as "FACT," forensic assertive community treatment is an adaptation of the assertive community treatment (ACT) model. Unlike ACT, however, FACT is purposefully designed to prevent arrest and incarceration among people with SMI who have histories of involvement with the criminal justice system (i.e., "justice-involved" individ

An Affordances-Based Approach and Scoping Review of Virtual Reality Applications in Forensic Behavioral and Mental Health Assessment and Treatment.

Immersive Virtual Reality (VR) offers plentiful opportunities for behavioral and mental health assessment and treatment, such as overcoming spatial restrictions, increasing treatment motivation, and reducing participant risk. We examine these opportunities through the lens of 'affordances', which refers to the specific possibilities a technology offers when users interact with it. This lens provides a frame of reference that can help researchers better understand and exploit the opportunities VR offers for the design of assessments and treatments, boost their effectiveness, and provide a share

Forensic Psychiatric Patients' Experiences of Personal Recovery: A Wilsonian Concept Analysis.

Psychiatric patients' recovery processes have been studied rather extensively, and a relatively clear consensus on what recovery is already exists. We examined whether the personal recovery of forensic psychiatric patients varies from this definition. We conducted a concept analysis to assess the personal recovery of patients in forensic psychiatric hospitals based on 21 articles and then evaluated how our results compared with existing definitions on psychiatric and forensic recovery. On the basis of this comparison, we concluded that the personal recovery of forensic psychiatric patients doe

Personality disorders and violence potential.

Violence associated with personality disorders is usually best viewed separately from psychiatric diagnosis, as a syndrome of violence rather than a syndrome of diagnosis. The authors describe eight categories of violence associated with personality disorders that may help clinicians choose treatment or management techniques: purposeful, instrumental violence; purposeful, non-instrumental violence; purposeful, targeted, defensive violence; targeted, impulsive violence; nontargeted, impulsive violence incidental to emotional escape; random but purposeful violence; violence related to perceived

Forensic psychiatric examinations: competency.

The many definitions of competency in civil, criminal, and domestic relations law are discussed with emphasis on the various legal criteria for competency and the different classes of psychiatric information required to apply the criteria to a given case. Within the context of a general discussion of forensic examinations, techniques for gathering the right kind of information are systematically related to the exigencies of evaluating past, present, or future mental states by selectively altering the focus of mental status evaluations and history-taking. In addition, special investigative tech

Investigating the phenomenon of overkill in Greece: A forensic psychiatric autopsy study between 2005 and 2020.

The purpose of this study was to investigate overkill in the Greek population from a criminological and victimological point of view and explore possible correlations of the phenomenon with socio-cultural or psychiatric factors. Overall, 158 autopsies of overkill victims were identified throughout the 15-year records of the national forensic laboratories throughout the northern Greek mainland. The pattern that has emerged from the statistical results of the present study on the victims of overkill within the Greek borders was generally in line with global statistics on homicide victims, but al
