["Psychologic marital unfitness" in cyclothymia? A case report on the topic of the annullment procedure in canon law].

According to the Canon Law (CIC) of the catholic church a marriage can be annulled because of psychological inability under certain conditions. We present the case report of a married woman, who fell ill with cyclothymia after her first childbirth. Her marriage was annulled under canon 1095 (n.3 CIC) because of psychological inability to fulfill martial obligations. The authors believe that this represents a clear cut case of discrimination against patients with mental disorders: on the one hand the catholic church claims that every martial bond is principally indissoluble; on the other hand t

[Prisoners in units for difficult patients].

Prisoners, on remand or convicted, can be placed for a variable amount of time in a unit for difficult patients if their pathological mental state so requires. For the most part, their therapeutic care does not depend on their status as prisoner. The treatments provided are those indicated for their psychological pathologies and their potential or known dangerousness. However, some administrative measures make a distinction between their treatment and that of non-prisoner patients placed in these secure psychiatric units.

Sexual sadism and sadistic personality disorder in sexual homicide.

Controversies exist about the diagnostic validity of sexual sadism and its relation to sadistic personality disorder in sex offenders. The aim of this study was to investigate which diagnostic, developmental, and criminal characteristics differentiate sexual sadistic from non-sadistic sexual homicide perpetrators. Psychiatric court reports on 166 men who had committed a sexual homicide were evaluated regarding psychiatric, sexual and criminal history. Sixty-one offenders (36.7%) with sexual sadism (SeSd) were compared with 105 (63.3%) offenders without this diagnosis (NSeSd). Besides the sexua

[Psychiatric exam under court order apropos of patients who refuse to submit to a psychiatric exam].

In this retrospective study 52 patients who had not committed any offence were examined against their will by Court order in the emergency department of a psychiatric hospital. They were compared with a control group of patients reflecting the usual clientele attending without compulsion the emergency department of the same hospital. This research reveals it is the immediate family rather than medico-social agencies that took the initiative in arranging the Court-ordered psychiatric examination. Such patients were no different than the usual patients seen in the emergency department as to age,

[Compulsory care for a mental incompetent pregnant woman: a case-report].

The compulsory Mental Healthcare Act (Dutch: Wvggz) provides, in exceptional cases, a legal framework for the implementation of psychiatric and somatic treatment without the patients consent. We describe a pregnant patient with a psychotic disorder who was compulsorily admitted to a psychiatric ward and treated with antipsychotic medication. She was unable to give informed consent regarding obstetric care. The care authorization did provide a legal framework for compulsory obstetric care to prevent serious harm for herself and/or her unborn child. A good relationship of trust, frequent counsel

[Exploring the risk factors of reoffending in patients under repeated compulsory treatment].

Introduction: Risk analysis, including the risk of recidivism, is of paramount importance in forensic psychiatry. Objective: The objective of this study is to examine which patterns may indicate an increased risk of recidivism in individuals with mental illness, and to identify factors that may have contributed to repeated court-ordered involuntary treatment. Method: In this retrospective study, authors analyzed the documentation of 301 inpatients, who were discharged from the National Institute of Forensic Psychiatry between 2000 and 2015. Sociodemographic, clinical, and crime-related informa

[The impact on the relatives of psychiatric patients admitted for the first time].

Seventy-three relatives of psychiatric patients aged 18-49 admitted for the first time from a well-defined catchment area were interviewed using the Social Behaviour Assessment Schedule to determine the distress elicited by the patients' illness. The patients were interviewed with the Present State Examination, 10th edition, development version. Regardless of sex and age, frequency of contact and relation to the patient, the relatives experienced distress elicited by symptoms, lowered social performance and the adverse effects of the illness. Informant's social class, male sex of patient and d

[Stalking: unwelcome company. The psychopathology of a modern phenomenon].

