Despite the growing number of women living with and affected by HIV, there is still insufficient attention to their pregnancy-related needs, rights, decisions and desires in research, policy and programs. We carried out a review of the literature to ascertain the current state of knowledge and highlight areas requiring further attention. We found that contraceptive options for pregnancy prevention by HIV-positive women are insufficient: condoms are not always available or acceptable, and other options are limited by affordability, availability or efficacy. Further, coerced sterilization of wom

This study examines how the criminalization of women's drug use during their reproductive years affects their access to reproductive healthcare, legal treatment, and psychosocial wellbeing. Using a qualitative research design, the study employed semi-structured interviews with women affected by drug-related criminalization, healthcare providers, legal professionals, and policy-related stakeholders in Beijing, Shanghai, and Guangzhou, China. The findings reveal that criminalization functions as a major barrier to timely healthcare access by generating fear, stigma, and mistrust of formal instit

Access to legally permitted abortion depends not only on the legal framework, but also on policy implementation, health system organisation, and professional practices. In Brazil, abortion is legally permitted in specific circumstances, but access remains highly limited. This qualitative study aimed to understand how Primary Health Care (PHC) professionals in São Paulo deal with cases eligible for abortion in everyday practice, focusing on conditions that constrain or enable the realisation of reproductive rights. Thirteen semi-structured interviews were conducted with professionals engaged wi

The HIV and AIDS Act was enacted in India in 2017 to protect the right to privacy, bodily autonomy, and non-discrimination of Persons Living with HIV (PLHIV). Prior to the Act, HIV/AIDS-related jurisprudence in India developed largely through judicial decisions on privacy, health care, queer rights, and marriage. This jurisprudence stigmatised PLHIV and constructed them as threats to society. The Act sought to respond to such characterisations and affirmed several rights of PLHIV that were previously denied. This article uses the reproductive justice framework to analyse the scope and potentia

This commentary analyses the state of legal abortion in Brazil over the past decade, contextualising the increasing restrictions and political disputes surrounding the issue within broader anti-gender offensives. While Brazilian law permits abortion only in limited cases - rape, risk to the pregnant person's life, and anencephaly - access to these rights has been consistently undermined, particularly amid the strengthening of far-right political forces. We explore how moral arguments and conservative discourses - often framed through the notion of "gender ideology" - have been mobilised to rol

International human rights bodies have played a critical role in codifying, setting standards, and monitoring human rights violations in the context of sexual and reproductive health and rights. In recent years, these institutions have developed and applied human rights standards in the more particular context of maternal mortality and morbidity, and have increasingly recognized a critical human rights issue in the provision and experience of care during and after pregnancy, including during childbirth. However, the international human rights standards on mistreatment during facility-based chi

The recent introduction in Italy of unsupervised conjugal visits for prisoners is part of a broader trend that has been well-established across numerous European countries. This provision is grounded in the respect for constitutional rights and the principles set out by the European Court of Human Rights (ECHR), which underscores the centrality of private and family life even for incarcerated individuals. This development raises significant bioethical and medico-legal challenges, which have yet to be fully explored, particularly regarding conception during conjugal visits. The present article

Chapter 3. Human Rights, Gender and Protection of Family and Private LifeThe analysis of the case law gives us the vision of an enlightened reality that is complex and full of nuances. In fact, the European Court of Human Rights has not hesitated to transform in the long term the social, legal and medical vision of transsexualism. However, although the Court remains sensitive to social developments, its approach to the relationship between gender and reproduction remains to a large extent dependent on the margin of appreciation it leaves to States.

