METHODS: Two large medicolegal databases-Westlaw Edge and VerdictSearch-were queried using the term "arthroscopy." Cases were reviewed and classified according to the nature of the plaintiff's complaint. Cases were only included if the primary basis of litigation rested on a malpractice claim related to arthroscopy. Data collected included reason for litigation, verdict ruling, location, monetary award, and joint involved. Pearson chi-squared test was used to as

Testicular torsion is overrepresented among malpractice cases for gonadal torsion.

INTRODUCTION & OBJECTIVE: Ovarian and testicular torsion are comparable surgical emergencies that may result in organ loss and, as such, have high litigious potential. We sought to describe the relative frequency and outcome of malpractice litigation between cases of ovarian and testicular torsion. METHODS: Searches were completed in the Westlaw Jury Verdicts & Settlements and Lexis Cases databases using the following search terms: "(ovarian or ovary)/5 torsion" and "(testicular or testicle)/5 torsion". Cases were excluded if they were not directly related to torsion or were not malpractice c

RESULTS: 31 closed cases associated with 40 total claims related to ophthalmic trauma out of 2565 claims (1.56%) in the OMIC database were analysed. 13 o

Medical malpractice in diagnostic radiology: claims, compensation, and patient injury.

The purpose of this study is to provide more information to diagnostic radiologists regarding claims, compensation, and patient injury in medical malpractice cases. Malpractice cases filed against the U.S. government were reviewed. The most common claim was misdiagnosis of a malignancy (30% of the cases); in these cases the claimants received relatively high compensation. Most of these cases involved failure to diagnose lung carcinomas on chest radiographs and failure to diagnose colon carcinomas on barium enema studies. The findings emphasize the importance of having the members of a radiolog

Patient Compensation Funds: legislative responses to the medical malpractice crisis.

Fifteen states have created Patient Compensation Funds in response to the increased cost and reduced availability of medical malpractice insurance associated with the so-called "medical malpractice crisis." Patient Compensation Fund statutes limit health care providers' liability to a specified amount, and establish state-administered funds to compensate victorious malpractice plaintiffs for damage awards in excess of that amount. This Note examines the Patient Compensation Fund mechanism, evaluates its effectiveness as a compensation system for malpractice victims, and recommends particular p

Let's Be Honest: These Medical Malpractice Cases Were a Pain in the Back.

INTRODUCTION: This series reviews three cases of back pain where a highly morbid diagnosis was missed by an emergency physician and subsequently successfully litigated. CASE REPORT: We review the clinical entities of spinal epidural abscess and cauda equina syndrome, challenging diagnoses that can be easily missed and lead to patient harm if not treated promptly. Here we offer suggestions for recognizing these conditions quickly, performing an adequate history and exam, and using documentation to support decision-making. CONCLUSION: When confronted with an unfortunate medical outcome, mainta

An analysis of malpractice litigation in the surgical management of carotid artery disease.

OBJECTIVE: Carotid artery disease is a common illness that can pose a significant risk if left untreated. Treatment via carotid endarterectomy (CEA) or carotid artery stenting (CAS) can also lead to complications. Given the risk of adverse events related to treating, or failing to treat, carotid artery disease, this is a possible area for litigation. The aim of this review is to provide an overview of the medicolegal factors involved in treating patients suffering carotid artery disease and to compare litigation related to CEA and CAS. METHODS: Three large legal databases were used to search

Occlusion and temporomandibular disorders: a malpractice case with medical legal considerations.

Occlusion and temporomandibular The issue of temporomandibular disorders (TMD) diagnosis and treatment has become a matter of increasing interest in the medical legal field in recent years. The old-fashioned theories based on the occlusal paradigm was proven to be erroneous, and clinicians who still provide irreversible treatments to TMD patients have to be conscious of the potential legal consequences of their behavior. The present paper described an illustrative case report of a patient to whom extensive and irreversible occlusal therapies were performed with the unique aim to provide relief