The term stalking describes a pattern of behavior in which the victim is pursued, pestered and threatened. In many cases, the stalker resorts to physical violence, and may even commit murder. In the German-speaking areas, the phenomenon is to date not much discussed in the psychiatric and psychological literature, despite the fact that it is a widespread occurrence. While stalkers are diagnosed as suffering from schizophrenia and/or narcissistic as well as borderline disorders, victims have no typical "victim personality". They do, however, respond to stalking with anxiety, depression and post

Practices and attitudes among Swedish psychiatrists regarding the ethics of compulsory treatment.

Few empirical studies have examined the attitudes and ethical beliefs of psychiatrists. In this study, 328 members of the Swedish Psychiatric Association were randomly selected to respond to a questionnaire containing three clinical vignettes examining involuntary hospitalization, other compulsory interventions, and restraint. The questionnaire also contained 16 controversial statements and items on the abuse of psychiatry. A 60% response rate was obtained. Psychiatrists' responses were influenced not only by the severity of and risks associated with the patient's disorder, but also by family

Impact of statutory revisions to family-petitioned civil commitment in South Korea.

INTRODUCTION: This study examined the impact of statutory revisions in 2016 which aimed to enhance procedural justice within the process of civil commitment for persons diagnosed with mental illnesses (PDMI) in South Korea. These changes included requiring that PDMI pose a threat of danger to self or others and the need for treatment simultaneously as criteria for petitioning civil commitment. Additionally, the revision established a public entity to oversee the legitimacy of petitions to involuntarily commit PDMI to inpatient treatment. Despite these statutory changes, families providing care

[Compulsory procedures in the treatment of somatic diseases in mentally ill patients].

The Danish law concerning commitment and compulsory procedures in psychiatry was reformed in October 1989, and for the first time laid down regulations for compulsory treatment of somatic disease in psychotic patients. The aim of the study was to evaluate whether the law is useful in clinical practice. The course of 28 psychotic patients who were committed and/or compulsorily treated due to severe somatic disease is described. We conclude that the law is a useful tool in the acute treatment of life-endangering somatic disease in psychotic patients.

[Solitary confinement as risk factor for psychiatric hospitalization].

The subjects of this study are prisoners who were hospitalized from custody in a psychiatric clinic. All of such patients of one psychiatric clinic during the period from 1976 till 1978 were compared with a random sample of other psychiatric patients using case reports and other data. Differences were found concerning social, personal, psychiatric, and criminal history as well as psychopathological state and diagnosis. Compared to the complete population of prisoners of the area, prisoners from solitary confinement (mostly remanding custody) were overrepresented. Other risk factors for psychia

[Clinical characteristics among forensic inpatients: A special case, the establishment of social defense "Les Marronniers" in Tournai (Belgium)].

BACKGROUND: In Belgium, the law of "social defense" stipulates that an accused "which is either in a state of dementia or in a serious state of mental disturbance or mental deficiency, incapable of controlling his actions" can be interned. The establishment of social defense (ESD) in Tournai (Belgium) hosts 350 inmates. OBJECTIVES: In collaboration with the Centre for research in social defense, we organized a systematic assessment of patients interned in ESD. This is the first study evaluating prospectively this population. METHODS: Of the total, 229 patients signed informed consent. Differ

A 5-year follow-up study of suicide attempts.

Seventy-five patients were admitted to the ward of the Lund Suicide Research Center following a suicide attempt. After 5 years, the patients were followed up by a personal semistructured interview covering sociodemographic, psychosocial and psychiatric areas. Ten patients (13%) had committed suicide during the follow-up period, the majority within 2 years. They tended to be older at the index attempt admission, and most of them had a mood disorder in comparison with the others. Two patients had died from somatic diseases. Forty-two patients were interviewed, of whom 17 (40%) had reattempted du

How research ethics' protections can contribute to public policy: the case of community treatment orders.

Though community treatment orders (CTOs) were first used in 1986 in Australia, debate about their clinical and ethical merits continues even today. For some, the benefits of reduced frequency and duration of involuntary hospitalizations are believed to adequately outweigh the harms of restricted liberties in community living. For others, however, such benefits are believed to be achievable by simply arranging integrated, devoted community resources sans any threat of forced re-hospitalization. In response to this enduring controversy, this article examines the ethical merits of community order