In Vietnam, despite the possibility of living healthy sexual lives and bearing children due to the increasing availability of antiretroviral therapy and prevention of mother-to-child transmission services, HIV programming has given little attention to the sexual and reproductive health of people living with HIV. Our study explored factors influencing sexual and reproductive health decision-making, needs, rights and access to services for women living with HIV in Hai Phong and Ho Chi Minh City. Nearly half of the women were sexually active at the time of the study and 15% reported wanting a chi

The Zika virus epidemic and the possible devastating teratogenic effects of the virus represent a challenge. Health authorities have the responsibility to create programs that provide adequate preventive, medical and psychological services to the affected population. The estimated risk of microcephaly in infants of mothers infected with Zika virus is 1 to 13% when the infection occurs in the first trimester of pregnancy. There is insufficient data to estimate the risk of microcephaly when infection occurs in the second or third trimester. Pregnant women and those in reproductive age are advise

The vulnerability of lesbian, gay, bisexual and transgender (LGBT) persons in Africa to public health and other risks is heightened by their exclusion from socio-economic opportunities and services. We analysed existing regional-level legal and policy instruments and treaties for the opportunities they offer to tackle the exclusion of LGBT persons in Africa. We identified seven key living legal and policy instruments, formulated and adopted between 1981 and 2018, by the African Union (AU) or its precursor, the Organization of African Unity. These treaties and instruments do not only highlight

Intersex people and bodies have been considered incapable of integration into society. Medical interventions on often healthy bodies remain the norm, addressing perceived familial and cultural demands, despite concerns about necessity, outcomes, conduct and consent. A global and decentralised intersex movement pursues simple core goals: the rights to bodily autonomy and self-determination, and an end to stigmatisation. The international human rights system is responding with an array of new policy statements from human rights institutions and a handful of national governments recognising the r

Since European settlement, the United States has controlled the reproduction of communities of color through tactics ranging from forced pregnancies, sterilizations, and abortions to immigration policies and policies that separate children from their families. Lesbian, gay, bisexual, transgender, queer (or questioning), asexual, intersex, and gender diverse people (LGBTQIA+) have been persecuted for sexual behavior and gender expression, and also restricted from having children. In response, women of color and LGBTQIA+ communities have organized for Reproductive Justice (RJ) and liberation. Th

Sexual and reproductive health and rights are fundamental to both human and societal wellbeing and sustainable development, and encompass a broad array of sociocultural and clinical issues that affect all people across the life course. In 2018, the Guttmacher-Lancet Commission described sexual and reproductive health as a state of physical, emotional, mental, and social wellbeing in relation to all aspects of sexuality and reproduction, not merely the absence of disease, dysfunction, or infirmity. The Commission advocated for a positive approach to sexuality and reproduction that recognises th

Drawing on 22 in-depth interviews with government officials, civil society leaders, multilateral and community-based actors, we examine how reproductive autonomy is shaped, constrained, and contested within Peru's sexual and reproductive health (SRH) system. The findings point to a cascade of constraints across three levels. At the macro-level, political avoidance, conservative influence, and the enduring legacy of Fujimori-era forced sterilizations have produced sustained silence around SRH, limiting leadership, accountability, and investment. At the meso-level, this silence translates into i

Abortion has been a reality in women's lives since the beginning of recorded history, typically with a high risk of fatal consequences, until the last century when evolutions in the field of medicine, including techniques of safe abortion and effective methods of family planning, could have ended the need to seek unsafe abortion. The context of women's lives globally is an important but often ignored variable, increasingly recognised in evolving human rights especially related to gender and reproduction. International and regional human rights instruments are being invoked where national laws

The February 2016 WHO declaration that congenital Zika virus syndrome constitutes a Public Health Emergency of International Concern reacted to the outbreak of the syndrome in Brazil. Public health emergencies can justify a spectrum of human rights responses, but in Brazil, the emergency exposed prevailing inequities in the national healthcare system. The government's urging to contain the syndrome, which is associated with microcephaly among newborns, is confounded by lack of reproductive health services. Women with low incomes in particular have little access to such health services. The eme

BACKGROUND: Abortion was legalized by the 2002 Muluki Ain to combat the surging rates of maternal mortality and morbidity. By 2021, the Maternal Mortality Rate plummeted to 151 from 539 in 1996. The decline in the abortion-related maternal mortality attributes to the implication of progressive abortion policies that includes expanded safe abortion services introduction of medical abortion, constitutional recognition of abortion, the mandates by Safe Motherhood and Reproductive Health Rights Act, and free-of-cost abortion services in government health facilities. This review study delves into e
